Scope of Work for Consulting Services

Dear Mr. Taylor:
Thank you for contacting us about assisting the Fort Collins Water Utilities with wetland
mitigation for the Timberline Road Improvement project. As we discussed in our site
meeting on July 8th, we understand that Water Utilities is seeking assistance in meeting
the requirements of Section 404 Permit Number 200380268 by documenting wetland
and stream conditions at the Timberline road mitigation site to the U.S. Army Corps of
Engineers. Specifically, the City requires a field assessment, annual monitoring report,
and identification of possible actions to achieve a successful mitigation site.
Based on our discussions, we understand that the mitigation work along Fossil Creek
was conducted in 2004 and included wetland creation and stream restoration. The
Planned wetland and reconfigured channel are now underwater and few wetland
plantings have survived. This project is not meeting the design intent.
This letter outlines our proposed scope of work and fee for assessing the site, submitting
an annual report to the Corps of Engineers, and recommending improvements to
achieve the desired mitigation project.
Phase 1 — Field Investigation
Biohabitats will conduct a site assessment of the project to document current conditions
of the mitigation area and compare wetland development to conditions specified in the
Mitigation Grading & Planting Plan of the 404 permit. Prior to the site visit, we will
investigate records of Water Utilities and Natural Areas regarding pre -project conditions
and project construction. Documentation activities will include lists of dominant plant
species and noxious weeds, estimates of percentages of ground surface area that is
vegetated and cover by wetland species in vegetated areas, a hand -drawn map of
wetland areas on current aerial photography (or as -built plans, if available) to be
provided by the City, and establishment of photo points to be used in subsequent
reports. As part of this task, we will make observations of mitigation wetland successes,
failures, and problems.
During the site assessment, Biohabitats will also make observations on the morphology
of Fossil Creek as it relates to the mitigation design. In addition, we will assess the
hydrology of the area using existing information provided by the city, observations of
features such as the drainage ways and the Timberline Road culvert, and a spot check
of elevations. Information on Fossil Creek Reservoir east of Timberline Road will also be
evaluated. Discussions with persons knowledgeable about past construction activities,
soils, geology, Fossil Creek reservoir, and groundwater may be conducted as needed to
gather additional insight into pertinent controlling factors.
Biohabltats will flag any items that need mapped for the City to survey. Biohabitats will
have a staff person visit the site to meet with the survey crew and provide guidance to
make sure that the appropriate items are surveyed.
Phase 2 — Annual Report Preparation
Biohabitats will prepare a draft annual monitoring report to the Corps of Engineers as
outlined in their letter dated June 10, 2010, including:
a) Permit number and county where the project is located.
b) Discussion of successes, failures, and problems.
c) Discussion of wetland area with wetland data sheet.
d) Discussion of stream morphology in the mitigation site based on our
observations.
e) Discussion of hydrologic conditions based on our observations.
f) Notes of current conditions marked on the Mitigation Grading and Planting
Plan.
g) Photographs documenting site conditions.
Biohabitats will submit a draft to the City of Fort Collins Water Utilities for review. We will
then prepare a final version for submittal that incorporates the City's comments.
Phase 3 — Recommendations Memorandum
Based on information gathered during Phase 1, we will prepare a memorandum with
conceptual sketches recommending potential actions to achieve a successful mitigation
project with the required 2.73 acres of wetland and 1.05 acres of restored Fossil Creek
stream channel. As part of this phase, we will contact the US Army Corps of Engineer's
Denver Regulatory Office regarding acceptable actions to increase wetland area.
Schedule and Fee
We are available to assist the City with this project upon notice to proceed, and
anticipate that the field work could be conducted as early as the first two weeks of
August. Our lump sum fee to conduct the above scope of work is $12,000,
