Dear Mr. O'Neill;
Please accept this Proposal in regards to bid solicitation 7142 requesting acquisition and
relocation services for the North College Avenue Improvement Project from the City of Fort
Collins. As representatives of the City Real Estate Services and Engineering Departments are
aware, Western States has maintained a keen interest in this Project over the past several years
and have followed its development to its current status where the City is now ready to begin the
right of way acquisition and relocation process to enable this Project to be approved for
construction. Personally, I have attended several meetings with city staff and selected property
owners along the Project to provide advice and suggestions that relate to the acquisition process
and the implementation of the federal regulations that govern same. Within this proposal, you
will note that we suggest that Mike Morgan and I will be the principal members of Western States
Land Services assigned to perform this work should the City select our firm. Both Mike and I
have a long history in Fort Collins and are very much aware from a personal basis of the need for
transportation improvements along the North College Avenue corridor. The implementation of
this Project will benefit greatly both the general traveling public and the area businesses that are
situated along this important urban corridor.
Western States is fortunate to have developed a strong working relationship with the City of Ft.
Collins and specifically its department of Real Estate Services and Transportation Planning. As
the City is aware, we are currently pursuing right of way and relocation services for the City's
BRT — Mason Corridor Project. Our level of effort currently applied to the Mason Corridor is
such that the addition of very similar services for the North College Avenue Improvements
Project would make for a very smooth and even transition. As noted, we would intend to utilize
the same personnel for North College as are currently working on the Mason Corridor Project.
As set forth elsewhere in this proposal, we have additional resources that would be available if
necessary. In essence, Western States is prepared to provide the same level of services to the City
on the North College Project as are currently employed on Mason Corridor and we have the
distinct advantage of current knowledge and practice utilizing the City's internal acquisition
policies and procedures. Additionally, we have a strong relationship with Region 4 of the
Colorado Department of Transportation, which will oversee the right of way acquisition and
relocation process for the North College Project. We have already attended several meetings with

IMPROVEMENTS PROJECT
We have carefully reviewed the information contained in the City's Request for Proposal. We have printed
several copies of the preliminary right of way plans established for this Project and have performed a field
' review of the project area in general and the specific properties from which right of way will be required to
accommodate the Project. Our scope of services detailed below is consistent with the requirements of the
Uniform Act and the City's internal procedures. As we conduct our scope of services, as previously
' mentioned, we are very aware that our services must blend successfully with all functions required for the
successful completion of this Project, including the City Real Estate staff, City Attorney's office, title
services, appraisal services, project engineering and surveying.

' An important aspect of a successful real estate acquisition program must include coordination between all of
the providers of the basic building blocks involved with real estate acquisition, and if necessary, relocation.
Western States will interface with the City of Fort Collins Department of Real Estate Services ("City"/
"RES") and engineering staff and the title, survey and appraisal sub -contractors in order to coordinate the
overall acquisition process. As necessary, this coordination will include attendance at public meetings,
project meetings with the City's Project Managers and, engineering, appraisal, survey and title consultants.
tWestern States' project management efforts will include the following:
1. Prepare and maintain a parcel tracking spreadsheet in a format similar to that demonstrated on
Appendix C of this proposal. Said spreadsheet shall include a current reporting for all real
estate related elements such as appraisals, surveys, title work, negotiations and condemnations;
2. Obtain plans and other necessary information for prosecution of the work contemplated;
' 3. Review appraisal, survey and title information to assist the City / RES in determination of
adequacy of work products;
4. Work directly with title and appraisal co -consultants to address issues that may arise during
' negotiations and closings;
5. Organize and attend, as necessary, meetings between the public, City and the project
consultants to discuss Project's status, concerns, etc.
' We routinely transmit and coordinate the above information through electronic means including e-mailing
and posting to and from City provided web based portals.
' Western States understands that the City's standard process for acquisition of real estate under threat of
condemnation includes obtaining an Ordinance through its City Council prior to initiation of formal
negotiations. In order to obtain the aforementioned Ordinance, the City must have right of way plans and
legal descriptions, along with correlating title reports that specifically define the ownerships and property
rights that the City will seek to acquire. Although the process of accumulating this information and making
' a formal presentation to City Council is typically an in-house function for the City / RES staff, Western
States will be available to provide assistance as necessary. In order to prepare for the upcoming negotiation
process, Western States will meet with the appropriate representatives of the City / RES and obtain right of
way plans, legal descriptions, documentation formats and related correspondences and prepare an initial
' schedule for the acquisition activities. We will review with the City compliance of the proposed acquisition
program with the procedures required by CDOT Region 4, appropriate federal regulations (Uniform Act)
and local laws. During this first phase, the following additional items will be accomplished:

1. Obtain overview of the Project in order to provide an accurate explanation to the public;
' 2. Identification of previous communications, if any, with subject property owners;
3. Field reviews as necessary of the Project to view general conditions of the real estate and
special circumstances, etc.

' Once the City has adopted the aforementioned Ordinances, Western States will provide written Notice of
Interest to Acquire and Authority to Obtain Appraisal (NOI) letters to the subject property owners.
Subsequent to the NOI letters, Offer letters and potentially Final Offer letters and similar documentation
' will be utilized during the negotiation process. Due to our current working experience with the City of Fort
Collins, we are well aware of current City documentation and maintain a complete electronic library of
acquisition formats established by the City. As necessary, we will blend this document with that required of
CDOT and the federal process in order to maintain compliance relative to the federal funding that will
' provided for this Project.
We understand that the Project Appraiser, Bonnie Roerig and Associates, may have initiated her initial
' research relative to comparable property sales along the project area. We have confirmed with City staff
that once the NO] letters have been issued, Roerig and Associates will be cleared to make direct contact
with the specific ownerships involved with the right of way in order to complete the appraisal process. We
' note that several of the parcels identified in the preliminary right of way plans are relatively small and may
qualify for a valuation process such as the CDOT Value Finding (less than $10,000).. Western States has
considerable experience in performing Value Findings and similar valuations and can coordinate these with
the project appraiser and RES if requested. Typically, Western States prefers to accompany the appraiser
during initial field meetings with the subject property owners. This is particularly important should any of
these properties involve any potential Relocations. Although at this time it is believed there will be no
' relocations required for this project, in the event there are any potential Relocations, it is very important that
the real estate appraiser and acquisition / relocation agent have a clear understanding of personalty versus
realty as that can have a significant impact on the relocation process. Accompanying the appraiser during
the initial inspection with the property owner also provides a good beginning point for building a future
relationship with the property owners in order to foster amiable and successful negotiations. It also is a
recommended procedure in the event Value Findings are requested.
' In the event during the initial appraisal inspections potential Relocations are noted, a Stage Relocation Plan
should be prepared. Initial field review of the Project indicates that any Relocations will likely be personal
' property moves only, which will simplify the Stage Relocation Plan preparation and documentation. In the
event a relocation is considered necessary, a Notice as set forth by 49 CFR Part 24 regarding same shall be
sent to the affected property owner(s).
' Once the Project Appraiser's report has been completed, reviewed and approved by the City / RES and
CDOT for presentation of an Offer, we will submit the City's formal Offer based on the Determination of
Fair Market Value (FMV) provided by CDOT and using approved documentation as referenced above. The
' Offer of Fair Market Value we will propose to the City is similar to the summary provided for CDOT
federal aid projects in Colorado. We will attempt to present all Offers in person to the extent that
circumstances allow. As negotiations proceed, we will maintain a current status report and log detailing the
' significant aspects of the negotiations and issues arising there -from. Although not mandated in the Code of
Federal Regulations, we note that CDOT has adopted a minimum 30-day negotiation frame as suggested in
the aforementioned Regulations and we expect that our negotiations will conform to these standards. As
' necessary, we will seek guidance and assistance from representatives of the City / RES to consider issues

' that may arise during the negotiations. As negotiations continue, Western States will provide the City / RES
with current updates, both written and verbal as to the status of the acquisitions. The purpose of this
' function is to bring negotiations to a close, either by acquisition of a signed real estate agreement or by
determination that voluntary acquisition is not possible, and impasse in the negotiations has been reached.
In the event negotiations have stalled over economic terms, we will suggest to the property owner that they
' consider a Possession and Use Agreement as set forth in our initial Offer to Acquire letter.
Federal Acquisition programs provide for donations pursuant to Federal Regulations. At this time we are
' not aware that there may be any donations on this Project, however, in the event a donation is offered under
the appropriate circumstances, we will prosecute those acquisitions in a format consistent with Uniform Act
provisions. A donation format consistent with that utilized by CDOT will be utilized for this circumstance.
' In the event the conclusion of our initial negotiation attempts do not result in a signed right of way
agreement or a possession agreement, we would suggest to the City / RES that a Final Offer be presented to
the property owner using documentation approved by the City.
' C. SETTLEMENTS - CLOSIN(:
' Upon receipt of a signed Right of Way Agreement or Possession and Use Agreement, Western States will
forward same to the City / RES for further processing by the City. As Agreements are approved and signed
by the City Western States will endeavor to return copies of counter -part originals to the property owners.
..Except in the case of very simple acquisitions (such as stand alone temporary construction easements) it is
our. understanding that the City will wish to close all transactions through its title provider. Western States
' will coordinate with the City / RES and the title provider in order to close the transactions and convey the
necessary property interests to the City for construction purposes. In the event a final settlement exceeds the
Fair Market Value previously approved by CDOT, an Administrative Settlement will be prepared and
' submitted to CDOT for approval. This approval is necessary in order to receive federal participation in the
right of way settlement in excess of the pre -approved Determination of Fair Market Value. We have
prepared many such Administrative Settlement requests on past federal aid projects and are prepared to
' accommodate this function as needed for the North College Avenue Improvement Project.
As the title company works towards closing any acquisition, we will interface appropriately to ensure all
' parties are kept informed of the closing status. In certain cases the City may determine to deposit the agreed
upon consideration into escrow with a title company in return for possession of the necessary real property
interests. To the extent practical, we can also provide assistance to the title company in an effort to obtain a
' release of financial encumbrances such as deeds of trust and mortgages against the real property being
acquired. As mentioned above, for simpler acquisitions (generally less than $5,000) Western can "close"
those acquisitions through direct payment to the property owner and obtain a Closing Statement and Receipt
in a standard CDOT format.

' As negotiations progress, the City / RES will be aware through written and oral communications of any
parcels which appear likely to reach impasse. The specific reasons for difficulties in any negotiations will
set forth in writing and in meetings with the City and its legal counsel. Adjustments will be made as
' necessary during the negotiation process relative to any legal advice or strategy required by the City
including Compromise Offer letters to afford the City limited protection from potential attorney's fees.
Provided we are at a final impasse in negotiations and pursuant to instructions from the City / RES Western
States will provide a packet to RES and its legal counsel which contains, in chronological order, all

' pertinent file information regarding negotiations, appraisals, title work and other information necessary to
assist the City in filing the proper pleadings in eminent domain. As directed, Western States will be
' available to assist the City in any pre -hearing / trial conferences and provide testimony regarding good faith
negotiations in District Court.
' E. RIGHT OF WAY CLEARANCE
Once the acquisitions and any relocations have been completed, Western States will prepare necessary
' documentation as required by CDOT, Region 4 and request that the Region provide a right of way clearance
for the Project. We will coordinate the preparation of this final documentation with the City so that all
necessary documents, forms and other requests are submitted to CDOT simultaneously to ensure the right of
way clearance process is completed and the City may be released to go to Ad for construction of the Project.
' F. EXAMPLE OF PROCESS — SAMPLE SCHEDULE
Pursuant to the City's RFP and review of information available through the preliminary right of way
plans, we believe that there are between 30 — 34 property owners identified from which multiple parcels
of right of way (fee and easement) will be required to accommodate the Project. Due to the nature of the
' Project, it is generally required that all parcels of right of way demonstrated on the approved right of way
plans must be in the possession of the City in order to obtain CDOT Right of Way Clearance. For this
reason, all of the parcels are essentially on the same schedule, which, according to the City's RFP
requires acquisition by March 2011 to accommodate the City's construction schedule. Attached is a
sample schedule showing the primary components of the right of way acquisition process and timing to
accommodate a March 2011 acquisition time frame.
' . This is a fairly aggressive schedule to acquire the necessary right of way to accommodate the Project.
Should any of the tasks as demonstrated on the sample schedule slip, the corresponding and dependent
' task(s) may likely require a similar adjustment. Western States is accustomed to the intangible aspect of
right of way acquisition and will make adjustments to its services as necessary to attempt to maintain the
project schedule.

' The following is a brief list of representative projects that.we have performed for other agencies along the
Front Range of Colorado, including projects where we were required to employ the provisions of the
Federal Uniform Act.
' COLORADO DEPARTMENT OF TRANSPORTATION — AUSTIN TO HOTCHKISS
CORRIDOR (Project STA 092-018) — during calendar year 2008, Western States Land Services, Inc.
' was the sole right of way acquisition consultant to the Colorado Department of Transportation, Region 5
headquartered in Grand Junction relative to the aforementioned Project. The Project included 22 parcels
including fee right of way, permanent and temporary easements from approximately 18 individual and
' distinct property ownerships. The Project primarily entailed the widening and slight re -alignments to
State Highway 92 between Austin and Hotchkiss Colorado. All negotiations were settled successfully
through initial negotiations save two, which were forwarded to the State Attorney General's Office for
' processing. The State Attorney General's Office was ultimately able to resolve those acquisitions without
filing condemnation. Our initial budget for this project was $84,030.00. At the conclusion of the project,
approximately $29,700 of the remaining original budget for Western States Land Services, Inc. remained
unspent. Western States Senior Right of Way Agent, Michael D. Morgan was our primary agent for this
' project. Supervision was provided by Phil B. Mazur, SR/WA Owner and President of Western States
Land Services, Inc. Our primary contact for this project was Ms. Dorlynn Erickson, Right of Way
Supervisor for CDOT Region 5 at (970) 683.6232.
COLORADO DEPARTMENT OF TRANSPORTATION — REGION 4 — BERTHOUD BY-PASS
(PARKWAY) AND RELATED EXTENSION OF US HIGHWAY 287 (NH 2873-068 Unit 2) —
' Between calendar year 2000 and 2003 Western States provided acquisition and relocation services to
CDOT Region 4 for the aforementioned Project. The Project was divided into several Units (Sections)
that ultimately included approximately 42 individual and distinct land ownerships from which fee,
' permanent easements and temporary construction easements were acquired. The Project entailed

' acquisition of new, virgin right of way to accommodate the Berthoud By -Pass (now called Berthoud
Parkway) and multiple smaller strips of right of way and easements at both points where the by-pass
' project joined existing US Highway 287 southwest and north of Berthoud. The Project involved several
commercial and residential relocations, and one of the residential relocations was appealed whereby
Western States represented CDOT during the appeal process. As the Project had several phases, the
budgets were broken down between the various sections. The ultimate budget for all of the work was
approximately $300,000 and at the conclusion of our services there remained approximately $75,000 as
unspent compensation to Western States Land Services, Inc. The primary agents that worked on this
Project were Brent Simanski, and Hervey Smith from our Thornton office. Phil Mazur, SR/WA provided
' daily supervision. Our primary contact for this Project was Mr. Bob Grube, CDOT Region 4 Right of
Way Manager at (970) 350.2152.
' CITY OF LOVELAND — TAFT AVENUE IMPROVEMENTS PROJECT PHASE I AND PHASE
II — Western States has been providing right of way acquisition and relocation services to the City of
Loveland for this Project since 2001. The Project has been divided into several sections and not all of the
' right of way acquisition has been slated to occur simultaneously. At the onset of the Project, the City
requested that Western States establish an Acquisition and Relocation Program to be utilized for this non-
federal project. Western States prepared a Real Estate Acquisition Guideline brochure and a Relocation
' brochure for the City for use on this and other City projects. Many aspects from the Federal Uniform Act
and CDOT Right of Way manual were applied to these documents. Due to the ebb and flow of this
Project, there have been times when Western States agents have been very actively involved and other
' periods where the right of way acquisition activity has been fairly dormant. The Project .has .included
acquiring several residential properties in whole and a multitude of smaller tracts of right of way in fee
with associated permanent and temporary easements. To date, none of the acquisitions have resulted in
condemnation. Over the past seven years, our total invoices for this Project have amounted to
' approximately $360,000. Due to the varying schedule and parameters for this project, an initial budget
was not established. Principal agents assigned by Western States to this Project are Mr. Ron Loose and
Phil Mazur, Company Principal. Our primary contact with the City of Loveland for this Project is Mr.
' Ross Shaw, P.E. at (970) 962-2636.
CITY OF LOUISVILLE — STATE HIGHWAY 42 AND SOUTH BOULDER ROAD
' INTERSECTION IMPROVEMENTS PROJECT - During the calendar year 2009, Western States
Land Services, Inc. provided consulting right of way acquisition services to the City of Louisville for the
widening and improvements at the intersection of State Highway 42 and South Boulder Road in Northeast
' Louisville. Essentially the project included acquiring temporary easements to accommodate the widening
of the existing roadway, installation of new sidewalks, utilities and signalization and re-establishment of
certain landscaping features. It was determined early in the project that various areas of existing CDOT
' right of way had been utilized by the adjoining property owners to install landscaping and utilities. Our
work included preparing value findings for the various acquisitions as demonstrated on the CDOT
approved right of way plans and working with the property owners to offer the re-establishment of certain
' landscaping features on their adjoining property. Once approved right of way plans were provided,
Western States issued all formal Notice of Interest letters and formal Offers to the subject property
owners and pursued all negotiations through successful completion. Resolution of access became a major
issue during the course of the negotiations due to the re -configuration of the intersection. Western States
' completed the closing of all acquisitions and assisted the City of Louisville in obtaining right of way
clearance through CDOT Region 4, enabling the City to go to Ad as initially scheduled for the Project.
All work performed for this Project was performed within the initial budget established for our services.

' COUNTY OF LARIMER, COLORADO — LARIMER COUNTY ROAD 19 (NORTH TAFT
AVENUE) LAPORTE AVENUE TO POUDRE RIVER — Western States provided right of way
acquisition services for Larimer County for this non-federal aid project between 2005 and 2007. The
' Project essentially consisted of widening and improvements to existing North Taft Avenue and included
acquisition of strips of right of way in fee, permanent easements and temporary easements. Due to the
extreme close proximity of homes and landscaping to the project area, there was considerable
negotiations regarding mitigation for landscaping losses and the like. There were three residential
properties that were purchased in whole and we assisted the County and property owners in developing an
appropriate relocation program to assist with these acquisitions. Overall, there were slightly over 100
' separate and distinct property ownerships with which Western States needed to perform negotiations.
The primary agent for Western States for this Project was Mr. John Doty, assisted and supervised by Phil
Mazur, owner. Our budget for this Project was approximately $ 115,000 and at the conclusion of our
' work there remained slightly over $17,000 in unspent funds for our services. It is noteworthy that the
initial budget was established to accommodate our services for approximately 12 months and, in fact, our
work carried forward for over two years. Our primary contact for this work was Mr. Jerry White (semi-
retired) and Charles Johnson with the Larimer County Public Works / Engineering Department (970) 498-
5725.
U.S. HIGHWAY 287 — RECREATION TRAIL UNDERPASS (FEDERAL AID PROJECT) —
During calendar years 2009 and 2010, Western States assisted the City of Loveland with acquisition of
permanent and temporary easements to accommodate the underpass of a recreational trail beneath U.S.
Highway. 287 on the north edge of Loveland. The acquisitions were acquired from two separate and,
distinct owners of real property. Once parcel required a third party appraisal and the second parcel was
valued utilizing a Value Finding prepared by Western States. The negotiations were considerably

DThe following is the standard fee and cost schedule for Western States Land Services for calendar year
2010 - 2011. These fees and costs are applicable to the City of Fort Collins North College Avenue

COST ESTIMATE
As demonstrated in the schedule included with this proposal, it is anticipated, that the project services
will begin immediately upon receipt of Notice to Proceed from the City, which is anticipated to be
around July 1, 2010. As previously discussed, right of way acquisition and relocation services are
' intended to occur simultaneously with all necessary property owners along the Project. From a staff level,
we plan to utilize Michael D. Morgan and Phil B. Mazur as the principal field agents and office support
from Linette Kwan to perform the acquisition services. In the event additional assistance is necessary, as
indicated in the Personnel section of this proposal, we have additional agents available to work on this
Project.
' Due to the various intangible aspects of right of way acquisition and relocation, it is difficult to estimate
a "Not to Exceed fixed bid" for our services. We strive to provide an efficient and frugal service for our
clients and we typically complete our assignments for less than the fees that we estimate at the onset. We
strive to achieve an economy of scale in our services whereby we attempt to consolidate our project
meetings with the client, project team members and property owners. In fairness to our clients and the
property owners with whom we will work with on a personal level, we realize that any given set of
' negotiation services cannot be accurately measured in terms of hours of service spent for a particular
acquisition or relocation. When working on federally funded projects, we also realize that there is an
additional effort required in order to comply with the documentation and standards established by CDOT
' and this is reflected in our hourly estimates. Based on our past experience with similar projects and the
specific scope and schedule established by the City for the North College Avenue Improvement Project,
Phase 11, the following is an estimate of our overall projected cost:

* As noted elsewhere in this proposal, it is not anticipated there will be relocation services necessary for
this Project. In the event relocations are required in order to meet the requirements of the Project and
Uniform Act, we will review with the City the potential costs involved with same.
The above quotation is not considered as an absolute bid and it is Western States practice to charge our
clients only the actual hours and expenses incurred on any project. In the event, upon the completion of
our services we have not expended the entire budget referenced above, then that would result in a cost
savings to the City. As noted in our budgetary review included in our project references, that has been a
typical occurrence. In the event unforeseen circumstances arise during the prosecution of our work, or
should additional services be requested by the City, causing our services to exceed the above established
budget, then we would not incur charges in excess of this amount without providing to the City the basis
for any adjustment in our budget and receiving approval of same. Our costs are estimated on the
presumption that all work will be released simultaneously and not fragmented.

' SUMMARY — STATEMENT OF UNDERSTANDING
' This Proposal has been constructed in order to outline the experience, methods and estimated_ costs of
Western States Land Services, Inc. (Western States) to perform right of way acquisitions and relocation
services pursuant to federal regulations necessary to facilitate the North College Avenue Improvement
' Project Project. We believe our current and past experience working directly for the City of Ft. Collins on
a variety of projects involving federal aid along with a host of other state and local agency clients along
the Front Range of Colorado well demonstrates our capabilities and experience.
' We have carefully examined the Request for Proposal documents and other pertinent project data. We
have downloaded the preliminary project right of way plans and have performed a field review of the
entire project area as it relates to right of way. We have had brief meetings with representatives of the
' City Real Estate Services staff to clarify certain elements of the Project. Specifically, we understand that.
the City staff will be responsible for acquisition of right of way from the Union Pacific Railroad and any
permission required to construct within the right of way of the lake canal.
Our proposal demonstrates our active experience on similar projects subject to the Uniform Relocation
Assistance and Real Property Acquisitions Policies Act of 1970, as Amended, along the Front Range of
' Colorado over the past 15 years. Our company and the personnel suggested have well over the minimum
of five years of successful acquisition and relocation experience pursuant to the Federal Uniform Act as
set forth in the City's requirements. Our company continues to be approved by the Colorado Department
of Transportation as a qualified right of way acquisition and relocation consultant. It is noteworthy that
' both Mike Morgan and Phil Mazur proposed for these services, are past employees of CDOT Region 4.
We have reviewed the Project requirements for the proposed consultant and are confident the information
contained herein will demonstrate that we meet and exceed these requirements.
' Within this proposal you will find information relating to specific projects that demonstrate our current
and past experience on similar federal aid project for Local Public Agencies. Within this proposal, we
have set forth the hourly rates and fees that we propose for the contemplated services. We have also
provided an overall estimate of costs, noting that there are several variables that are yet to be defined that
can impact the final work expended and resulted costs.
' STATEMENT OF UNDERSTANDING
' Western States is very familiar with the Scope of Services set forth by the City and required to
successfully accomplish the necessary real estate acquisitions and relocations required for the North
College Improvement Project. The Scope of Services will be greatly influenced by the requirements of
the Uniform Act and the internal procedures of the City of Fort Collins Real Estate Services and the City
Attorney's office. The basic building blocks required to achieve the services will include compilation of
title information, legal descriptions, approved right of way plans, appraisals and compilation and
processing of right of way acquisition documentation in a format approved by both the City and CDOT.
Western States recognizes the need to work on a responsive and fluid basis with the City staff and the
variety of co -consultants to successfully implement and complete the right of way services in a competent
and timely manner. The following statement of Qualifications and presentation of Scope of Services will
' demonstrate our abilities and understanding of the process to achieve the goals of the City for this project.

Incorporated in Larimer County in 1981, Western States Land Services, Inc. (Western States) is one of the
few companies headquartered in Colorado, which offers exclusively real estate acquisition and relocation
services for public entities. Western States performs well over 90 percent of our work along the Front

in the services offered. Western States does not import / export "contract agents" from other locals or
' otherwise act as a body brokerage when it comes to the personnel we use. Our philosophy is to concentrate
our efforts where we are most knowledgeable of the people, customs, laws and the "lay of the land."
' Our experience with a variety of clients and types of projects has allowed Western States the opportunity to
gain considerable experience with many different acquisition systems and has enabled us to glean those
elements which we have been found superior and apply them to other projects with which Western States is
' involved. We have been fortunate to work with many of the prominent appraisers along the Front Range.
Notably, we have a long history working with Bonnie Roerig and Associates, the City's Real Estate
Appraiser for the North College Avenue Improvement Project. We currently have several on -going
assignments for similar projects where we are working with Ms. Roerig and have discussed with her the
schedule and appraisal process planned specifically for this project.
' The Colorado Department of .Transportation is the lead agency, on behalf of the Federal Highway
Administration, in administering most federally assisted acquisition and relocation projects in the State of
Colorado. Western States has remained on the CDOT pre -qualified and approved list for real estate
consultants since it was initially established in 1996. We are experienced with the acquisition procedures as
set forth in the Uniform Relocation Assistance and Real Property Acquisitions Policies Act of 1970, (Public
Law 91-646) and recent amendments thereto. We are accustomed to employing these procedures when
performing our services on federally funded projects, including programs such as Federal Aid to Urban
' System (FAUS), Intermmodel Surface Transportation Efficiency Act (ISTEA) and Transportation Equity
Act (TEA-21) projects
As previously noted, we have had several meetings to date with representatives of the City and the Colorado
Department of Transportation, Region 4 regarding the specific needs and processes required for this Project.
We will continue to work closely with the City and CDOT to finalize the right of way acquisition process in
a manner that will be most advantageous for the successful and timely completion of this Project for the
City. As is typical of Local Public Agencies receiving federal aid administered through CDOT, we
recognize we must implement the provisions of the Uniform Act as set forth in Regulation (49 CFR, Part
24) which present the basic policies and procedures to be utilized on federallyfunded projects.
Our Loveland office is centrally located within Larimer County and in close proximity to the City of Ft.
' Collins. As our personnel profiles will present, several of the agents that we propose to utilize on the Project
currently reside in the City of Ft. Collins. Three of our principal agents are graduates of Colorado State
University and Mr. Morgan is currently active in CSU Alumni support.
Our office is fully automated, including current architecture computers/word processors, facsimile
machines, scanners, high capacity copiers, high definition plotters and all other necessary office equipment
to allow us to perform all of the necessary functions to complete our services on an in-house basis. We have
' established a website and maintain high-speed Internet connections, including e-mail. Our office proximity
to the City of Fort Collins and the Project gives Western States the advantage of offering hourly rates as
opposed to daily or monthly quotations whereby the City is obligated to accept full time service from its real
' estate consultant, whether the Project requires it or not.

Mr. Mazur will be the Project lead and supervisor for Western States on the. Project. Mr. Mazur is the
President and owner of Western States Land Services, Inc. and has experience performing acquisition and
relocation work pursuant to the Uniform Act since 1996.
Mr. Morgan will be a primary Senior Field Agent assigned to perform the day-to-day acquisition and
relocation functions with the subject property owners. Mr. Morgan lives in Ft. Collins and has over 30-
years of experience performing Uniform Act Acquisition and Relocation services as a former employee of
CDOT Region 4, Right of Way Department. As necessary, Mr. Doty and Mr. Loose will be available to
supplement the day-to-day activities of Mr. Mazur and Mr. Morgan. Our goal is to have sufficient
' personnel available to perform all necessary functions in a timely fashion and maintain flexibility with our
personnel assignments to the extent that we do not overload the Project. Ms. Kwan will be primarily
responsible for preparation of all documentation and reporting format, which will be performed directly out
of our Loveland office.
