PROJECT CHANGE ORDER # 1 Project Name: FORT COLLINS BRT Client Name: MICHAEL BAKER CORP JIM SELL DESIGN Job Number: 2609 Date: 7/2/2010 Client hereby orders the following modification in the described scope of work or orders the following additional services beyond the existing scope of work as defined in the contract: Background The City is in the process of acquiring real property from the owners of the Casey Crwash (Mowery) to accommodate the Mason BRT Project. The City's appraisal consultant, Bonnie Roerhig, is in the process of preparing an appraisal report for this property. Generally, the City is acquiring a 25 ft right of way along the west side of the property adjacent to the BNSF railroad tracks. In addition, the City is acquiring a 5 ft permanent easement and a 20 ft temporary construction easement. The property owner has contracted with a local architect and contractor to prepare a site redevelopment plan and cost estimate to modify the carwash site to accommodate the BRT Project impacts. The redevelopment plan also appears to include other site improvements which are not necessarily associated with the BRT Project. Scope of Services: Review proposed site plan and cost estimate prepared by the property owner with respect to impacts caused by the Mason BRT Project. Provide recommendations as to which portions of the site redevelopment and costs are related to the BRT Project impacts and which are unrelated. Estimated costs: 8 hr. @ $149.35, 8 hr. @ $122.16 = $2,172.08 Provide two (2) alternative recommendations for mitigation to the carwash site from BRT Project impacts including approximate cost estimates. Estimated hours: 16 hr. @ $149.35, 16 hr. @ $122.16 = $4,344.16 Coordinate with City's real estate services team and their appraiser on the project impacts and recommendations. Estimated hours: 6 hr. @ $149.35 = $896.10 The contract sum shall be modified by or the extra work contract amount shall be: ® The Fixed Sum of $7,412.34 ❑ JSD's actual cost plus 10%; or ❑ Other: The Client will be required to accept or reject in writing each phase or requested change or addition to the project to ensure acceptance of the consequences of the requested change. This is to protect both parties' interests and to help achieve Client satisfaction. A signed Change Order Form MUST BE RETURNED BEFORE ANY WORK IS TO BE DONE. The contract sum shall be modified accordingly or the extra work contract amount shall be determined and provided to the Client in writing. If no precise method of adjustment has been determined at the time the change is requested, then the contract sum shall be equitably adjusted within 30 days to compensate JSD for the change at our contracted rates. The amount due JSD for any change shall be due upon completion of the change work. The time for completion of any existing contract shall be modified by the estimated time required to complete the change or by an equitable amount of time if no time estimate is presently available. COST ESTIMATES —STORM DRAIN AT PROSPECT Review of cost estimates prepared by others, and prepare independent cost estimate for storm drain at Prospect. 2. BID ALTERNATES —CSU DRAINAGE OUTFALL Prepare bid alternate (plans & specs) for 24-Inch drainage outfall shown in the plans, and proposed upsize to 54-inch pipe. Accounting of the bid differential is required as CSU will be responsible for the increased cost of the upsize. 3. DOWNTOWN TRANSIT CENTER —MODIFICATION OF BRT BAYS Prepare plans to modify existing bus bays at Downtown Transit Center to accommodate proposed BRT NABi buses. 4. BRT OPERATIONAL ANALYSIS REPORT As a result of the Stations and Stops Working Group Meeting of December 17, 2009, IBI Group and Baker were directed to prepare a planning -level assessment of busway operations and a platform conceptual design assessment for the portion of the Mason Corridor project that would operate beside the BNSF Railway south of University Avenue. The operational assessment consists of four sections: 1. A review of operational considerations made in the work to date; 2. Formulation of guidance, criteria, and methodology for a planning -level operational assessment; 3. The planning -level operational assessment of five alternatives; and 4. Recommendations for moving forward with final design. IBI Group invoice for completed work attached. S. RAPTOR/EAGLE NEST SURVEY AND MEMO FOR SOUTH TRANSIT CENTER The memo will include confirmation of presence or absence of migratory bird (raptor) nests within the X mile of the four acre STC site. Please note that migratory bird breeding season is approximately mid -April through August and the follow-up survey would identify any new nests that may have been built during the 2010 breeding season. This task includes development of a field map, two nesting surveys, a memo, and memo update prior to construction to document findings. Should raptor nests be identified, Baker will Identify additional steps required to for mitigation in the memo, however, USFWS and other consultation is beyond the scope of this change order. 6. RATING PACKAGE FOR BRIDGES (MAIL CREEK BRIDGE AND SPRING CREEK PIPES) Prepare bridge rating packages In accordance with CDOT Bridge Design manual and CDOT Bridge Rating Manual. The following major structures are Included in this task: Mail Creek Bridge and Spring Creek Pipes (classified as a major structure due to size of pipes and spacing). Our proposal is based on the information you have provided, consisting of phone conversations and email correspondence provided on March 23, 2010, March 26, 2010, and June 10, 2010, The defined Scope of Work to be performed and our proposed Fees to be charged are described in Exhibits A and B, respectively. Please note that our fee is subject to review if this agreement is not executed within 90 days. Please contact us with any questions you may have. Respectfully submitted, Cullen Kinoshita Project Manager EXHIBIT A SCOPE -OF -WORK: We propose to provide the following irrigation engineering services: TASK 1.0: Data Collection • Attend a meeting with Design team and City of Fort Collins Representatives to discuss the project, areas to be irrigated, expectations of the irrigation system, centralized control and equipment preferences. • Identify the irrigation water source for each bus station (i.e. existing irrigation system or new potable water tap). If the water sources include connections to existing irrigation systems, it is assumed that as - built information of the existing irrigation systems will be provided by others. • Meet with Colorado State University representatives to coordinate connection(s) to their existing irrigation system. • The results of the above efforts will be summarized in a memorandum and graphic for Design team, City, and CSU approval prior to construction document work. TASK 2.0: Irrigation Construction Documents • Review the site landscape drawings. • Water Use - Calculate the irrigated area based on the landscape drawings from the landscape architect, verify ET data for Fort Collins, Colorado, and calculate peak season and annual ET for the project. A spreadsheet will be developed to show peak season and annual water use. This spreadsheet will also be updated as the project proceeds so that water use information can be kept current. • Tap/Electrical Coordination - Coordinate with the Civil and Electrical Engineers the location and size of future connections. • Sleeving Drawings, Specifications, and Details - Develop drawings, specifications, and details for the installation of irrigation sleeving. • Prepare irrigation demolition documents as necessary. • Prepare irrigation construction documents for the landscaped areas around 8 bus stations along Mason Street and along Mason Street between Lake Street and Laurel Street. It is anticipated that twenty, 20- scale, 24"x36" drawing sheets will be required. Layout drawings will include sprinkler and drip layout, hanging basket irrigation, lateral pipe routing and sizing, valve locations and layout, mainline routing and sizing, and controller locations and stationing. Irrigation construction documents for the landscaped areas on the CSU property will be per CSU standards. • Prepare spreadsheets, calculations, and irrigation schedules per City of Fort Collins requirements. • Prepare Irrigation Specifications in CDOT format. • Develop Irrigation Installation Details. • Prepare an opinion of probable construction cost based on the construction documents. • Submittals - Submit plans, specifications, and installation details for Client review at 65%, 90% and 100% complete. • Meetings - Attend one (1) full day interdisciplinary review meeting in Denver, two (2) full day review meetings in Fort Collins, and four (4) half day coordination meetings in Fort Collins. TASK 3.0: Irrigation Bidding Assistance • Prepare contractor clarifications during the bidding process. Aqua Engineering, Inc. Mason Street BRT Irrigation Engineering Services June 14, 2010 - 2 - ASSUMPTIONS It has been assumed that the following information/services are to be supplied by others before the irrigation design begins: • Accurate and finalized computerized base information compatible with .DWG, .DXF or .DGN formats containing curb lines, building and other hard surface locations, sidewalk locations, grading, etc. • Finalized landscape design. • Water source location, water pressure, and contacts for coordination issues. • Power source locations and contacts for coordination issues. SERVICES NOT INCLUDED • Formal submission of a "pricing" package or partially completed documents. • Site visits or coordination meetings other than those specified. • Electrical engineering, "one -line", or panel board schedules. • Redesign for changes in design after the drawings have been either partially or completely prepared because of site changes, concept changes, etc. (Comments from review meetings will be incorporated) • Record drawings. • Development of existing site as -built drawings. • Evaluation of existing irrigation systems and recommendations for improvements. • Hydraulic evaluation of existing irrigation mainline and lateral pipe systems. • Irrigation design for bus stops. • Irrigation pump station design. • Attendance at pre -bid meeting. • Construction observation services. • Irrigation as-built/record drawings. • Irrigation auditing services. CHANGES Because changes in base information and/or landscape design can significantly affect sprinkler layout and in turn pipe layout and hydraulics, any such changes will necessitate our charging additional fees, as detailed in the Agreement. Therefore, the fees quoted presume the availability of completed base information and completed landscape design before irrigation design begins. Aqua Engineering, Inc.
