Bella Energy will not be responsible for revegetation, repair of sprinkler systems or other underground systems.
Client must ensure that underground utilities and services are clearly marked by a professional locate company.
Bella Energy will not be responsible for drywall repair or painting.
Dirt work in soil conditions other than normal hand digging will be charged additional as appropriate.

Attachment A: Terms and Conditions

3 Bella Energy carries liability insurance in the amount of $2M per event.
4 Only certified and licensed electricians will be used.

6 If Bella Energy is collecting Xcel incentives, Bella reserves the right to specify an alternate recipient.
7 if Bella Energy is collecting Xcel incentives, delays in receiving Xcel incentives caused by client signature delays will be billed at 2% of the
incentive amount for each week of delay.
8 If Bella Energy is collecting Xcel incentives, all documents must be submitted to Bella for submission to Xcel.
9 If Bella Energy is collecting Xcel incentives, installation will not be scheduled until 2nd payment is made and Acknowledgement Letter is
submitted to Xcel.
10 Customer assumes responsibility to provide a shade free environment for the PV array in accordance with the Xcel Energy Solar Rewards
Program.
Price & Discounts
11 This bid price is good for 30 days, prices subject to change.
12 Colorado state tax, local and other applicable taxes may or may not be included in this proposal. All applicable taxes, including use taxes, will
be the responsibility of the customer.
13 Permit and related documentation costs greater than $400 will be included in the final invoice. —
14 Structural engineering from a CO PE licensed Structural engineer may be required. Costs in excess of $500 will be included in the final
invoice.)
15 Price for ground and pole mounts must be confirmed prior to final bid.
16 Discounts apply to projects paid by cash or check as outlined in the Payment Schedule below.
17 Once 2nd payment is received and Acknowledgement Letter/ Interconnection Agreement have been signed/submitted to Xcel, an installation
date will be established.
18 If project is cancelled by customer once costs have been incurred, customer will be responsible for incurred costs.
19 Contract signature implies permission to use names and photos of people or structures in publications.
20 Bella Energy does not make any guarantees regarding the Investment Tax Credit. Customer must collect Investment Tax Credit on their
taxes. Consult your Tax Advisor for specific information.
21 Bella Energy reserves the right to substitute equipment of comparable quality and value, as necessary.
22 Unforeseen and unusual costs incurred will be considered change orders and billed with final invoice.
23 Delays due to equipment, permits, inspections, weather, incentive programs, etc. can delay installation completion.
24 Late fees of 1.5% will be assessed 30 days after payment is due.

Bella Energy 10-year Limited Warranty on Solar Electric Systems
I accept the Terms and Conditions of this contract as stated below

Bella Energy warrants the installation and operation of its installed photovoltaic systems for a period of ten years from the date of installation. This limited
warranty extends to the original owner and any subsequent owner at the same location.
Bella Energy's Responsibilities:
Bella Energy provides this limited warranty for defects in materials, workmanship, and system malfunction under normal use and service for a period of ten
years from the date of initial installation.
Bella Energy will provide field inspection of warranted item(s) in order to verify failure, establish probable cause, and determine the corrective action
required at no charge to the owner promptly upon notification.
Bella Energy agrees to repair or replace any defective parts, within a reasonable time, to the extent of the manufacturer's warranty, at its expense, or
correct a defective installation at its expense.
Customer's Responsibilities:
Customer agrees to inspect the components of, and monitor the performance of, their own system for malfunction or defect on at least a monthly basis
throughout the term of this Warranty.
Customer agrees to notify Bella Energy in writing of any observed system malfunction or defect within 5 business days of discovery of any such malfunction
or defect.
Customer agrees not to allow any person or entity to attempt to repair, fix, adjust or tamper with the system or any components thereof without the
expressed written consent of Bella Energy, except in the case of emergencies.
The above warranty does not apply to the tollowing conditions, situations, or claims:
Defects in a component which is/was not a component part of the original system installed by Bella Energy.
Damage of any sort resulting from abuse, misuse, neglect, negligence, vandalism, accidents, fire, abnormal weather conditions, hail, utility power spikes,
rodents or other animals, Force Majeure, or "acts of Nature".
Normal expected fading and minor deterioration of exterior surfaces of PV system components, or seasonal variation in power output.

Conditions resulting from defects in roofing or structure that exist prior to system installation, or, structural damages caused by, or allegedly caused by the
system.
Conditions resulting from repair, removal, or alteration by anyone or any entity other than Bella Energy, the original equipment manufacturer, or their
expressly authorized representatives.
Any system for which there is an outstanding balance due (including utility rebates assigned) for any reason.
Defects in, or performance of, battery system components, or other components, other than those covered by manufacturer warranties.
Consequential damages, including, but not limited to, loss of use, loss of income, personal injuries, or any other non -repair damages that may be alleged,
related to malfunctioning of the system.

WAGE DETERMINATION APPEALS PROCESS

On survey related matters, initial contact, including requests
for summaries of surveys, should be with the Wage and Hour
Regional Office for the area in which the survey was conducted
because those Regional Offices have responsibility for the
Davis -Bacon survey program. If the response from this initial
contact is not satisfactory, then the process described in 2.)
and 3.) should be followed.
