RE: Proposal for Railroad and Public Utilities Commission Coordination Services
Mason Bus Rapid Transit (MAX) and Mason 2-way Conversion Projects
Fort Collins, Colorado
Dear Kathleen:
Felsburg Holt & Ullevig is pleased to submit this proposal to provide continued support to the
City for coordination efforts with the BNSF Railway associated with the bus rapid transit MAX
project. We are also including as pail of this proposal, time for assistance with the Public
Utilities Commission application for conversion of Mason Street to 2-way traffic.
Based on our recent discussions with regard to the direction of the BNSF Railway coordination
effort, we have outlined the following Scope of Services and Fee Estimate to assist you with this
task. This scope of services assumes a 6 month timeframe to align with the FTA schedule for
identifying the terms of use of the BNSF Railway right-of-way. Therefore, an approximate end
date for this scope would be April 30, 2009,
SCOPE OF SERVICES
BNSF Railwav Coordination
FHU will assist with coordination for use of BNSF right-of-way. Anticipated coordination items
include:
Preparation of the revised City letter to the .BNSF identifying the City's desire to use the
BNSF Railway right-of-way
Preparation of a draft Construction & Maintenance Agreement and draft Public Roadway
Easement document for consideration by the BNSF Railway
Preparation of exhibits associated with long term occupancy of design elements on BNSF
right-of-way property

• Phone/electronic coordination with BNSF Railway and Jones Lang LaSalle Americas,
Inc. (formerly Staubach Global Services, Inc.) to progress the agreements and obtain
periodic status of the progress
• :Project Meetings with the City and/or BNSF as necessary (assumes 4 for fee estimate)
Colorado Public Utilities Commission (PUC) Coordination
FHU will assist with PUC coordination for conversion of Mason Street to 2-way traffic through
the downtown portion. Anticipated coordination items include:
• Preparation of the draft PUC application for the 2-way conversion
• Preparation of the associated exhibits to the application
• Preparation of the City's request for cost estimate from the BNSF Railway to adjust
railroad related warning devices for 2-way traffic along Mason Street
• Assisting the City with preparation of the list of adjacent land owners/lessees and utility
owners as required by the PUC for distribution of the application for review
• Monitoring of the application progress through the PUC
• Assisting the City with response to any comments received regarding the PUC
application
Phone/electronic coordination with the PUC and BNSF Railway, as necessary
It is assumed that once the Public Utilities Commission has rendered a decision document on the
2-way conversion, which will list the work to be done and the parties responsible for the work,
the City's Engineering Department will coordinate directly with local BNSF Representatives for
the timing of the necessary adjustment of the railroad elements to coordinate with the roadway
conversion.
FEE ESTIMATE
We propose to conduct this work on a time and materials basis. In such an agreement, we are
compensated for our services at our standard hourly rates and direct expenses are reimbursed at
1.1 times cost. The following are our standard hourly billing rates for staff anticipated to work
on this project:

S 135.00/hour
S 90.00/hour
S 65.00/hour
At these rates, we estimate that the above scope of work can be completed for a maximum
budget of S 15,000. We will not exceed this amount without your prior approval. Attendance at
meetings beyond those identified will only be at your request and will be billed as additional
services at the same hourly rates. If the conditions of this proposal are acceptable, please process
a contract change order through the normal channels. If you have any questions, please call.

NOTES:
1. Fee estimate assumes the PUC application will be uncontested. If the application is contested, the process escalates to a legal arena and hearing. No costs are included on the part of
Felsburg Holt & Ullevig for this effort.
2. Costs are not included for survey of the proposed new crossing easement. It is assumed the City will complete surveys of the easement areas and generate legal descriptions. Note the
surveyor must be BNSF Safety trained.
3. It is assumed that CDOT will not be party to the Construction and Maintenance Agreement, Easement Agreement or Public Utilities Application. If CDOT coordination is necessary, FHU
can provide a revised fee estimate for that effort.
