HomeMy WebLinkAbout436737 HOK VENUE - CONTRACT - RFP - 32985 P1083 FEASIBILITY ANALYSIS FOR DOWNTOWN AMPHITHEATERPROFESSIONAL SERVICES AGREEMENT THIS PROFESSIONAL SERVICES AGREEMENT ( Agreement) made and entered into the day and year set forth below by and between THE FORT COLLINS COLORADO DOWNTOWN DEVELOPMENT AUTHORITY a body corporate and politic (the DDA) and HOK Sport Inc a Missouri corporation ( Professional ) WITNESSETH WHEREAS pursuant to C R S §31 25 808 the DDA has authority to make public improvements which benefit those downtown areas of Fort Collins within its boundaries and WHEREAS the DDA desires to build a downtown amphitheater to serve the functions of Beet Street and as a community -wide town square and WHEREAS on December 7 2006 the Board of Directors of the DDA (the Board ) approved the expenditure of up to One Million Two Hundred Seventy Thousand Dollars ($1 270 000) of DDA funds for pre construction expenses associated with the development of the downtown amphitheatre and WHEREAS on November 12, 2007 a selection committee consisting of two members of the Board DDA staff the Executive Director of Beet Street and representatives of the private sector the City of Fort Collins Purchasing Department Colorado State University and the Fort Collins Symphony selected the Professional to perform certain pre construction activities including assistance with site selection analyses of financial feasibility and operations programming and design for a downtown amphitheatre as described in the Scope of Services set forth on Exhibit A hereto under Project Description (the Project ) NOW THEREFORE In consideration of the mutual covenants and obligations herein expressed it is agreed by and between the parties hereto as follows 1 Scope of Services The Professional agrees to provide services in accordance with the scope of services attached hereto as Exhibit "A consisting of seven (7) pages and incorporated herein by this reference ( Scope of Services ) 2 The Work Schedule The services to be performed pursuant to this Agreement shall be performed in accordance with the work schedule attached hereto as Exhibit C' consisting of one (1) page and incorporated herein by this reference ('Work Schedule ) 3 Contract Period This Agreement shall commence upon signing and shall continue in full force and effect until December 31 2009 unless sooner terminated as herein provided and subject to the appropriation provisions of Paragraph 7 of this Agreement ( Contract Period ) 4 Early Termination by DDA Notwithstanding the time periods contained herein the DDA may terminate this Agreement at any time without cause by providing written notice of termination to the Professional Such notice shall be delivered at least fifteen (15) days prior to the termination date contained in said notice unless otherwise agreed in writing by the parties In the event of any such early termination by the DDA the Professional shall be paid for services rendered prior to the date of termination subject only to the satisfactory performance mechanical, electrical, plumbing, acoustical, audio visual, food service, and civil design B Design Development Based on the approved schematic design documents and cost estimate, our team will develop Design Development (DD) level drawings Design Development fixes the character of the building, describing building components and systems in sufficient detail for a thorough cost estimate or G M P to be developed HOK Venue routinely produces DO documents that are regarded as very thorough, compared by many contractors with wide knowledge of the construction industry to other firms' construction documents V Cost Estimating As part of our service to the City, our team will develop appropriately detailed cost estimates for this project at each of three primary stages programming, schematic design, and design development These estimates will allow us to track the overall project cost as the design progresses, and make any necessary adjustments before proceeding to the next phase VI Public Involvement The design process itself should build excitement and support for the project Our team's contributions include the creation of great design graphics, design team assistance with media releases, the production of a summary document, animated fly through for the City, and materials that can be used on Beet Street/DDA web sites Our team can make available 60 voting tablets that can be used to solicit comments at public meetings These tablets can be used to produce real time graphics on PowerPoint as results are received Our team recognizes that this project will be a highly visible public project in downtown Fort Collins In fact, every project we design is a high visibility project, so we are accustomed to the level of public scrutiny that accompanies such projects And we are prepared to conduct the design process in a way that maximizes public support for the project A few of our techniques for building public support include • The charrette process Working on design alternatives in Fort Collins provides multiple opportunities for public input to the design process at the beginning of the charrette, while work is in progress, and during the wrap up Many charrette activities can be open to the public, and the charrette Itself can attract positive media coverage for the project • Public meetings Our team is prepared to conduct multiple public meetings on topics including site selection, building goals, design options, and recommended design direction The number of these meetings can be negotiated, however, we believe that a minimum of four such meetings will be necessary during this initial phase of work to build the appropriate level of public trust and consensus • Media availability In conjunction with major project activities, our team members will be available for media interviews and presentations, to make certain that the project objectives and goals are communicated consistently Such interviews are another means of building public support for and consensus around the preferred design concepts as they are developed VII LEED Certification Assistance Our team is prepared to assist the Owner in seeking LEED® certification at whatever level the Owner deems appropriate Our core design team is staffed with LEED Accredited Professionals, and we understand the LEED certification process It is critically important that efforts toward LEED certification begin with the inception of the project, including clear statements about project goals and expectations Documentation for many of the necessary LEED credits begins with (or before) schematic design, and our team's LEED coordinator will begin this documentation at project kickoff We will also register the project with the U S Green Building Council (USGBC) LEED certification is not obtained until project completion, however, early in the design process the team will conduct an assessment of possible or probable LEED credits and offer an opinion as to the level of certification that is reasonable to attain Beginning the process at the earliest point provides The 540- seat Illsley Ball Nordstrom Recital Hall is a more intimate stage setting. Also, the downtown residents formed a committee to ensure that they would not be disturbed by events held in this space. Hankard Environmental measured ambient noise throughout the area and downtown. They also worked closely with the Pepsi Center to develop sound levels that would be acceptable to the performance arc community. A demonstration of how it would sound to residents downtown was developed as well. The project was approved by the residents and an outside acoustical consultant. A letter of recommendation was provided by the Pepsi Center.
