NOTICE OF AWARD
Date: March 2, 2006
TO: Don Kehn Construction, Inc.
PROJECT: 5958 East Prospect Road Improvements
OWNER: CITY OF FORT COLLINS
(hereinafter referred to as "the OWNER")
You are hereby notified that your Bid dated February 22, 2006 for the above
project has been considered. You are the apparent successful Bidder and have
been awarded an Agreement for 5958 East Prospect Road Improvements-Poudre River
Bridge to Summit View Drive: 1. LPATH Structure which consists of
superstructure and pre -cast girders sitting, on top of abutments and piers.
Structure will be built to accommodate a 4-lane arterial roadway built per City
of Fort Collins standards. Total quantity of class D concrete is approximately
531 CY. Structure will include bridge rails and pedestrian rails. 2.
Installation of over 49,000 CY of embankment material. Over 31,000 CY consists
of unclassified excavation. Material is available and located in the vicinity
of the project. 3. Arterial roadway demolition and reconstruction. Pavement
thickness is 12 1-" total (6 1�" asphalt concrete, 6" Aggregate Base Course). 4.
Asphalt Mill (0"-3" depth) and overlay (2" depth) intersection of Summit View
Drive and Prospect Road. 5. Installation of a reinforced concrete pipe storm
sewer system ranging in pipe size from 18" to 36". 6. Updating of existing
private sanitation sewer utility (1894 LF). 7. Relocation of 2 privately
owned force mains. This work will include connections, air -vacs, blow -offs,
and testing of the new lines. 8. Coordination of required utility
relocations. 9. Wetlands mitigation landscaping and area of disturbance
seeding/restoration. 10. Installation of new 5" thick, 10' wide concrete
trail (approximately 4,600 SY). 11. Construction of a new parking lot. 12.
Traffic control for work listed above.
The Price of your Agreement is $3,757,538.35.
Three (3) copies of each of the proposed Contract Documents (except Drawings)
accompany this Notice of Award. Three (3) sets of the Drawings will be
delivered separately or otherwise made available to you immediately.
You must comply with the following conditions precedent within fifteen (15)
days of the date of this Notice of Award, that is by March 17, 2006.
1. You must deliver to the OWNER three (3) fully executed counterparts of
the Agreement including all the Contract Documents. Each of the Contract
Documents must bear your signature on the cover of the page.
2. You must deliver with the executed Agreement the Contract Security
(Bonds) as specified in the Instructions to Bidders, General Conditions
(Article 5.1) and Supplementary Conditions.

Failure to comply with these conditions within the time specified will entitle
OWNER to consider your Bid abandoned, to annul this Notice of Award and to
declare your Bid Security forfeited.
Within ten (10) days after you comply with those conditions, OWNER will return
to you one (1) fully -signed counterpart of the Agreement with the Contract
Documents attached.
