Dear Mel and John:
I am writing in regard to Bid #5848 dated July 1, 2004, signed by me on July 23, 2004
and by James B. O'Neill II on July 28, 2004, regarding the installation by Custom
Security of an electronic access system for PFA. The Service Agreement requires that
the project be completed by October 31, 2004. Because of a delay in the beginning of the
project, I am requesting a 30 day extension of the deadline to complete the project by
November 30, 2004. As per the Service Agreement under paragraph #3 "Delay", "If
either party is prevented in whole or part from performing its obligations by
unforeseeable causes beyond its reasonable control without its fault or negligence." As
you know, the original manufacturer of the product we planned to use on this project
failed to return my calls for over a month. When I was able to meet with them, the
company seemed to be on the verge of bankruptcy and could not guarantee timely
delivery of the product or on -going service. Subsequently, I investigated other options to
be sure that I could provide a comparable product with on -going service and support.
This included researching the products available, providing a demonstration of the new
product chosen for PFA and receiving their approval of this product. This process
delayed the start by an additional two weeks. A 30 day extension should allow me to
complete the project installation, programming and testing of the system with the badges
before changing the existing locks and completing the contract.
