Bryan Avenue Fort Collins, CO 80521 RE: Proposal for Architectural/Engineering Services Buckingham, Park Restroom Fort Collins, Colorado Dear Eileen: Alter-Ungle Architects P.C. is pleased to provide you with this Proposal for architectural services for the proposed Restroom Building at Buckingham Park in Fort Collins. We are happy to have been selected for this project. In response to our meeting on August 10, 2004, we propose the following scope of services and associated fees: Project Description The project is to include architectural construction documents and construction administration as outlined below. The work will be based upon the "Professional Services Agreement" dated in 2004 as contracted with the City of Fort Collins, Colorado. 1. Provide design, construction documents, and construction administration based upon approved floor plans from conceptual designs of restrooms previously completed for the City of Fort Collins. 2. As recorded changes to the drawings will be provided. Scope of Basic Services The Scope of Basic Services shall be as follows: 1. Conceptual Design Phase: Conceptual floor plans, elevations. 2. Design Development Phase: Floor plan and elevation revisions based upon City of Fort Collins' comments and cost estimate. 3. Construction Documents Phase: Modify the Warren Park construction drawings and specifications only for competitively bidding the project to Contractors. Coordination and Project Management: Coordinate the efforts of the Owner, Architect, and Engineers for a complete project. 5. Bidding/Negotiation Phase: Assistance to the Owner to acquire and review Contractor bids, attendance at Pre -Bid Conference, responding to Contractor questions and issuing addenda as necessary, and assistance in reviewing bids, negotiations and contract award. 6. Construction Administration Phase: Perform field inspections of the work in progress during construction with written reports to the Owner, attendance at Pre -Construction Conference, attend site meetings with the Contractor and Owner's representative, review of shop drawings and submittals as necessary, issuance of change orders as necessary, review of Contractor's pay requests, final "punch list" inspection and assistance with project close-out. For purpose of this Proposal, the number of field visits during the Construction Administration phase shall be limited to two (2) architectural and structural trips and one mechanical / plumbing trip. All construction documents prepared for this project shall be generated with our in-house Computer - Aided Design and Drafting (CAD) systems, using AutoCAD Version 2002 software. Work Not Included 1. Site Design: Owner to provide for all landscaping, utilities, paving, and grading to within 5'-0" of the building separately. 2. Representation of public meetings including neighborhood meetings, City Council, Planning Commission. 3. Perspectives, renderings, models or other presentation documents. See Additional Services. 4. Energy calculations as may be required by the City of Fort Collins in support of the building permit application. 5. Site visits or inspections beyond those identified in the Basic Scope of Services. owner -Provided Information 1. Owner -developed sketches or programming documents. 2. Copies of all applicable standard documents, forms, specifications or other information from the City to be a part of the bidding documents. 3. Copies of all standard specifications for materials, equipment, fixtures and systems to be incorporated into the project design used by the City, including material cut sheets and sources for sales and technical representatives, if available. 4. City application, development and building permit fees. 5. All site landscaping, utility, paving, and grading design and specifications to within 5'-0" of the building. 6. Site plan locating building. 7. Soils report for area where building is located. Fees Aller. Lingle Architects P.C. proposes to complete the project through the Construction Administration phase for a maximum not to exceed fee based upon the hourly rates established with the City of Fort Collins for a cost of approximately $14,900.00. Payment is due within 30 days of the statement date. Interest of 1.5% per month (18% per annum) will be charged on any outstanding balance. Fees shall be based upon hours used per month. Reimbursable Expenses In addition to Basic Services, reimbursables will be billed per the City of Fort Collins Contract. We expect this amount to be about $500.00. All printing of construction documents and specifications for bidding will be by the City of Fort Collins. 1. Blueprinting 2. Copying 3. Long distance telephone/1=AX 4. Mileage 5. Postage 6. Federal Express/Express Mail and other delivery services 7. Photography or other miscellaneous expenses 8. Plotting of CAD -generated drawings for City reviews and presentations Additional Services If the Owner requests additional services beyond those set forth in this Proposal, or for additional services as described elsewhere in this Proposal, such services shall be agreed to in writing between the Owner and the Architect and the fees adjusted accordingly per the current hourly rates as contracted with the City of Fort Collins. Principal: $75/hour Project Manager: $72/hour Electrical Engineer: $68/hour Senior Designer: $62/hour Designer: $55/hour CAD Tech: $46/hour Clerical: $30/hour Page 4 Contract Terms All terms of this Proposal shall be in accordance with our master contract with the City of Fort Collins. Schedule Scope of Basic Services for this project will be performed in accordance with the following schedule, assuming notice to proceed from the Owner by October 15, 2004: 1. conceptual Design Phase: 4 weeks, complete by November 14, 2004. 2. Design Development Phase: 8 weeks, complete by January 14, 2005. 3. Construction Documents Phase: 8 weeks, complete by March 14, 2005. 4. Bidding/Negotiation Phase: As required by the proposed bidding/construction schedule. 5. Construction Administration Phase: As required by the proposed bidding/construction schedule. Duration of Contract If the Basic Services covered by this Proposal have not been completed within six (6) months of the date hereof, or if the project is suspended for more than six (6) months, through no fault of the Architect, compensation for the Architect's services beyond the term of this Proposal shall be renegotiated as Additional Services. Delivery of CAD Files At the conclusion of the Project, the Architect shall deliver to the Owner copies of all final construction documents on computer disks upon payment in full of all monies due to the Architect. It is agreed that all such drawings and data are instruments of service of the Architect, who shall be named the author, and who shall retain all common law, statutory and other rights, Including copyrights. The Owner agrees not to use these drawings and data, or permit any reuse or modification to be made to them, without the prior written consent of the Architect, and then only after the Architect has been properly compensated for any such reuse. The Owner further agrees to waive all claims against the Architect resulting in any way from any unauthorized changes or reuse of the drawings and data for any other project by anyone other than the Architect. The transfer of the CAD files for use by the Owner shalt not be deemed a sale and the Architect makes no warranty, ■ 11/23/2004 16:09 6949 PARKS PAGE 07 Proposal for Architectural/Engineering Services either express or implied, of merchantability or fitness for any particular purpose. Page 5 The electronic files provided by the Architect to the Owner are submitted for an acceptance period of 30 days. Any defects the Owner discovers during this period will be reported to the Architect and shalt be corrected as part of the Basic Scope of Services. Correction of defects detected and reported after the acceptance period will be compensated for as Additional Services. Cost Estimates Since the Architect and Engineers have no control over the cost of labor, materials, equipment or services furnished by others, the quality or level of finishes selected, the Contractors methods of determining prices, or competitive bidding or market conditions, any estimate of project costs is made on the basis of the Architect's and Engineers' experience and qualifications and represent our best judgment as experienced and qualified professionals familiar with the construction industry. The Architect and Engineers cannot and do not guarantee that proposals, bids or actual construction costs will not vary from the estimate of probable cost. The selection of either the method of construction or a particular Contractor shall not affect this limitation. Hazardous Materials The Architect and Consultants shall have no responsibility for the discovery, presence, handling, removal or disposal of, or exposure of persons to hazardous materials in any form at the project site, including but not limited to, asbestos, asbestos products, polychlorinated biphenyl (PCB) or other toxic substances.
