RECOMMENDATION ITEM NUMBER: 7 A-B DATE: September 14, 2004 STAFF: Matt Baker Staff recommends adoption of the Resolution and of the Ordinance on Second Reading. EXECUTIVE SUMMARY A. Second Reading of Ordinance No. 138, 2004, Appropriating Prior Year Reserves in the General Fund for Transfer to the Capital Projects Fund - Timberline Road Improvements Project to be Used for the Engineering Design of Timberline Road from Prospect Road to Drake Road. This Ordinance, which was unanimously adopted on First Reading on September 7, 2004, appropriates funding for the final design for the full and complete 4-lane widening project of Timberline Road between Prospect and Drake in anticipation of potential project construction funding through the Building on Basics ballot measure. The design would be conducted concurrently with the Interim 4-lane project design now underway assisted by developer funding. B. Resolution 2004-111 Authorizing the Purchasing Agent to Execute a Change Order in Excess of $100,000 for the Four Lane Engineering Design of Timberline, Drake to Prospect Project. This Resolution authorizes the Purchasing Agent to execute a change order to the existing contract with Interwest Consulting Group to perform the design of the full and complete 4-lane project concurrently with the Interim Timberline 4-lane design work. ORDINANCE NO. 138, 2004 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING PRIOR YEAR RESERVES IN THE GENERAL FUND FOR TRANSFER TO THE CAPITAL PROJECTS FUND - TIMBERLINE ROAD IMPROVEMENTS PROJECT TO BE USED FOR THE ENGINEERING DESIGN OF TIMBERLINE ROAD FROM PROSPECT ROAD TO DRAKE ROAD WHEREAS, a section of Timberline Road from Prospect Road to Drake Road is well below the City's level of service requirements, with almost all legs and turn movements failing during the morning and afternoon peak rush hours; and WHEREAS, improvements for the aforementioned section of Timberline Road are not a part of any of the City's current capital improvement programs, and funding for these improvements has not yet been identified; and WHEREAS, the developers (the James Company and the Cumberland Group) of two parcels within a one -mile radius of the Timberline Road and Prospect Road Intersection proposed privately funding the interim improvements necessary to meet the minimum levels of services at the Timberline Road and Prospect Intersection; and WHEREAS, on November 4, 2003, City Council accepted a petition on behalf of the James Company and the Cumberland Group, with regard to the construction of certain interim improvements along the section of Timberline Road, to create a special improvement district ("SID") as a mechanism for repaying the cost of the interim improvements through assessments levied by the City against benefined properties in the SID; and WHEREAS, the City received a total of $100,000 from the James Company and the Cumberland Group, which City Council appropriated by adopting Ordinance No. 026, 2004 on March 2, 2004, and such appropriated funds were to be used to prepare plans, estimate of costs, and maps of the proposed SID in order to complete the engineering design of interim improvements along Timberline Road; and WHEREAS, at this same meeting, City Council is considering adoption of Ordinance No. 132, 2004 on second reading, which Ordinance would authorize the transfer of appropriations from the City's Street Oversizing Fund to the Capital Projects Fund - Timberline Road Improvements project, to be used to complete the street oversizing portion of the design, the geotechnical reports and environmental studies associated with the Timberline Road Improvements project; and WHEREAS, City staff is recommending that the contract for design oterim improvements associated with the Timberline Road Improvements project be amended to include the full and complete four -lane widening project of Timberline Road from Prospect Road to Drake Road, in anticipation of potential project funding through the Building on Basics ("BOB") ballot measure, scheduled for April 2005; and WHEREAS, the additional cost of the full and complete 4-lane design of Timberline Road from Prospect Road to Drake Road is $200,000; and WHEREAS, staff recommends using General Fund prior year reserves to fund the aforementioned additional design cost; and WHEREAS, Article V, Section 9, of the Charter of the City of Fort Collins ("Charter") permits the City Council to appropriate by ordinance at any time during the fiscal year such funds for expenditure as may be available from reserves accumulated in prior years, notwithstanding that such reserves were not previously appropriated; and WHEREAS, it is the desire of the Council to appropriate the sum of $200,000 from prior year reserves in the General Fund for transfer to the Capital Project Fund - Timberline Road Improvements Project to be used with existing appropriations for the full and complete 4-lane design of Timberline Road from Prospect Road to Drake Road. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that there is hereby appropriated from prior year reserves in the General Fund, the sum of TWO HUNDRED THOUSAND DOLLARS ($200,000), for transfer to the Capital Projects Fund - Timberline Road Improvements Project, and appropriated therein, to be used for the full and complete four -lane design of Timberline Road from Prospect Road to Drake Road. ATTEST: City Clerk Mayor RESOLUTION 2004-111 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING AN EXEMPTION TO THE USE OF A COMPETITIVE PROCESS FOR ADDITIONAL PROFESSIONAL SERVICES IN CONNECTION WITH THE TIMBERLINE, DRAKE TO PROSPECT PROJECT WHEREAS, the City previously conducted a competitive request -for -proposals process, through which Interwest Consulting Group (Interwest) was selected to complete various professional services related to the engineering design of the Timberline Road, Drake to Prospect Project (the "Project"); and WHEREAS, the City entered into a professional services agreement with Interwest for the completion of the engineering/design for the interim improvements of the Project on July 7, 2004, and work is proceeding satisfactorily pursuant to that agreement; and WHEREAS, the original scope of work to be completed by Interwest did not include the completion of the full and complete four lane engineering design (the "Additional Work"); and WHEREAS, the City has determined since contracting with Interwest that concurrent engineering design of the interim and four lane projects would save the City both time and money in advance of the Building on Basics proposed sales tax renewal; and WHEREAS, the Purchasing Agent has determined that the use of Interwest to complete the Additional Work through a change order to the existing contract for services would be an efficient and cost-effective means of accomplishing the same and has submitted the requisite justification to the City Manager for approval; and WHEREAS, the Interim City Manager has reviewed and approved the determination of the Purchasing Agent; and WHEREAS, the cost associated with the Additional Work totals $200,000, which is proposed to be appropriated in Ordinance No. 138, 2004; and WHEREAS, Article IV, Section 8-161(d)(1)j of the Code of the City of Fort Collins authorizes the Purchasing Agent to contract for services without competition if the services are to be provided through a change order to an existing professional services contract; and WHEREAS, Section 8-161(d)(3) requires approval by City Council of exceptions to the competitive purchasing process for items costing more than One Hundred Thousand Dollars ($100,000) prior to acquisition. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the Purchasing Agent is authorized to execute an addendum to the City's existing contract with Interwest to add the Additional Work to the scope of services to be completed thereunder, at an additional contract price of $200,000, contingent upon the final adoption of Ordinance No. 138, 2004, appropriating certain funds therefor. It is requested that Council authorization be granted to amend the existing contract with Interwest Consulting Group to perform the design of the full and complete 4-lane project concurrently with the Interim Timberline 4-lane design work. September 7, 2004 -2- Item No. 15 BACKGROUND The engineering process for the Interim Timberline Road (Prospect to Drake) widening is proceeding at this time. Interwest Consulting Group has been retained as the lead design engineering firm. The design timeline allows roadway construction to begin in the fall of 2005 and to be completed in 2006. The interim design is of necessity a compromise. Additional funding of $3.1 million for the full and complete 4-lane improvement, including constructing the Prospect intersection to full standards, is included as a candidate for funding in the proposed sales tax renewal (Building on Basics - BOB). If the measure is successful in April 2005 and includes this project ve ed for the full and complete improvements before constru on of nteri p 'e gi If the BOB measure passes, t a cond a construction of the full and complete 4-lane improvements, rather than allow the interim widening to be built, then following it with another construction project on the same stretch of road. Besides the savings from efficiencies, it's a far better public relations approach. The proposal is to conduct the design of the full and complete 4-lane widening of Timberline concurrent with the interim design work. To wait to initiate the ultimate design until after the election would delay the entire project nine to twelve months. If the design is already complete when the BOB vote occurs, the original schedule can be retained. Conservatively estimating construction cost escalation rates, not delaying the full project design ul sav about $350,000 over a year. TOTAL Contract amount = $344,285.5 SCOPE OF SERVICES TIMBERLINE ROAD — 4-LANE WITH MEDIAN o%-t00% DESIGN DRAWINGS October 20, 2004 The following Scope of Services includes the preparation and submittal of 50% design drawings for the ultimate 6-lane arterial roadway and the 4-lane arterial with raised median of Timberline Road from Drake Road to Prospect Road. The also includes 100% design drawings for the 4-1ane section centered on the ultimate median. The 4-lane arterial design will include curb and gutter on both sides of the roadway, an enlarged 22-foot wide parkway, and sidewalk and right-of-way in their ultimate location. A dedicated right turn lane will be required at the signalized intersection of Nancy Gray Drive for both north and south bound traffic. The Prospect/Timberline intersection and the Spring Creek Bridge will be designed to their ultimate configuration which will minimize the modifications required to expand the roadway to the future 6-lane arterial alignment. The following scope and fees are based upon the concurrent design of the 4-lane interim arterial roadway. Several of the design components and reports listed below will be similar to that concurrent design thus providing efficiency in design and fee. Representation at public meetings relative to the project is included in this portion of the scope. Project Requirements Drainage Studv The drainage studies will be similar to the ones being prepared for the 4-lane interim conditions plan; however, these designs will incorporate additional curb and gutter and storm drainage facilities, particularly along the west side of the roadway north of Mansion Park. The Spring Creek Bridge will be designed to its ultimate width which will involve a slightly different drainage design at the entrance to the bridge. A storm sewer system will be required to convey flows generated from the roadway and median islands. This system will be located relative to the ultimate design while remaining practical for interim conditions. Local runoff that drains toward the roadway will be conveyed in a storm system to a discharge point along Spring Creek or coordinated with adjacent property systems toward its historic discharge location. Grading and new channel work will be required on the existing west side of the bridge that may impact conveyance patterns and the hydraulic efficiency of the bridge system. A previous floodplain analysis indicated that while the bridge itself has adequate conveyance capacity, there was an overtopping of Timberline Road north of the railroad track crossing. As the bridge and channel are expanded to the west, these overtopping flows will need to be analyzed for any adverse impacts. At this time, the city anticipates that the Utility Department's Special Projects team will provide all flood plain analyses as part their regional detention facility project. A preliminary drainage study will be prepared for the 50% interim and ultimate designs. A final drainage study will be prepared for the 4-lane interim with median design. The drainage studies will be prepared in accordance with the City Stormwater Utility Department's design requirements. The Studies will include an analysis of historic and developed flows and required hydrologic and hydraulic calculations for the inlets and pipe networks. Deliverable: • Drainage Studies (50%, 90% and 100% Design submittals) Traffic Assessment This task includes assistance from the Interwest traffic consultant to evaluate the geometric design of the intersections along the corridor based upon the previously submitted traffic assessment and specific turning movements generated at key intersections. Additional Level of Service calculations are not anticipated as part of this scope. Deliverable: • None 50% Submittal Design We will provide 50% design plans for both the ultimate 6-Lane arterial roadway and the 4-lane arterial section with raised median configuration. These plans will incorporate 50% level design details for the roadway, intersection, drainage structures, railroad crossing, landscaping, removals and utility modifications. Right-of-way and easement requirements associated with construction are anticipated to be the same for each of these alternatives and will be identified on the plans and a right-of-way strip map. Landscaping concepts will be provided as follows: a. Preliminary landscape plans including size and location of plant materials and representative plant list. b. Conceptual irrigation plan including sleeve locations, mainline routing, and controller locations c. Memorandum of irrigation design including proposed water use requirements, tap/meter size, and equipment memo Deliverables: • 50% complete design plans for the 6-lane ultimate and 4-lane interim with median design options • Forty (40) full size sets of prints for each design • Strip map showing alignment, ROW, intersections, structures and historic resources for each design • Right-of-way and easement acquisition strip map, including field staking along the west side of Timberline, as needed • Rough field staking of curb and gutter along the west side, utility crossings and other critical alignments for team field meeting and evaluation 90% Submittal Design At the 90% design phase, we will complete the plans and specifications for the 4-lane curb and gutter roadway with median as identified above. These plans will be suitable for the contractor to accurately bid and construct the project. We will perform a bridge analyses to reflect the geometry of the ultimate roadway section and prepare an Alignment and Bridge Construction Phasing Plan. Bridge Construction Phasing is another critical component including a phasing concept that keeps adequate lanes of traffic open in each direction with turn lanes, as necessary, during construction. Detailed design drawings and specifications will be included for the ultimate design of the Spring Creek Bridge extension. The plans will include a concrete intersection design and joint layout for the Prospect and Timberline intersection based upon the ultimate six (6) lane arterial roadway section. The striping plan for the intersection will be based upon AUTOTURN templates for all movements through the intersection. Complete signing and striping plans for the entire project limits will also be provided. Details within the drawings will include cross sections every 50 feet and at critical locations, flow line profiles and will show utilities from the potholing data provided by the city. Utility relocation and stub out for future services will be shown in plan and profile for the contractor. Traffic signal plans will be provided for the ultimate intersection configurations at Prospect and Timberline (modified from previous interim design), and Nancy Gray and Timberline. Landscaping and irrigation will include: a. Final landscape plans including size and location of plant materials, mulches, seed types and plant list including plant sizes and species b. Planting construction details c. Fencing details d. Aesthetic landscape grading information to be included in the grading plans. e. Final irrigation plans and details A final exhibit for the railroad crossing will be prepared for inclusion in the city's permit application with the Public Utilities Commission (PUC). Deliverables: • 90 percent complete design plans and specifications for the 4-lane interim improvements with ultimate median • Bridge and retaining wall structural designs and details • Landscape and Irrigation Plans • Forty (40) full size sets of prints for review • Railroad crossing exhibit • Signal design plans • Engineer's cost estimate or Quantity Analysis • Right-of-way and easement legal descriptions and exhibits Final (100%) Design The final design phase will incorporate necessary revisions and additions to the 90% submittal plans and include the final mylar set for city signature. Deliverables: • One (1) mylar and five (5) print sets of signed and sealed final drawings • Electronic copy of Final Design plan sheets and base map • Final Strip map Exhibits If the City should determine that additional exhibits are required for public outreach or various presentations, we will provide such exhibit based upon the hourly rates provided.
