Scope of Work
Ackerman Ranch Lands Mineral Assessment
I propose to conduct a standard minerals assessment and prepare an appropriate analysis (which will
comply with Internal Revenue Service Code §170(h)(5)(B)(ii) if necessary), the major components of which
are:
Review of title insurance, abstract, and similar documentation as may be provided.
Examination of General Land Office patents and Bureau of Land Management records to ascertain original
patent statutes as well as mineral reservations, if any, whether or not contained in provided
documentation, as well as BLM mineral lease and mining claim records.
Examination of original deeds severing recorded fee mineral interests, and analysis of language of such
reservations, to the extent these documents are available.
Examination and analysis of any existing mineral deeds; leases, exploration, production, operating, or
pooling agreements; or any other agreements conveying any exploration or development rights in any
mineral resource that might be present.
Analysis of the geologic setting and mineral resource potential of the property.
Examination of on-line records of the Division of Minerals and Geology and Colorado Oil and Gas
Conservation Commission for applicable past and present mining or drilling activities.
Determination of the likelihood of surface mining. or quarrying, including surface activities related to
underground mining defined as surface mining by applicable local, state, and federal statute and
regulations; and the likelihood of underground mining by any method.
Determination of the likelihood of petroleum exploration and development activities, including but not limited
to conventional oil and gas; coalbed methane; basin -centered gas; carbon dioxide; and helium.
Summary conclusion of mineral resources present in commercial quantities, if any, and the likelihood of the
extraction thereof by any method.
Summary report of findings and conclusions. Preliminary reports are generally 6 to 12 pages in length and
are sufficient for due diligence and acquisition decisions, as well as recording.
Final report including maps, photos, and other illustrations as appropriate; documentation of findings,
background information, and conclusions; footnote explanations of technical terms; and references
used in assessment preparation.
This Scope of Work specifically does not include mineral or other title searches subsequent to examination
of original patent records. To the extent such work is not included in provided documentation and may
become necessary, it will necessitate a separate proposal, including independent cost estimate.
