Statement of Bidder's Qualifications
Question #20
Thissen has never been involved in litigation with the owner of any
construction project where the owner alleged any issues with Thissen's
performance. Thissen has been involved with disputes with its subcontractors
where (a) Thissen sought to recover a back charge from its subcontractor and the
subcontractor alleged, as a defense to Thissen's claims, that the problems arose
from Thissen's, and not the subcontractor's, omissions, as alleged by Thissen (in
the matter of Thissen vs. Keast Architects) and (b) in an action brought by a
subcontractor who was fully paid on a project but alleged, months after the project
was done, that the subcontractor was entitled to delay damages for unspecified
delays caused by Thissen (which delay claims had previously been made on the
owner and denied) (in the matter of Interstates Electric v. Thissen - the owner's
rep advised Thissen that this same sub made delay claims against the owner on 3
out of 4 other projects, on which Thissen was not involved, undertaken between
this owner - Anhueser Busch - and this subcontractor, all of which were denied by
the owner).
