Sincerely, CHf2`M HILL MLf{lbison Y President Enclosure CONFIDENTIAL Update of the Fort Collins Water Utility Emergency Response Plan INTRODUCTION According to House of Representatives Bill H.R. 3448, Public Health Security and Bioterrorism Response Act of 2001 (the Act), community water systems greater than 3,300 persons are required to conduct vulnerability assessments (VAs), under the authority of the United States Environmental Protection Agency (USEPA). Community water systems are also required to certify their Emergency Response Plans (ERPs) by the USEPA, within 6 months of completion of their VA but no later than: • September 30, 2003 for systems serving populations greater than 100,000 persons • June 30, 2004 for systems serving populations between 50,000 and 99,999 persons • December 31, 2004 for systems serving populations between 3,301 and 49,999 persons Fort Collins Water Utility completed the water Vulnerability Assessment and submitted it to EPA on January 31, 2003. The six-month rule is in effect, therefore the ERP certification is due to the EPA no later than July 31, 2003. The ERP must be certified to be in compliance with Section 1433(b) of the Safe Drinking Water Act as amended by the Public Health Security and Bioterrorism Preparedness and Response Act of 2002 (Public Law 107-188, Title IV — Drinking Water Security and Safety). The ERPs should incorporate the results of the VA completed for the community water system. This includes "plans, procedures, and identification of equipment that can be implemented or utilized in the event of a terrorist or other intentional attack" on this community water system. The ERP should also include "actions, procedures, and identification of equipment which can obviate or significantly lessen the impact of terrorist attacks or other intentional actions on the public health and the safety and supply of drinking water provided to communities and individuals." To the extent possible, the ERP should be coordinated with state and local emergency response organizations, regulatory authorities, and local government officials. To expedite the process and minimize the project costs, an electronic copy of the existing Fort Collins Water Utility ERP will be provided to C112M HILL at this meeting. Following the meeting, CH2M HILL will develop the 1-t draft of the revised ERP meeting the EPA guidance. This draft will incorporate the approved recommendations generated jointly with FCU during the GAP analysis of the current ERP, and subsequently at the Utilities meeting held on May 23, 2003. Fort Collins Water Utility will have a minimum of five working days to review the draft document. Task 2: Development of 2nd Draft ERP After receiving the comments from FCU on the initial draft ERP, CH2M HILL will revise the draft as the 2nd version of the ERP. Fort Collins Water Utility will have a minimum of five working days to review the draft document. Task 3: Development of the Final ERP and Certificate for the EPA After receiving the comments from FCU on the second draft ERP, CH2M HILL will revise the draft as the final version of the ERP. A presentation (if necessary) to the Fort Collins Uilities directors on the ERP will be provided. A Certification letter will be prepaired for Fort Collins.
