Please find attached a copy of the Pre -Qualification statement submitted by J & A Safety & Sign, Inc, dba Traffic Masters dated January 29, 2003. Because of the specialized nature of the Downtown Enhancement Project the City of Fort Collins required pre -qualification prior to bidding. All of the prequalified approved traffic control contractors met all of the minimum requirements for the above referenced bid. The process used to pre -qualify general contractors and sub -contractors for the above bid included two major requirements: (1) The first requirement for contractor prequalification is that the current company be incorporated for a minimum of five (5) years. According to the Pre - Qualification Statement that your client's completed and submitted to our office, the date of incorporation is 6-4-02. (2) The second requirement for prequalification is the type of work completed in the last 5 years; specifically to be Project experience. Project experience, for this bid is defined as multiple projects maintaining traffic control under one contract for a General Contractor for a period of more that ten (10) days. Your client did not list any Project experience in the City of Fort Collins or downtown area. Also, in your letter, Jessica Bensing is referred to as having substantially more that five years of association with Traffic Masters. The pre -qualification Statement reflects six (6) years. It is my understanding that they were excluded from the right to bid on the above referenced project and the amount was within the approved contractor - subcontractor list. They were given a reason that they had not been in business for more than five years. This simply is not true. Jessica Bening is one of the owners of J & A Safety & Sign, Inc. She has been associated with Traffic Masters for substantially more than five years and has a background and expertise necessary to qualify them to bid on this job. My clients have worked in the downtown area on multiple occasions. My clients are the main supplier for traffic control to the downtown business association for special events. My client has actually been in business for 13 years, although there has been a partial change of ownership, but the employees remain the same. Traffic Masters is closer to the downtown area than any of the other business that were allowed to bid on this, making response time faster. At least one of the qualified traffic control contractors has not been in business for a five year minimum and is not in good standing with the Secretary of State. We believe that the decision to not allow our clients to bid on this job is both discriminatory and contrary to both State and Federal legislation. Therefore, this shall serve as our objection and notice to the City as to our objection to my clients not being allowed to participate in the bid process.
