This Addendum is made and entered into this 20th day of November, 2000, by and
between Tumbleweed Super Tasty Treats (the "Concessionaire") and the City of Fort Collins
(the "City").
Whereas, the Concessionaire and the City entered into that certain Downtown Vending
Concession Agreement dated June 1, 2000 (the "Agreement"), pursuant to which the City
agreed to grant to the Concessionaire, in consideration of the mutual covenants and obligations
therein express, a concession for outdoor vending, as defined in the Agreement.
Whereas, the parties have agreed that it is their mutual benefit to modify the terms of the
Agreement as described herein, so as to clarify their respective rights and responsibilities under
the Agreement.
Now, therefore, in consideration of the mutual covenants and obligations expressed
herein, and other good and valuable consideration, the receipt and adequacy of which is hereby
acknowledged, the parties agree that:
1. All paragraphs in the Agreement relating to site assignment are amended to remove
Site #10 and daytime operations at Site #4.
2. Effective as of the date hereof, Section 3.0, paragraph N, is hereby amended as
follows:
N. The Concessionaire must keep the concession area open for business as
directed by the City. Until otherwise agreed by the parties, the minimum hours the
concession area shall be open are as follows:
Two (2) to four (4) hours between 6pm and 6am at Site #4 Monday through Friday.
Site to be operated throughout the year; except for inclement weather and national
holidays or holidays recognized by the City where City offices (except for emergency
personnel) are closed.
3. All terms and conditions of the Agreement, as modified by this Addendum, shall
remain in full force and effect.
In witness whereof, the parties have executed this Addendum to Downtown Vending
Concession Agreement the day and year first above:
