Colorado Division Subcontract Policy The MasTec of North America, Inc. (MasTec) Colorado Division currently employs between 100 and 400 full time personnel, and two hundred and seventy (270) pieces of equipment. We can mobilize to perform virtually any size project for our customers. Whether the job includes plowing, trenching, boring, manhole and handhole placement, copper or fiber optic cable placement, aerial construction, etc., MasTec has the resources to complete the job in a timely and cost-effective manner. The MasTec Colorado Division also has strategic relationships with approximately sixty (60) miscellaneous subcontractors who when utilized, can also assist to provide the full gamut of construction activities throughout Colorado, Wyoming, and New Mexico. MasTec evaluates each job we are awarded to most effectively complete the project in the timeframe requested by the customer. Many times we can mobilize a subcontractor in an area quicker and more cost-effective than mobilizing MasTec resources. By being so flexible, we are able to pass this advantage to our customers. We also own a substantial amount in ��oment, which at December 31, 2000 had a gross book value of $269.0 million. This equipment includes vans, It tractors, trailers, bucket trucks, backhoes, bulldozers, directional boring machines, digger derricks, cranes and tesnu, .:went and software. We obtain our equipment from various third -party vendors, none of which we depend upon, and have not c,perienced any difficulties in obtaining desired equipment. LEGAL PROCEEDINGS We have filed lawsuits in Florida state court against a subsidiary of Artcom Technologies, Inc., a holding company for a Spanish infrastructure provider that we formerly owned, to recover more than $5.0 million due under a promissory note and for breach of contract. We are also pursuing other claims against Artcom affiliates totalling approximately $4.0 million. Artcom has responded by suing us in federal court in Florida to recover approximately $6.0 million (subject to trebling) it alleges we received as a result of certain allegedly unauthorized transactions by two former employees of Arteom that occurred after we sold the company. In January 2001, we filed suit in Florida state court against Broward County, Florida, to recover approximately $5.0 million for work performed to construct a detention facility for the Broward Sheriffs Office ("BSO"). The BSO has filed a separate lawsuit in response to our lawsuit claiming $13.0 million in damages for alleged delays in constructing the facility. In November 1997, we filed a suit against Miami -Dade County in Florida state court alleging breach of contract and seeking damages exceeding $3.0 million in connection with the county's refusal to pay amounts due to us under a multi -year agreement to perform road restoration work for the Miami -Dade Water and Sewer Department ("MWSD"), a department of the county. The county has counterclaimed against us seeking unspecified damages. We are a party to other pending legal proceedings arising in the normal course of business, none of which we believe is material to our financial position or results of operations. None.
