or employees has been convicted of bid -related crimes or violations at
any time including within the past five years in any jurisdiction.
Neither Alliance Construction Solutions, LLC nor any of its
principals, personnel, divisions or affiliates presently, or in the past,
are or have been, debarred or suspended from entering into contracts
with any federal, state or local governmental entity.
Alliance Construction Solutions, LLC is not presently nor has it
during the past five years been a party to any court or administrative
proceedings where: (1) the violation of any local, state or federal
statute, ordinance, rule or regulation by Alliance Construction
Solutions, LLC was alleged or (2) a bid of Alliance Construction

Alliance Construction Solutions, LLC, is one of the larger General
Contractors in the Colorado region. As the prime contractor, Alliance
Construction Solutions, LLC, becomes responsible for all project
work and the handling of any claims that may arise. Although claims
are not unusual in the industry for larger prime contractors, in our
opinion, how claims are managed becomes the issue for the project.

LEGAL HISTORY
In 1997, an affiliated company, Alliance Construction Solutions, Inc.
was under contract with the Colorado Department of Corrections for
the correctional facility in Trinidad, Colorado. There was a
construction claim relating to alleged defects in concrete tolerances
and aesthetics. The bonding company and Alliance Construction
Solutions, hic. addressed the claim and the bonding company
recommendation was to have construction continue through Alliance
Construction Solutions, Inc. The recommendation was not accepted
by the Department of Corrections and, in the owner's interest, the
bonding company became involved in the completion of the work.
Settlement of the claim and wrongful termination of contract is
pending.
Unfortunately, claims exist for most successful contractors. Safeco
Surety has reviewed the history of the affiliated Alliance Construction
Solution Companies and has chosen to provide bonding for Alliance
Construction Solutions, LLC. Safeco Surety is one of the larger
bonding companies in the industry and provides bonding for
numerous construction companies in the Colorado region. The claim
in question is being managed professionally and in no way affects
the bonding and/or performance capabilities of Alliance
Construction Solutions, LLC.

Surety, are hereby held and firmly bound unto the City of Fort Collins, Colorado,
as OWNER, in the sum of �21 of total bid for the payment. of which, well and
truly to be made, we hereby jointly and severally bind ourselves, successors, and
assigns.
THE CONDITION of this obligation is such that whereas the Principal has
submitted to the City of Fort Collins, Colorado the accompanying Bid and hereby
made a part hereof to enter into a Construction Agreement for the construction of
Fort Collins Project, CITY PARK POOL RENOVATION; Bid No. 5731.

(a) If said Bid shall be rejected, or
(b) If said Bid shall be accepted and the Principal shall execute and deliver a
Contract in the form of Contract attached hereto (properly completed in
accordance with said Bid) and shall furnish a BOND for his faithful
performance of said Contract, and for payment of all persons performing
labor or furnishing materials in connection therewith, and shall in all
other respects perform the Agreement created by the acceptarice of said Bid,
then this obligation shall be void; otherwise the same shall remain in
force and effect, it being expressly understood and agreed that the
liability of the Surety for any and all claims hereunder shall, in no
event, exceed the penal amount of this obligation as herein stated.
The Surety, for value received, hereby stipulates and agrees that the obligations
of said Surety and its BOND shall be in no way impaired or affected by any
extension of the time within which the OWNER may accept such aid; and said Surety
does hereby waive notice of any such extension.
Surety Companies executing bonds must be authorized to transact business in the
State of Colorado and be accepted by the OWNER.
