AGREEMENT FOR THE INSTALLATIL OF
FULL, DEPTII CONCRETE CROSSING SURFACE MATERIAL ON
THE BURLINGTON NORTHERN AND SANTA FE RAILWAY COMPANY
ON Trilby Road, DOT 9244 618111 In Fort Collins, Colorado, MP67.68, LS 476
Thus is a letter agreement wherein The Burlington Northern And Santa Fc Railway Company, hereinafter called Company, agrees
that the existing crossing surface at Trithv Road, LCR 34% Fort Collins, Colorado is to be removed and new full depth concrete crossu
surface lobe installed to a crossing surface width of 40 frock feet' for a total crossing surface length of 40' To accomplish this work, t
City of Fort Collins, Colorado hereinaller called Agency, and the Company, agiee as follows
♦ 1) The work will be perlormed at the cxperise of the Company Said work will consist of the installation of concrete
crossing surface material including upgrades to the track to accommodate new concrete crossing surface material, to
adequately include all vchicu6ar driving lanes, based on a width of-}RB' 36feet from the edge of pavement to edge of
pavement
♦ 2) The Agency will pay the Company the total cost of installation new crossing surface length for work described above for
a total cost of S45,040 001
♦ 3) The Company will order the concrete crossing surface rnatenal from a qualified suppler rind after receipt of the
ntatenal, the Agency will be billed on basis of Paragraph 2 above
♦ 4) Tlic Company, at its own cost and c%pense, wilt matntnm the crossing surface in a satisfactory mariner and will make
ample provisions for such maintenance, provided, however, that the Company shall be entitled to receive any contribution toward
the cost of such m,untendnce as niav be now or hereafter made available by reason of any law, ordinance, regulation, order, grant,
or b1 other means or sources,
♦ 5) The Agency, at its own cost and expense, will provide all barricades, lights, flagmen or traffic control devices necessary for
detouring vehicular traffic at the crossing, during construction of the crossing involved
♦ 6) The Agency further agrees to allow the Company to dram the crossing area mto existing Agency storm sewers, if
available,
near the crussrng The drain pipes mid filter fabric will be furnished and installed by the Company
7) 'rho Agency, further agrees to flinnsh and place, at their expense, asphalt beRticen the saw cut to the existing roadway
surface and the new cmicrete crossing surface, phis the area between the tracks if there is more than one track
♦ 8) The Agency shall execute or require its agents or contractors to execute the Company's "RIGHT OF ENTRY AND
RELEASE OF CLAIM AND INDEMNITY (Form BNSF 1624V Rev 1/97)" which must beapprovedby the Company prior to
the Agency, or its agents or contractors performing any construction work on the Company's properly.
♦ 9) Both parties agree to the requirements of Title VI of the Civil Rights Act of 1964, which by reference is
ni a part of ibis agreement
