EXHIBIT C YEAR 2000 COMPLIANCE CERTIFICATION AND INDEMNITY Section 1 Contractor hereby certifies that all information resources or systems to be provided or used in connection with the performance of this Agreement are "Year 2000 Compliant', except as otherwise expressly described in Section 2, below "Year 2000 Compliant" shall mean that information resources meet the following criteria a Data structures (e g , databases, data files) provide 4-digit date century recognition For example, "1996" provides date century recognition, "96" does not b Stored data contains date century recognition, including (but not limited to) data stored in databases and hardware/device internal system dates c Calculations and programs logic accommodate both same century and multi - century formulas and date values Calculations and logic include (but are not limited to) sort algorithms, calendar generation, event recognition, and all processing actions that use or produce date values d Interfaces (to and Supplier Thank you for the opportunity to bid on Transfort's fuel requirements As Transfort's current fuel supplier, I would like to take a few minutes to express our appreciation for the business and highlight a few accomplishments Throughout the past four years, SERVICECO has maintained the same profit and freight cost This consistency has allowed Transfort to control its fuel cost while preventing them from escalating unnecessarily Also, SERVICECO has had the opportunity to respond quickly to a few rare emergency requests In 1998, Transfort requested the removal of fuel from its tanks SERVICECO helped to coordinate and organize the necessary manpower quickly to remove the fuel from the tank Enclosed please find a completed bid As you know, the bid contains a few additional administrative requirements These include the supply of branded product, the submittal of invoices by both fax and mad, and notification of any fuel procured at higher prices than the lowest posted price SERVICECO is willing and able to comply fully with these additional requirements Also, per your request, listed below please find a description of our pricing information and fuel delivery service Pncmg information SERVICECO is a subscriber to the Oil Price Information Service (OP1S) As a subscriber, SERVICECO receives published daily rack prices of each fuel supplier A sample price report is enclosed for your review SERVICECO uses this information to determine which fuel supplier to purchase product from SERVICECO routinely pulls product from the supplier with the lowest fuel price However, it should be noted, that at times this is not always possible as some suppliers with the lowest fuel price may not have product available In this case, SERVICECO will pull product from the supplier with the next lowest price Also, it should be noted that OPIS does not publish premium red dyed -diesel fuel prices To obtain an approximate published premium diesel price, they recommend we would like to receive at least twenty four (24) hour advanced notice of a fuel delivery Once the fuel is ordered, SERVICECO dispatches a truck to the delivery site Currently there are seven (7) drivers that are trained to operate the attached trucks Each driver is properly trained to deliver fuel without incident Upon arrival at the site, the driver measures the fuel level in the tank before unloading any fuel into the tank This precaution allows the driver to quickly gauge whether the fuel will fit comfortably in the tank If adequate space exists, the driver then pumps fuel from the tanker truck into the tank After loading, the dnver makes a final note of the fuel level Historically, SERVICECO has been able to send the same two (2) drivers to Transfort However, during emergency conditions and/or unexpected customer requirements, it may be necessary to add other experienced drivers to this route These conditions include refinery shut downs and/or product shortages, customer outages etc The additional flexibility to add drivers when needed provides Transfort the best service possible during emergency or unexpected conditions It should be noted that Transfort's requirement for branded fuel may in fact increase the need for this additional flexibility as the availability of the product is limited to only branded fuel SERVICECO's staff has enjoyed working with Transfort
