We are pleased to submit the following scope of work to prepare an Ecological Characterization Study for the proposed watercraft course adjacent to the old power plant in Fort Collins, Colorado. SCOPE OF SERVICES The Ecological Characterization Study will be prepared pursuant to the City of Fort Collins, Division 3.4 Environmental, Natural Area, Recreational and Cultural Resource Protection Standards, Section 3.4.1 Natural Habitats and Features, subsection (D) Ecological Characterization and Natural Habitat or Feature Boundary Definition, (1) Ecological Characterization Study as outlined below: (a) the wildlife use of the area showing the species of wildlife using the area, the times or seasons that the area is used by those species and the "value" (meaning feeding, watering, cover, nesting, roosting, perching) that the area provides for such wildlife species; (b) the boundary of wetlands in the area and a description of the ecological functions and characteristics provided by those wetlands; (c) any prominent views from or across the site; (d) the pattern, species and location of any significant native trees and other native site vegetation; (e) the bank, shoreline and high watermark of any perennial stream or body of water on the site; (f) areas inhabited by or frequently utilized by Sensitive and Specially Valued Species; (g) special habitat features; (h) wildlife movement corridors; (i) the general ecological functions provided by the site and its features; 0) any issues regarding the timing of development -related activities stemming from the ecological character of the area; and (k) any measures needed to mitigate the projected adverse impacts of the development project on natural habitats and features. Assumptions: Walsh will incorporate the following assumptions into the preparation of the scope of services outlined above: (a) Existing wildlife data from the City (e.g., Natural Resources Department inventories) will be reviewed and incorporated into the report along with NatureServe, NDIS, USFWS and other ecological sources. Walsh will verify this data during the field reconnaissance (i.e., the same site visit as the jurisdictional delineation in item (b) below). (b) Walsh will delineate the jurisdictional waters/wetland boundaries in accordance with the methodology enumerated in the 1987 Corps of Engineers Wetlands Delineation Manual. INTRODUCTION The City of Fort Collins respectfully requests Proposals (including fees) for Professional Services for the design of a Water Craft Course (Kayak Course) along a designated section of the Poudre River. The selected Consultant(s) firm / team must have completed, through construction, a minimum of three (3) other similar projects and provide information about each project individually. A brief history and current status of this project is as follows. The vision of developing a water craft/kayak course in the Downtown area of Fort Collins at the old Power Plant was identified in the City Council adopted Downtown River Corridor Implementation Plan (DRCIP). The DRCIP was adopted on July 18, 2000. The course would be located in the area downstream of the the old Power Plant Dam and Coy Diversion structure to a take out area at the BNSF Railroad trestle. A conceptual plan for the water craft course was developed during the DRCIP process. The old Power Plant Dam and Coy Diversion structure is a major structure located just downstream of the North College Avenue bridge. This structure was modified in the mid 1980's to allow for water craft passage. However, it only accommodated passage at the very peak of river flows and was impassable at other times. A downstream boat chute drop structure was installed in 1999 to create a water pool below the Diversion. This pool created a needed higher water surface elevation below the diversion structure making the passage of water craft possible. The proposed water craft course will require the installation of boulder structures downstream to complete the course. The new area of the course will be approximately 300 feet long. The total length of the course from the North College Avenue Bridge to the railroad trestle is about 800 feet. A sandbar area under the railroad trestle offers a potential egress access or take-out point. A path will be required from the designated take-out point to a point along the side of the City's paved Poudre River Trail for users to return to the starting point of the course. II. SCOPE OF WORK The chosen Consultant(s) firm / team shall work closely with the City, the kayak community, the consultant responsible for the floodplain analysis process, and the environmental consultant to provide the design drawings and specifications for the project. The following is an outline of a general scope of work. The Consultant(s) firm / team should expand each of the following major work items into specific tasks, as well as add any additional items and tasks that would be necessary to assure an excellent overall product. A. Site analysis, inventory and evaluation of the river. B. Determination of the desired features, from the kayak community, to be installed in the river. C. Determination of access and bank improvements 2/9/00 D. Combination of meetings with staff and the kayak community. This process will need to be supported, at a minimum, by graphics displays and renderings, maps, and other visual materials. E. Preparation of the conceptual, preliminary and final drawings in an electronic and/or AutoCAD compatible format, construction specifications in CSI format or an approved alternate format, and cost estimates for each design phase of the project. F. Coordinate efforts with the hydraulic modeling consultant to achieve an acceptable design to both FEMA and the City of Fort Collins Storm Water Division. G. Coordinate efforts with the environmental consultant and process to achieve an acceptable design. H. Meet or exceed the criteria of all applicable local, state, and federal regulatory agency requirements. I. Develop and maintain a project schedule. J. Provide Construction services including but limited to preconstruction administration, construction monitoring, inspection, and contract administration. K. Provide information on your firm's / team's availability, and experience with other recent projects. The Consultant(s) firm / team must also have completed, through the construction phase, a minimum of three (3) other projects similar in nature and provide information about each project individually. The City will provide electronic files of aerial mapping for the project, as well as other available data and informational sources. All FEMA mapping, analysis, documentation, and reporting will be completed under a separate City contract. The environmental process will also be completed under separate City contract. A project representative will be available to answer questions and the "conceptual plan" will be available for review. III. IIV.REVIEW AND ASSESSMENT REVIEW AND ASSESSMENT Professional firms will be evaluated on the following criteria. These criteria will be the basis for review of the written proposals and interview session. The rating scale shall be from 1 to 5, with 1 being a poor rating, 3 being an average rating, and 5 being an outstanding rating. WEIGHTING QUALIFICATION STANDARD FACTOR 2.0 Scope of Proposal Does the proposal show an understanding of the project objective, methodology to be used and results that are desired from theproject? 2.0 Assigned Personnel Do the persons who will be working on the project have the necessary skills? Are sufficient people of the requisite skills assigned to theproject? 1.0 Availability Can the work be completed in the necessary time? Can the target start and completion dates be met? Are other qualified personnel available to assist in meeting the project schedule if required? Is the project team available to attend meetings as required by the Scope of Work? 1.0 Motivation Is the firm interested and are they capable of doing the work in the required time frame? 2.0 Cost and Do the proposed cost and work hours compare Work Hours favorably with the project Manager's estimate? Were problems corrected quickly and effectively? 2/9/00 PROFESSIONAL SERVICES AGREEMENT THIS AGREEMENT made and entered into the day and year set forth below, by and between THE CITY OF FORT COLLINS, COLORADO, a Municipal Corporation, hereinafter referred to as the "City" and , [insert either a corporation, a partnership or an individual,doing business as WITNESSETH: hereinafter referred to as "Professional'. In consideration of the mutual covenants and obligations herein expressed, it is agreed by and between the parties hereto as follows: 1. Scope of Services. The Professional agrees to provide services in accordance with the scope of services attached hereto as Exhibit "A consisting of ( ) pages, and incorporated herein by this reference. 2. The Work Schedule. [Optional] The services to be performed pursuant to this Agreement shall be performed in accordance with the Work Schedule attached hereto as Exhibit "B", consisting of ( ) pages, and incorporated herein by this reference. 3. Contract Period. This Agreement shall commence 2007, and shall continue in full force and effect until 2007, unless sooner terminated as herein provided. In addition, at the option of the City, the Agreement may be extended for additional one year periods not to exceed four (4) additional one year periods. Renewals and pricing changes shall be negotiated by and agreed to by both parties. Written notice of renewal shall be provided to the Service Provider and mailed no later than ninety (90) days prior to contract end. 4. Early Termination by City. Notwithstanding the time periods contained herein, 2/9/00 the City may terminate this Agreement at any time without cause by providing written notice of termination to the Professional. Such notice shall be delivered at least fifteen (15) days prior to the termination date contained in said notice unless otherwise agreed in writing by the parties. The Professional shall be responsible for the professional quality, technical accuracy, timely completion and the coordination of all services rendered by the Professional, including but not limited to designs, plans, reports, specifications, and drawings and shall, without additional compensation, promptly remedy and correct any errors, omissions, or other deficiencies. The Professional shall indemnify, save and hold harmless the City, its officers and employees in accordance with Colorado law, from all damages whatsoever claimed by third parties against the City; and for the City's costs and reasonable attorneys fees, arising directly or indirectly out of the Professional's performance of any of the services furnished under this Agreement. The Professional shall maintain commercial general liability insurance in the amount of $500,000 combined single limits and errors and omissions insurance in the amount of $ 6. Compensation. Final payment shall be made following acceptance of the work by the City. Upon final payment, all designs, plans, reports, specifications, drawings and other services rendered by the Professional shall become the sole property of the City. 7. City Representative. The City will designate, prior to commencement of work, its project representative who shall make, within the scope of his or her authority, all necessary and proper decisions with reference to the project. All requests for contract interpretations, 2/9/00 change orders, and other clarification or instruction shall be directed to the City Representative. 8. Project Drawings. [Optional] Upon conclusion of the project and before final payment, the Professional shall provide the City with reproducible drawings of the project containing accurate information on the project as constructed. Drawings shall be of archival, prepared on stable mylar base material using a non -fading process to provide for long storage and high quality reproduction. "CD" disc of the as -built drawings shall also be submitted to the owner in and AutoCAD version no older then the established city standard. 9. Monthly Report. Commencing thirty (30) days after the date of execution of this Agreement and every thirty (30) days thereafter, Professional is required to provide the City Representative with a written report of the status of the work with respect to the Scope of Services, Work Schedule, and other material information. Failure to provide any required monthly report may, at the option of the City, suspend the processing of any partial payment req uest. 10. Independent Contractor. The services to be performed by Professional are those of an independent contractor and not of an employee of the City of Fort Collins. The City shall not be responsible for withholding any portion of Professional's compensation hereunder for the payment of FICA, Workers' Compensation, other taxes or benefits or for any other purpose. 11. Personal Services. It is understood that the City enters into this Agreement based on the special abilities of the Professional and that this Agreement shall be considered as an agreement for personal services. Accordingly, the Professional shall neither assign any responsibilities nor delegate any duties arising under this Agreement without the prior written consent of the City. 12. Acceptance Not Waiver. The City's approval of drawings, designs, plans, specifications, reports, and incidental work or materials furnished hereunder shall not in any way relieve the Professional of responsibility for the quality or technical accuracy of the work. 2/9/00 The City's approval or acceptance of, or payment for, any of the services shall not be construed to operate as a waiver of any rights or benefits provided to the City under this Agreement. 13. Default. Each and every term and condition hereof shall be deemed to be a material element of this Agreement. In the event either party should fail or refuse to perform according to the terms of this agreement, such party may be declared in default. 14. Remedies. In the event a party has been declared in default, such defaulting party shall be allowed a period of ten (10) days within which to cure said default. In the event the default remains uncorrected, the party declaring default may elect to (a) terminate the Agreement and seek damages; (b) treat the Agreement as continuing and require specific performance; or (c) avail himself of any other remedy at law or equity. If the non -defaulting party commences legal or equitable actions against the defaulting party, the defaulting parry shall be liable to the non -defaulting party for the non -defaulting party's reasonable attorney fees and costs incurred because of the default. 15. Bindinq Effect. This writing, together with the exhibits hereto, constitutes the entire agreement between the parties and shall be binding upon said parties, their officers, employees, agents and assigns and shall inure to the benefit of the respective survivors, heirs, personal representatives, successors and assigns of said parties. 16. Law/Severability. The laws of the State of Colorado shall govern the construction, interpretation, execution and enforcement of this Agreement. In the event any provision of this Agreement shall be held invalid or unenforceable by any court of competent jurisdiction, such holding shall not invalidate or render unenforceable any other provision of this Agreement. 17. Prohibition Against Employing Illegal Aliens. This paragraph shall apply to all Contractors whose performance of work under this Agreement does not involve the delivery of a specific end product other than reports that are merely incidental to the 2/9/00 performance of said work. Pursuant to Section 8-17.5-101, C.R.S., et. seq., Contractor represents and agrees that: A. As of the date of this Agreement: 1. Contractor does not knowingly employ or contract with an illegal alien; and 2. Contractor has participated or attempted to participate in the basic pilot employment verification program created in Public Law 208, 104th Congress, as amended, and expanded in Public Law 156, 108th Congress, as amended, administered by the United States Department of Homeland Security (the `Basic Pilot Program") in order to verify that Contractor does not employ any illegal aliens. B. Contractor shall not knowingly employ or contract with an illegal alien to perform works under this Agreement or enter into a contract with a subcontractor that fails to certify to Contractor that the subcontractor shall not knowingly employ or contract with an illegal alien to perform work under this Agreement. C. Contractor shall continue to apply to participate in the Basic Pilot Program and shall in writing verify same every three (3) calendar months thereafter, until Contractor is accepted or the public contract for services has been completed, whichever is earlier. The requirements of this section shall not be required or effective if the Basic Pilot Program is discontinued. D. Contractor is prohibited from using Basic Pilot Program procedures to undertake pre -employment screening of job applicants while this Agreement is being performed. E. If Contractor obtains actual knowledge that a subcontractor performing work under this Agreement knowingly employs or contracts with an illegal alien, Contractor shall: 1. Notify such subcontractor and the City within three days that Contractor has actual knowledge that the subcontractor is employing or contracting with an illegal alien; and 2. Terminate the subcontract with the subcontractor if within three days of receiving the notice required pursuant to this section the subcontractor does not cease employing or contracting with the illegal alien; except that Contractor shall not terminate the contract with the subcontractor if during such three days the subcontractor provides information to establish that the subcontractor has not knowingly employed or contracted with an illegal alien. F. Contractor shall comply with any reasonable request by the Colorado Department of Labor and Employment (the "Department") made in the course of an investigation that the Department undertakes or is undertaking pursuant to the authority established in Subsection 8-17.5-102 (5), C.R.S. G. If Contractor violates any provision of this Agreement pertaining to the duties imposed by Subsection 8-17.5-102, C.R.S. the City may terminate this Agreement. If this Agreement is so terminated, Contractor shall be liable for actual and consequential damages to the City arising out of Contractor's violation of Subsection 8-17.5-102, C.R.S. H. The City will notify the Office of the Secretary of State if Contractor violates this provision of this Agreement and the City terminates the Agreement for such breach. 17. Special Provisions. The required permits will meet applicable federal, state, and local floodplain rules and regulations. The effective Flood Insurance Study (FIS) for this project is assumed to be the Larimer County FIS dated December 19, 2006. Documentation supporting a revision to the effective FIS in the project area of the Cache la Poudre River was submitted with the Oxbow Levee LOMR and will be effective April 19, 2007. The analyses and supporting documentation for the Oxbow Levee LOMR update was finalized in April 11, 2006 and approved by FEMA in December 2006 as a revision to the Larimer County DFIRM. The project reach for the current analyses is between Cache la Poudre River Main Channel Cross Sections AV:230017 (Upstream side of the BNRR) and 230355 (Downstream side of the Boat Chute). The anticipated study reach for the current analyses is between Cache la Poudre River Main Channel Cross Sections AV:230017 (Upstream side of the BNRR) and 230472 (Upstream side of the Coy Diversion Dam). The study reach definition assumes the 100- and 500-year floodplain delineations in the left overbank remain the same or are reduced. Tracking a major change of the floodplain delineations on the left overbank is beyond the scope of the current study. The purpose of this study is to design and obtain FEMA approval of the proposed Water Craft Course. No changes to the effective CLPR hydrology are assumed for the current study. All modeling for the current study will be performed using the USACE's HEC-2 model. Task 1. Data Collection and Basemap Preparation This task will include the compilation, review, and evaluation of available materials associated with the channel hydraulics and regulatory floodplain of the Cache la Poudre River between the Burlington Northern Railroad and North College Avenue (U.S. 287). The pertinent information may include but is not limited to: 1. The effective Flood Insurance Study (FIS) text, tables, profiles, and associated Flood Insurance Rate Maps (FIRMS) for Larimer County; 2. Development plans/as-built information for any construction along the river including bike trails and the Water Craft Course structures; COFC2007-05 SOW -DRAFT Thursday, March 22, 2007 SCOPE OF WORK (Continued) March 22.2007 Page 3 3. The available reports and documentation related to floodplain and channel hydraulics, including the submitted LOMR documentation for the Oxbow Levee LOMR [FEMA April 19, 2007; and ACE April 11, 2006] and a separate half -foot floodway analysis [ACE October 18, 20061. A corrected effective basemap will be developed based on the revised condition basemap from the Oxbow LOMR by overlaying the topography from Task 2. ACE will also participate in the interview and selection process for the lead design consultant for the Water Craft Course. Task 2. Surveying of Existing Conditions This scope of work assumes and provides for new surveying and the generation of 1-foot topography for the area(s) shown in Exhibit B. All surveying data will be referenced to the City of Fort Collins Datum (National Geodetic Vertical Datum of 1929 Unadjusted), the same datum utilized for the effective base mapping. Conversion of the horizontal datum to Colorado State Plane (NAD 83) will be provided. A Colorado Registered Professional Land Surveyor will certify the topography. Task 3. Effective and Duplicate Effective Condition The effective hydraulic models will be operated during the Duplicate Effective step to ensure that similar results are obtained when compared with the results published in the April 19, 2007 LOMR. This task will compile the effective FEMA models received from the COFC for the study reach of the Cache la Poudre River. Evaluations will be made of the FEMA regulated 100- year floodplain and one -foot floodway. An additional evaluation will be made of the COFC regulated half -foot floodway. Water surface (10-, 50-, 100-, and 500-year events) and floodway data comparison tables will be provided in the City of Fort Collins Datum (NGVD 29 Unadjusted) summarizing the published effective data and the results of the duplicate effective analyses. Comparison tables in FEMA's datum (NAVD 88) will be provided in an appendix. Task 4. Corrected Effective Condition The Duplicate Effective HEC-2 models will be updated to include the corrected topography developed in Task 2. It is recommended that the additional cross sections be incorporated at the location of the proposed encroachments in the revised condition. Evaluations will be made of the FEMA regulated 100-year floodplain and one -foot floodway. Water surface and floodway data comparison tables will be provided in the City of Fort Collins Datum (NGVD 29 Unadjusted) summarizing the results of the Duplicate Effective and Corrected Effective analyses. Revised Condition Task 5.1 Hydraulic Design A hydraulic evaluation will be made of the proposed channel bottom encroachments. Mitigation of potential water surface rises due to the channel bottom encroachments will be investigated by altering channel side topography. Two iterations of channel bottom and channel side modifications and analysis are assumed for this task. This task includes no more than four hours of effort related to assisting with addressing local scour related issues. This task includes two meetings to discuss the results and findings of the hydraulic design effort. Task 5.2 Hydraulic Analysis After completion of the hydraulic design iterations a final hydraulic analysis will be compiled to support the revised condition analysis of the CLOMR. The HEC-2 model, floodplain and floodway summary tables, 100-year water surface profiles, 100-year floodplain delineations, and one -/half -foot floodway delineations will be updated with the Reviseed Condition information. Evaluations will be made of the FEMA regulated 100-year floodplain and one -foot floodway. Water surface and floodway data comparison tables will be provided in the City of Fort Collins Datum (NGVD 29 Unadjusted) summarizing the results of the Duplicate Effective and Corrected Effective analyses. The report will include the methodology, assumptions, and results associated with the study. In addition, all flood profiles and floodplain/floodway delineations will be included. Documentation of all floodplain and floodway analyses will be provided in technical appendices. Work maps specifically delineating the 100-year floodplain/one- and half -foot floodways for the Cache la Poudre River will be included in the report. A compact disk (CD) will be included in the draft report containing all the appendices and hydraulic models utilized in the study. After the City of Fort Collin's review and approval of the draft report, four copies of the final report will be produced (FEMA, COFC-Utilities, COFC-Parks, CWCB). In addition to the models, the final CD will contain a PDF version of the final report text and appendices. This task includes the correction of minor post draft review comments. Task 7. Permitting It is assumed that the selected contractor, prior to the commencement of construction, will prepare a Construction Stormwater Discharge Permit for the Colorado Discharge Permit System (CDPS), along with a Stormwater Management Plan (SMP). Task 7.1 Floodplain Permits A City of Fort Collins Floodplain Use Permit will be prepared and submitted to the City's Floodplain Administrator. This task does not include the estimated $325 submittal fee required by COFC. An application for a FEMA Conditional Letter of Map Revision (CLOMR) will be made. All required FEMA application forms for a CLOMR will be completed and provided to the City of Fort Collins for submittal to FEMA. This task includes one meeting with the City of Fort Collins to present and review the application package. Four copies of the submittal package will be provided to FEMA, the City of Fort Collins, and CWCB. This task does not include the estimated $4,000 submittal fee required by FEMA. This task does not include effort associated with public notifications of changes to the floodplain and/or floodway(s). It is assumed that public notifications will be performed by the City of Fort Collins Utilities Department. This task includes the submittal of GIS linework to the COFC for inclusion in the City's database. It is assumed that the City of Fort Collins will delineate wetlands and waters of the United States for incorporation into both the design drawings and the figures required for the 404 permit application. ACE will provide all pertinent design information, both narrative and figures, necessary for the City of Fort Collins to complete the permit application Task 8. Construction Management Support The following construction support services will be provided: (a) two inspection site visits by an engineer during construction; (b) one site visit by the surveyor to perform spot check of critical elevations during construction; and (c) one site visit by the surveyor after the completion of construction to perform the as -built survey. Task 9. Letter of Map Revision (LOMR) This task assumes minimal changes to the revised condition analysis prepared in Task 5.2. The Task 5.2 revised condition analyses will be updated with the as -built data collected in Task 8. Any as -built changes that significantly alter the hydraulic results of the hydraulic modeling completed during the CLOMR will be handled under a separate scope and budget. The effective, duplicate effective, corrected, and revised conditions steps will be recompiled into a LOMR report. An application for a LOMR will be made to FEMA. All required FEMA application forms for a LOMR will be completed and provided to the City of Fort Collins for submittal to FEMA.
