HomeMy WebLinkAbout104230 CSU ENVIRONMENTAL HEALTH SERVICES - CONTRACT - CONTRACT - INTERGOVERNMENTAL AGREEMENTINTERGOVERNMENTAL AGREEMENT THIS AGREEMENT is entered into this 9-- b +t` day of February, 2005 by and between THE CITY OF FORT COLLINS, COLORADO, a municipal corporation, hereinafter referred to as "City", and the Colorado State Board of Agriculture by and through COLORADO STATE UNIVERSITY for the use and benefit of the ENVIRONMENTAL HEALTH SERVICES LABORATORY, ENVIRONMENTAL HEALTH SERVICES, hereinafter referred to as "CSU". WITNESSETH: In consideration of the mutual covenants and obligations herein expressed, it is agreed by and between the parties hereto as follows: (1) Sampling and Testing. CSU shall conduct water quality sampling and testing for the City at various sites on the campus. A minimum of thirty (30) potable water samples shall be taken monthly, said samplings to be evenly distributed throughout the month. (2) Written Reports. No later than the fifth day of the month following the month within which the samples were taken, CSU shall insure that written reports are submitted to the Environmental Services Manager, Water Utilities, City of Fort Collins, Water Quality Lab, 4316 LaPorte Ave., Fort Collins, Colorado 80521. (3) Testing Standards. Testing for total coliforms, temperature and free chlorine residual at each sample site shall be done in accordance with the latest USEPA-approved edition of Standard Methods for the Examination of Water and Wastewater and 40 CFR Parts 141 and 142. (4) Payments. In consideration for the services to be performed by the CSU, the City shall pay the following sums: For the period beginning January 1, 2005, through December 31, 2005, the sum of Four Thousand -Two -Hundred -Fifty Dollars ($4,250.00). For the period beginning January 1, 2006, through December 31, 2006, the sum of Four Thousand -Three- Hundred Dollars ($4,300.00). Said payments shall be made to CSU within 30 days of billing. (5) Term. This agreement shall remain in force and effect for a period of twenty-four (24) months from January 1, 2005, and terminating December 31, 2006, unless otherwise extended by written agreement of the parties hereto. (6) Contingency. The obligations of the City and CSU under this Agreement for the period beginning January 1, 2005, through December 31, 2006, shall be contingent upon the Fort 2005 - 2006 CSU Intergovernmental Agreement Collins City Council budgeting and appropriating the necessary funds to be paid by the City to CSU under paragraph (4) above for such period of time. If such funds are not so budgeted and appropriated, then this Agreement shall terminate and both parties shall be relieved from all obligations hereunder.
