ORDER GRANTING THE TIMNATH DEVELOPMENT AUTHORITY AND
COMPASS MORTGAGE CORPORATIONS JOINT MOTION TO DISMISS AND
REQUEST FOR EXPEDITED BRIEFING AND HEARING
THIS MATTER comes before the Court on The Timnath Development Authority and
Joint Motion to Dismiss and Request for Expedited Briefing
The Court, having reviewed the Motion and being fully apprised of its premises, hereby
GRANTS the Motion:
Pursuant to C.R.C.P. 121§ 1-15(4), expedited briefing on the Motion is hereby
ordered. Plaintiff is to file his response within __ days, no later than June __, 2018.
Defendants are to file their reply by June __, 2018;
A hearing on the Motion is hereby set for June __, 2018; and
Pursuant to C.R.C.P. 12(b)(5), in its
entirety with prejudice as to Compass Mortgage Corporation and the Timnath
Development Authority for failure to state a claim upon which relief can be granted.
