ORDINANCE NO. 200, 2025
OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING THE CODE OF THE CITY OF FORT COLLINS TO
RENAME THE CULTURAL SERVICES DEPARTMENT AS THE
ARTS AND CULTURE DEPARTMENT AND RENAME THE
CULTURAL SERVICES AND FACILITIES FUND AS THE ARTS
AND CULTURE FUND
A. The City’s Cultural Services Department exists within the City’s Community
Services Service Area. The City seeks to rename the Cultural Services Department as
the Arts and Culture Department to better reflect the work and mission of the Department.
Amendments to the Code of the City of Fort Collins are required to effectuate this name
change. Additionally, the new name of the Department will be used on the City’s new
website, which will go live on December 10, 2025.
B. The Cultural Services and Facilities Fund holds City funds to expend on
cultural services and related facilities. To align with the name of the Arts and Culture
Department, City staff has recommended renaming the Cultural Services and Facilities
Fund as the Arts and Culture Fund.
In light of the foregoing recitals, which the Council hereby makes and adopts as
determinations and findings, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
FORT COLLINS as follows:
Section 1. Section 2-143 of the Code of the City of Fort Collins, as amended by
Ordinance No. 091, 2025, and effective April 1, 2026, is hereby amended to read as
follows:
Sec. 2-143. - Arts and Culture Board
. . .
(b) The Board shall have the following functions:
(1) To assist, advise and make recommendations to the Director of the Arts and
Culture Department and City Council on arts and culture matters and regarding
opportunities to promote awareness, understanding, advocacy, and appreciation
for the value of arts and culture in the community. This may include providing
assistance, advice and recommendations regarding the following programs,
facilities and plans:

(4) To review proposals for funding from the Cultural Development and
Programming Account and the Tourism Programming Account, as requested by
the Director of the Arts and Culture Department;
(5) To advise and make recommendations to the Arts and Culture Department
and the City Council regarding works of art funded by or donated to the Art in Public
Places program, as required in Chapter 23, Article XII of the City Code, and
following the established and published Art in Public Places Guidelines, as defined
in Section 23-302.
Section 2. Section 2-145 of the Code of the City of Fort Collins is hereby
amended to read as follows:
Sec. 2-145. Cultural Resources Board.
(a) The City shall have a Cultural Resources Board, hereafter referred to in this
Section as the "Board." The Board shall consist of seven (7) members.
(b) The Board shall have the following functions:
(1) To advise and make recommendations to the Director the Arts and Culture
Department and the City Council as to rules, regulations, policies, administrative
and budgetary matters pertaining to the Arts and Culture Department's programs,
services and facilities and any other cultural facility constructed or operated by the
City;
(2) To review proposals for funding from the Cultural Development and
Programming Account and the Tourism Programming Account, fol lowing
established and published guidelines, and to submit recommendations regarding
such proposals to the City Council to be approved by the City Council by resolution;
(3) To advise and make recommendations to the City Manager regarding any
proposed revisions to the guidelines used by the Cultural Resources Board to
make the funding recommendations referred to in Paragraph (2) above; and
(4) To assist, advise and make recommendations to the Director of the Arts and
Culture Department and the City Council on arts and culture related matters and
regarding opportunities to promote awareness, understanding, and appreciation
for, the value of cultural resources in the community.
(c) All terms of members of the Board shall terminate April 1, 2026.
Section 3. Section 2-145 of the Code of the City of Fort Collins will be repealed
in its entirety on April 1, 2026, pursuant to Section 4 of Ordinance No. 091, 2025, of the
City of Fort Collins. Nothing in this Ordinance is intended to impact such repeal.

Section 4. Section 8-76 of the Code of the City of Fort Collins is hereby
amended to read as follows:
Sec. 8-76. Arts and Culture fund.
There is hereby created a fund to account for arts and cultural activities known as the Arts
and Culture Fund. Revenues for the fund shall include user fees and receipts for cultural
activities as well as operating transfers from other funds. Expenditures shall be made for
approved purposes in connection with the arts, cultural services and related facilities of
the City.
Section 5. Section 23-303(c) of the Code of the City of Fort Collins is hereby
amended to read as follows:
Sec. 23-303. Accounting methods.

(c) Contributions to APP for each Utility will be kept and spent in such Utility's own
fund, with the exception of maintenance, administration, repair and display costs. Each
Utility fund will pay its share of maintenance, administration, repair and display costs
annually to the APP program cost center in the Arts and Culture Fund. Monies credited
to such Utility funds for APP shall be expended only for the acquisition or lease of works
of art that provide a betterment to such utility or that are otherwise determined by the City
Council to be for a specific utility purpose that is beneficial to the rate payers of such
Utility.
Section 6. Section 23-307 of the Code of the City of Fort Collins is hereby
amended to read as follows:
Sec. 23-307. Administration.
The Director of the Arts and Culture Department shall administer the provisions of this
Article in a manner consistent with the APP Guidelines. The guidelines shall provide for
the selection of works of art; the placement and presentation of works of art; the
maintenance, repair and care of works of art; the payment for works of art; the acceptance
of donations of works of art; and such other matters as the Director deems necessary and
appropriate.

approved on second reading for final passage on December 16, 2025.
