Has geotechnical work already been completed or is it still needed at this stage? If it is still needed, will the City be using its on-call contract or will the design team be responsible? Response: Geotechnical investigation has not been completed and all necessary geotechnical work for the preliminary design will be required. The City of Fort Collins will not be using its on-call contract and it will be the responsibility of the selected planning / design team to complete this work. 2. Page 11 of the pre-proposal meeting slides states “All proposals must include a completed Acknowledgement Form, and Certificate Regarding Lobbying.” We don’t see a Certificate Regarding Lobbying form included in the RFP. Can you please provide that? Response: See Exhibit 2 below. 3. Item 2 in Section D: Firm Capability and Assigned Personnel requests that resumes be provided for each professional and technical person to be assigned to the project. Do you want the resumes to be included a) in the answer to item 2, b) at the end of Section D, or c) in an Appendix in the back, as they are not included in the page count? Response: Include as a separate Appendix in the back not included in the page count. 4. Item 4 in Section D: Firm Capability and Assigned Personnel requests that we provide beginning and ending prices for a minimum of three similar projects. Are you asking for the design fee or the construction cost? Response: We would like to know the beginning and ending design fee as well as the beginning and ending construction costs for the projects. Addendum # 1 RFP 10197 Vine and Timberline Overpass Design EXHIBIT 2 - Byrd Anti-Lobbying Amendment (31 U.S.C. 1352) CERTIFICATION The Contractor attests that it has filed the required certification under the Byrd Anti-Lobbying Amendment. The Contractor attests that it has certified that it will not and has not used Federal appropriated funds to pay any person or organization for influencing or attempting to influence an officer or employee of any agency, a member of Congress, officer or employee of Congress, or an employee of a member of Congress in connection with obtaining any Federal Contract, grant or any other award covered by 31 U.S.C.1352. The Contractor further attests that it has disclosed, and will continue to disclose, any lobbying with non-Federal funds that takes place in connection with obtaining any Federal award. The undersigned certifies, to the best of his or her knowledge and belief, that: (1) No Federal appropriated funds have been paid or will be paid, by or on behalf of the undersigned, to any person for influencing or attempting to influence an officer or employee of an agency, a Member of Congress, an officer or employee of Congress, or an employee of a Member of Congress in connection with the awarding of any Federal contract, the making of any Federal grant, the making of any Federal loan, the entering into of any cooperative agreement, and the extension, continuation, renewal, amendment, or modification of any Federal contract, grant, loan, or cooperative agreement. (2) If any funds other than Federal appropriated funds have been paid or will be paid to any person for making lobbying contacts to an officer or employee of any agency, a Member of Congress, an officer or employee of Congress, or an employee of a Member of Congress in connection with this Federal contract, grant, loan, or cooperative agreement, the undersigned shall complete and submit Standard Form--LLL, "Disclosure Form to Report Lobbying," in accordance with its instructions [as amended by "Government wide Guidance for New Restrictions on Lobbying," 61 Fed. Reg. 1413 (1/19/96). (3) The undersigned shall require that the language of this certification be included in the award documents for all subawards at all tiers (including subcontracts, subgrants, and contracts under grants, loans, and cooperative agreements) and that all subrecipients shall certify and disclose accordingly. This certification is a material representation of fact upon which reliance was placed when this transaction was made or entered into. Submission of this certification is a prerequisite for making or entering into this transaction imposed by 31, U.S.C. § 1352 (as amended by the Lobbying Disclosure Act of 1995). Any person who fails to file the required certification shall be subject to a civil penalty of not less than $10,000 and not more than $100,000 for each such failure.
