It is understood by the undersigned that,by acceptance of this dedication,the City of Fort Collins accepts the right-of-way as shown in Exhibit A with the public improvements thereto and in the physical condition existing at the time of execution of this deed.Unless otherwise specifically agreed by the City,the City does not assume the duty of maintenance of sidewalks, curbs and gutters, or parkways in the right-of-way. Any future construction of improvements and the maintenance and repair guarantees as required by City Code will be the responsibility of the constructor. After meeting the responsibility of any required construction and guarantees, maintenance is then assumed as defined by City Code.In the event that the City performs work in the right-of-way,it shall perform such in a diligent manner to completion.
