sample of the easement document that I prepared, using your direction,
to you last week. If it is acceptable to you, I will get the easement
does out to the owners for execution.

Subject: Boilerplate DA language
Mr. McDonaugh,
In response to a request from Scott Sinn at BHA, I've attached the
City's boilerplate language for development agreements. The final DA
for the project will be different than what is shown, especially in the
areas of water/wastewater, stormwater, and streets.
For your information, I am going to outline the process:
The City doesn't begin working on project-specific language for DA's
until the project has been approved at a public hearing, final
compliance plans have been submitted for review, and all of the
remaining questions on the plans have been answered. When that has
occurred, and I have received the site-specific language from various
City departments and incorporated it into the DA and I have received a
completed DA information sheet from you, I will send you a copy of the
DA for you and your attorneys to review. If there are concerns about
the DA language, we will then work out any problems, and come to a final
draft, which I will then give you 6 copies of for the appropriate
developer/owner signatures.
During this same time,the utility plans and site and landscape plans
need to be finalized, with mylars submitted to the City for signatures.
When the utility plan mylars have been signed by the City, and the City
has received the DA copies signed by the developer/owner and any other
items required for the development(such as deeds of dedication for
easements or ROW), then the utility plan mylars will be released back to
your engineer so that they can make copies for our files. Once we have
received these copies, then that completes Engineering's requirements
for having an approved development. Please contact the Current Planning
department for the process for approval of the site and landscape
plans.
Construction onsite may only begin after a Development Construction
Permit is issued, and I can fax you that information if you like. The

Development Construction Permit is a permit to start grading and utility
installation work, which needs to occur before the building permit can
be released.
