Description of RFP 10098: Transit Advertising RFP

the following changes/additions are hereby made and detailed in the following sections of this
addendum:

EXHIBIT 1 – QUESTIONS & ANSWERS
1. Regarding the replacement of shelters, can you provide any additional specific information
regarding timing and product types for the shelter replacement that the city plans on
installing?
Shelter replacement can mean replacing the entire structure with a new one or
removing and reinstalling a shelter after construction. Replacement is dependent
on the availability of funds and proper permitting. Transfort does foresee the need
for minimal shelter replacement in the next five years but at this time we are unable
to comment on when or exactly how many. CSU will require the installation of
approximately 20 shelters which do not have any ad space. When shelters are
replaced, we prefer to replace them with a similar shelter containing the same
amount of ad spaces. For additional details, please see section 2.3 of Attachment D
(Transfort Bus Stop Standards & Guidelines) in the RFP document, as well as
Exhibit 3 to this Amendment, which is taken from the current Amenities Contract .
2. Under the Innovative Approaches section:
a. Discuss the firm’s recognition of market segmentation as it relates to the City. – Can you
please add some clarification to this question? Are you asking about industries,
geographic locations, market sector, etc. Or is there something else that the City is
looking for with this question?
Transfort would like the prospective ads to suit the community’s demographic
and be representative of the characteristics of the population as a whole.
b. Explain Service Provider’s approach to both selling and posting advertising appropriate
to the different settings in which Transfort operates. – Can you please explain
“appropriate to the different settings” in this question? Is this in regard to locations
throughout the city, departments within in the City, different events or advertising needs
of the city, advertising policy, etc.?
Transfort would like the selected advertising company to take the community
into consideration when placing ads. We would prefer for the ads to suit their
location. For example, bus stops in residential areas likely have a different
demographic than the ad spaces by CSU or downtown. Is this possible and if
so, how would your company strive to achieve this?
3. How should proposers submit their redacted proposal files? Also upload to the portal?
Yes, please upload your redacted proposal as a separate document to BidNet.
4. Is Transfort open to full wrapped bus designs?
At this time, Transfort is not open to fully wrapped bus designs. There is interest
in learning more about wheel to wheel ad types. The decision to move forward
with wheel to wheel ads is dependent on the alignment with internal policies and
the potential for revenue.
5. Is Transfort open to using perforated vinyl on designs that extend to the windows to
maximize visibility?
Perforated vinyl is preferred if Transfort decides to move forward with wheel to
wheel ad types. Please present any pertinent information regarding this type of

ad, including the installation process and potential revenue share. Transfort will
make a final determination based on alignment with internal policies and the
potential for revenue.
6. Please provide the lats/longs of the existing shelters and benches.
See chart attached in Exhibit 2.
7. Can you please provide some clarification/information about the existing and historical
advertising program?
Transfort had a third-party contract for advertising at bus stops (benches and
shelters) in place from 2001 through 2021. This contract was extended through
the end of 2022 to allow time for a new advertising policy was being updated and
a new Request for Proposal was developed. Under this original contract, the
contractor was responsible for all aspects of the advertising program, including
marketing, promotion, printing, installation and removal. The contractor was also
responsible for maintenance of the bus stops with advertising, including trash
removal, general cleaning, repair and maintenance, graffiti abatement, and snow
removal. The contractor was also responsible to complete a certain number of
bus stops upgrades each year (ADA accessible concrete pads, and purchase of
amenities).
Transfort also had a separate contract for on bus advertising in place from 2016
through 2022, this included interior and exterior advertising (panels only, no
wraps).
Transfort had completed competitive processes to execute new advertising
contracts in 2020 but declined to award a contract at that time.
At the conclusion of bus stop advertising and on bus advertising contracts in
2022, Transfort elected to pause the pursuit of commercial advertising while re-
evaluating its advertising program and policy. During the period from 2023 –
present, Transfort implemented a limited advertising program showcasing
advertising from only Transfort and other City Departments.
Transfort has updated its advertising policy and now desires to return to a
commercial advertising program. Once a contract is executed, Transfort will
remove all existing advertising from buses and bus stops, except for the stops
and on bus ad spaces that Transfort is electing to retain, referred to in the scope
of work as “Transfort Designated Spaces.”
8. Can you please provide clarification the allowed ad types – will the new vendor have the
ability to place ads top to bottom, wheel well to wheel well (aka extended kong)?
Transfort is interested in learning more about this type of ad. Please present any
pertinent information, including the installation process and potential revenue
share. Transfort will make a final determination based on internal policies and
potential for revenue.
9. Is if there is any standard transition language from one vendor to another. Such as revenue
shares, contracts being handed over, etc.?
Not at this time. The City will negotiate those specific terms with the awarded
Service Provider as part of contract negotiations. As there is currently not any

public advertising in place, there will not be any transition needs for the awarded
Service Provider to address upon beginning services.
10.When Transfort was operating and selling their program prior to re-evaluation, did you
subcontract the installation and removal of the vinyl advertising? If yes, please share the
subcontractor’s name and contact information.
No. The advertiser was responsible for installation and removal as well.
11.In the proposal, the City is requesting that the question be restated. Is restating the question
in the header of the page acceptable?
Yes.
12.In the proposal, when restating the questions, if the narrative response answers multiple
questions, should these be restated at the start of the sub section? Additionally, some
questions in Section F. are answered in earlier sections to questions from Sections C. and
E., how should this be noted in the proposal?
Either restate the answer or refer to the section where the answer was already
provided.
13.In the proposal layout, Section F. Question 5 is “State the Minimum Annual Revenue
Guarantee you will offer the City and proposed methodology for determining the City’s
revenue for the Service Provider’s exclusive right to the Advertising Program.” Does this
question belong in Section G. Compensation?
Please answer the question in the section as set forth in in the RFP document.

Provider will work with the City of Fort Collins to design a custom shelter at a mutually
agreeable price consistent with the pricing for standard sized shelters. The design work for such
shelters shall be provided by the Service Provider at no cost to the City.

Official Purchasing Document WARRANTY: LIMITATION OF LIABILITY
The Service Provider warrants the products and materials provided by it, when properly
assembled and installed, to be free from defects in materials and workmanship, when under
normal use and service, for the expected Useful Life of the product. If any products or materials
provided by the Service Provider are found to be defective, the Service Provider will repair or
replace, at its sole option, the defective products or materials, subject to the following conditions:
A. The Service Provider is notified in writing within the applicable warranty period of any
product or material defect; B. The product or material has not been misused, abused or
improperly maintained; C. This warranty excludes glazing, electronic components, illumination
components and powder coat defects not associated with fading or lifting, which shall be
warranted for a period of one year. Powder coat finish is warranted for a period of two (2) year
against fading or lifting. The solar illumination systems are warranted for five (5) years with the
exception of the batteries, Batteries for solar illumination are warranted for three (3) years with
the following criteria: 100% year 1, 50% year 2 and 25% year 3. D. The product or material has
been installed in compliance with the installation instructions and has not been repaired or
altered except by written authorization of the Service Provider; and E. The defect is not
attributable to vandalism or normal wear and tear. The limited warranty herein described
constitutes the entire obligation of the Service Provider and the maximum liability of the Service
Provider is limited to the purchase price plus the cost of shipping of each defective product or
material. No other warranties, whether express, implied or statutory, including warranties of
fitness for a particular purpose or merchantability are given and all such warranties are hereby
expressly disclaimed. In no event shall the Service Provider be liable for any consequential,
indirect, incidental or special damages of any nature whatsoever arising from the sale or use of
its products or materials. The Service Provider shall have no further liability or obligation
whatsoever to any distributor or any other person or entity with respect to the Service Provider’s
products or materials other than the obligations expressly set forth above.
STARTING DATE The STARTING DATE shall be determined as that date which can be
verified to the Service Provider’s reasonable satisfaction as the product installation date.
ADDITIONAL RESPONSIBILITIES
The Service Provider will provide, or make available, such information or instruction as is
needed to install, service, operate, and maintain its products. The Service Provider will provide
the replacement parts or materials, freight prepaid, and reimburse distributor for freight charges
on returned components, which are warranted. The Service Provider will make every attempt to
respond to warranty claims within thirty (30) days after the receipt of written request as stated in
this warranty.
PRODUCT INSTALLER RESPONSIBILITIES Installer is responsible for installing the
product in accordance with the Service Provider’s specifications and installation instructions.

Official Purchasing Document Installer is responsible for keeping such records as are necessary to locate the product and
determine its installation date.
PRODUCT OWNER RESPONSIBILITIES Owner is responsible for communication
expenses, meals, lodging, and incidental costs incurred by the owner or employees of the owner
as a result of warrantable failure. Owner must give notice of a warranted failure to the Service
Provider.
ADDITIONAL WARRANTY LIMITATION
The Service Provider is not responsible for products, which have failed as a result of owner or
operator abuse or neglect, such as lack of maintenance, vandalism, product alteration, overload,
accident, or other causes beyond its control. The Service Provider does not warrant the product
when it is used with accessories not approved by the Service Provider or when other than
genuine Tolar Manufacturing Co., Inc. replacement parts have been installed on the product. The
Service Provider does not warrant accessories supplied by manufacturers which bear the name of
a company other than Tolar Manufacturing Co., Inc., beyond the warranty provided by that
company. The Service Provider does not warrant the paint finish if documentation cannot be
provided as to the cleaning frequency of the product painted and the product has not been
cleaned with a cleaner approved by Tolar Manufacturing Co., Inc. or if the product has been
damaged due to etching, graffiti or other vandalism. Product cleaning and maintenance should be
in compliance with AAMA 609/ 610. The Service Provider shall not be responsible for expenses
due to owner's requirements, inspections, or modification of components, or other handling
requirements. The Service Provider shall not be responsible for parts returned without prior
authorization or without proper identification, including claimant's name and the Service
Provider’s claim number.
WARRANTY CLAIM PROCEDURES
HOW TO MAKE A CLAIM: To make a claim under this WARRANTY, the Owner must
provide the Service Provider adequate documentation which states product modes, start date, the
serial number as shown on the serial tag installed on the product, where and how used. These
warranties are the sole warranties of the Service Provider. There are no other warranties express
or implied.
