DEED OF DEDICATION FOR RIGHT-OF-WAY
KNOW ALL MEN BY THESE PRESENTS: That the undersigned CACHE LA POUDRE
RESERVOIR COMPANY ("Grantor"), being the owner of certain real property in Larimer County, Colorado
legally described at Reception No.44071 in the Larimer County Records, inconsideration often dollars($10.00)
in hand paid, receipt of which is hereby acknowledged, and other good and valuable consideration, does hereby
dedicate,transfer, and convey to the City of Fort Collins, Colorado, a Municipal Corporation("Grantee"),whose
mailing address for purposes of this Deed of Dedication is P.O. Box 580, Fort Collins, CO 80522, for public use
forever a permanent right-of-way for public street purposes in the City of Fort Collins, County of Larimer, State
of Colorado, as described on Exhibit A attached hereto and by this reference made a part hereof.
The undersigned acknowledges in this Deed of Dedication for Right of Way the right-of-way easements
granted by Grantor to PNE Prospect Road Holdings, LLC (the "developer") in the Crossing Agreement for
Carriage Parkway, Fiber Optics and Power Conduits in the records of the Larimer County Clerk and Recorder at
Reception No. 20240054368 executed by Grantor, Grantee, and the developer ("Crossing Agreement"), ,
including, as set forth in the Crossing Agreement, among other duties, the duty of maintenance of the hereby
dedicated right-of-way and permanent improvements constructed therein and thereon pursuant to the Crossing
Agreement. Unless otherwise specifically agreed by the City, the City does not assume the duty of maintenance
of sidewalks, curbs and gutters, or parkways.For avoidance of confusion,this Deed of Dedication grants a right-
of-way easement only, and Grantor retains fee ownership of the property described on Exhibit A. This Deed of
Dedication does not convey any rights-of-way or other property interest to any entity other than the Grantee.
Separate from this Deed of Dedication,Grantor must grant additional rights for any additional structures,including
utilities,to be installed on, in,through, or below the property described on Exhibit A.

A parcel of land being a part of that tract of land recorded as Reception No.20210025371 of the Records of
Larimer County and situate within the Southwest Quarter of Section Fifteen(15),Township Seven North(T.7N.),
Range Sixty-eight West(R.68W.)of the Sixth Principal Meridian(61"P.M.),City of Fort Collins,County of Larimer,
State of Colorado,being more particularly described as follows;
Considering the South line of the Southwest Quarter as bearing North 89°59'24"West with the Southwest
corner of Section 15 being monumented by a 2 1/2"brass cap in concrete and the South Quarter corner of Section
15 being monumented by a 2 1/2"aluminum cap on#6 rebar in monument box stamped PLS 28295 and with all
bearings contained herein relative thereto:
COMMENCING at the Southwest Quarter of Section 15;
THENCE along the West line of the Southwest Quarter North 00'11'30" East a distance of 1380.89 feet;
THENCE departing said West line South 89'48' 16" East a distance of 95.14 feet to the South line of that tract of
land recorded at Reception No.20210025371;
THENCE along the Southwesterly line of said tract of land the following three(3)courses and distances:
