Section 9 of the sample agreement note that the service provider shall “indemnify and defend.” We request that the word ‘defend’ be removed so that this clause will more closely match industry standard contracts (AIA B-101 2017) for professional services, or substitute the following language: “Indemnification. Notwithstanding any clause or provision in this Agreement or any other applicable Agreement to the contrary, Architect’s only obligation with regard to indemnification shall be to indemnify, but not defend, the Client, its officers, directors, employees and agents from and against damages arising out of third-party claims that Client is legally obligated to pay as a result of the death or bodily injury to any person or the destruction or damage to any property, to the extent caused by the negligent act, error or omission of the Architect or anyone for whom the Architect is legally responsible, subject to any limitations of liability contained elsewhere in this Agreement.” This wording is consistent with Standard AIA Agreements and the requirements of our professional liability insurers. The City/PFA is open to negotiating the final agreement terms with the awarded Service Provider. However, we will not negotiate or commit to changes to our standard terms and conditions at this stage of the RFP process. You are welcome to submit your proposed redlines to the standard Agreement as provided for in Section II.G of the RFP document. 2. Scope of Work; Deliverables; Item 3 notes “Detailed Cost Estimate including funding Strategies.” Please clarify the term “Funding Strategies.” Is it the intention of the City that the successful proposer will help write grants and / or governmental funding requests, or bond or referendum campaign texts? It is not the intention of the City/PFA that the proposer write grants or funding requests. Should the proposer have suggestions to assist the City/PFA fund projects and/or help prioritize projects and provide options for funding them, it would strengthen the proposal. 3. RE: RFP Section III.C.5. Provide a sample facility master plan or comparable document. Question: Rather than including our sample document in Section C, are we able to place it in the back of our proposal as an appendix? Yes, this would actually be preferable. 4. RE: RFP Section II.B. PFA would like to complete this Facility Master Plan project by the second quarter of 2025. Question: Please clarify whether PFA would like the project complete by the end of the second quarter of 2025 or complete before the second quarter of 2025. We are aiming for the end of the second quarter of 2025. 5. Can you provide the number of buildings? The aerial appears to show several accessory buildings to the main building. There are two office buildings that have two floors and bay space for apparatus and storage. The remainder of the buildings are props that the Fire Department uses for fire academies and training incumbents. These include a six-story concrete tower, double-wide modular, two-story concrete house, three-story burn building, a “roof” prop to practice roof operations. Other areas of interest include an extrication yard for cutting and burning vehicles, and a confined space area to Addendum 1 Page 3 of 5 practice under-ground rescue. 6. Additionally, can you provide the building SF, construction year, and floors by building for each? This is information that we have and will provide to the awarded Service Provider. 7. Are site elements (parking lots, pedestrian sidewalks, etc..) requested to be assessed in addition to the building elements? Yes, we would like site elements included as well. It will help us understand the full design and how people will move about and use the facility. 8. Is a certain software specified for use for the FCA collection and analysis? No. 9. Would the license transfer of the software used to collect FCA findings be requested for continued use by the PFA? No, that will not be necessary. 10. Does the client have any design guidelines/standards? If so, can they be shared? We do not have any guidelines/standards for the design. Once a Service Provider is selected, our hope is to provide them with specifics for what we would like to see at our training site. Any previous conceptual designs and master plans that we can review will help us in making our final decision. 11. How many facilities/buildings will be included in the Phase 1 scope of work, and can the location of all the facilities in Phase 1 be provided? Can you please also provide the buildings’ uses (e.g., office, admin, storage, training, etc.) As of now, we are just requesting a conceptual master plan for our grounds. Once we choose a Service Provider, we will provide specific types of buildings that we would like to see in the design. This will include mostly training buildings and potentially one or two buildings for office and storage space. 12. Are there any specific sustainability goals not listed in the RFP (e.g., LEED Certification, etc.)? This will not be required for the conceptual master plan. We just need sketches and arrangement for the proposed facilities. We will conduct further RFPs for specific facilities once we prioritize and have funding for them. 13. Are there any available facility condition reports that have been previously completed? No. We don’t anticipate these types of reports to be necessary for this assignment. 14. Can existing conditions (construction drawings) for the existing facilities to be included in Phase 1 be provided? PFA does have construction drawings for the existing facilities, and those documents can be shared with the awarded Service Provider. Addendum 1 Page 4 of 5 15. Section C. Scope of Proposal Item 5. Requests that we provide a sample facility master plan or comparable plan document as part of our response. Would you like this folded into our response or as a separately submitted pdf document? If you would like it within our response, will it count against the 50-page limit and if yes, may we include an excerpt only as opposed to a complete facility master plan? The sample report can be a separate document or added to the end of your proposal document as an exhibit or appendix. The sample will not count against the page limit. 16. Does the client have a survey of the lot, or will one need to be procured? We have a survey. 17. If a survey is required, is it expected that the design team include a surveyor, or will the client procure one? Should our survey be insufficient, the Service Provider will need to procure a surveyor and add that to the cost of the project. 18. If a survey has already been completed, can it be provided to interested proposers? Yes, please see Exhibit 2. 19. Does the client want full civil site layouts, or just sketches?
