This First Amendment (Amendment #1) is entered into by and between the CITY OF FORT COLLINS (the “City”) and ENNIS-FLINT, INC. (the “Provider). WHEREAS, the Provider and the City entered into Agreement 9576 Preformed Pastics and Preformed Pliant Polymer Goods effective June 1, 2022, through May 31, 2023 (the “Agreement”); and WHEREAS, the Provider and the City entered into a Renewal 9576 Preformed Pastics and Preformed Pliant Polymer Goods effective June 1, 2023, through May 31, 2024; and WHEREAS, the Provider and the City entered into a Renewal 9576 Preformed Pastics and Preformed Pliant Polymer Goods effective June 1, 2024, through May 31, 2025; and WHEREAS, Provider and the City desire to amend the Agreement to revise the pricing schedule. NOW, THEREFORE, in consideration of the foregoing recitals and the mutual promises herein contained, the parties agree as follows: 1. Exhibit D, Compensation is hereby revised with the attached revised rate sheets for ENNIS-FLINT, INC. Any rate sheets not revised by this Amendment #1 shall remain as is per the original Agreement. Except as expressly amended by this Amendment #1, all other terms and conditions of the Agreement shall remain unchanged and in full force and effect. In the event of a conflict between the terms of the Agreement and this Amendment #1, this Amendment #1 shall prevail.
