located east of Lemay Avenue and north of St. Elizabeth Seton Parish, zoned
R-L-P, Low Density Planned Residential.

EXEC[TrIVE SUNIMARY: The applicant is requesting final approval, with condi-
tions, for 15 single family lots on 5.855 acres. The preliminary plan was
approved by the Planning and Zoning Board on Febn.iary 23, 1987 with the
f_ollowirig three conditions: property annexed into the City limits; provide
54' dedicated City ROW; compliance with site distance requirements. The
final plan is in substantial conformance with the preliminary plan. Due to
certain circumstances pertaining to the applicant purchasing the property,

1. Background:
The surrounding zoning and land uses are as Follows:
N: R-L-P; Golf course, South Ridge Greens
S: R-L-P; Saint Elizabeth Seton Church
E: R-L-P; Golf course, South Ridge Greens
W: R-P; Vacant land, no development

The property was previously referred to as Pine Ridge Subdivision. The
Fort Collins City Council approved annexation of the property at its meet-
ing on May 5, 1987. The R-L-P zoning classification was also approved.
The Planning and Zoning Boa�l approved, with 3 conditions, the Preliminary
plan at its meeting on Febnaary 23, 1987. The conditions are as follows:
l. The property is annexed into the Fort Collins City limits, and the
request of R-L-P zoning is approved.
Staff Respone:
The property was annexed into the City limits along with approval of
the R-L-P zoning at the City Council Meeting on May 5, 1987.
2. Prior to final approval, the developer must provide fifty four feet
(54' ) of City right-of-way for Seton Street, and a joint access agree-
ment with Saint Elizabeth Seton Parish.
Staff Response:
The majority of the ROW dedication is to be done by the Saint Elizabeth
Seton Parish Archdiocese. The Archbishop has signed a contract with
Everitt Enterprises agreeing to the access easement and agrees to dedi-
cate 43' of Public ROW. The Church will not actually dedicate the ROW
until final approval of the project has been obtained from the Planning
and Zonirig Board and the property is purchased by the applicants.
3. Prior to final approval, the developer must demonstrate compliance with
the site distance requirements for the intersection of Seton Street and
Lemay Avenue.
Staff Response:
The developer has demonstrated compliance with the site distance
requirement and is reflected on the landscape plan.
The applicant has encountered circumstances which prevent him f_ran obtain-
irx� Planning and Zoning Boan� approval without conditions. The conditions
which the applicant is requesting are as follows:

Within 90 days, the applicant/developer shall:
a. Dedicate 54' of_ Public Right-of-Way for Seton Street.
b. Su�nit signed, original Development Agreement, and mylar plat:
The Bialeks, current owners, will not sign any documents that deal
with this project. Everitt Canpanies is scheduled to close on the
property May 25, 1987, which in turn they will be glad to sign all
documents. The catch is that the land purchase agreement is con-
tingent on obtaining final approval of this project from the Plan-
nirig and Zoning Board.
c. Submit mylar Utility Plans which have been signed by the Fort Col-
lins - Loveland Water District, South Fort Collins Sanitation Dis-
trict.
Currently the property is not with in the boundaries of the water
and sewer district. The Everitt Canpanies plan to petition into
the district once they close on the property. The District has
reviewed the Utility Plans and has the capacity and ability to
serve the site but cannot make official comments regarding their
approval until the property is in the district.
A copy of a letter from Michael Di'T�llio, Fort Collins - Loveland
Water and Sewer District Manager is attached.

The final plan is in substantial confonnance with the preliminary plan.
The Staff reco�nends approval of Oak Ridge Estates with the condition that
within 90 days, the applicant/developer submit the following:
A. Dedication of 54' Public ROW for Seton Street.
B. Signed, original Development Agreement and mylar plat.
C. Signed Utility Plans.
