HomeMy WebLinkAboutEAST OAK TOWNHOMES - PDP230018 - SUBMITTAL DOCUMENTS - ROUND 1 - EASEMENTS 1 December 20, 2023 Ms. Sophie Buckingham City of Fort Collins 281 North College Avenue Fort Collins, CO 80522 Re: East Oak Townhomes Subdivision Request for Variance #1 – Utility Easements Dear Sophie, The East Oak Townhomes Subdivision was presented at a Conceptual Review meeting in September 2023. The latest project site plan is attached. Engineering’s comments included requiring that a 9’ Utility Easement be dedicated along both Oak Street and Mathews Street per Larimer County Urban Area Street Standards (LCUASS). A variance is requested from the LCUASS Chapter 7 Typical Sections to allow this project to move forward without the standard 9’ Utility Easements on the rights-of-way. This variance is requested with the following justifications: 1. Oak Street and Mathews Street are both local streets (per the City Master Street Plan), but both have 100’ wide rights-of-way (much larger than a LCUASS Local Street). All LCUASS Local Streets have 19.5’ from the flowline of the curb to the back of the 9’ Utility Easement. Oak Street has over 20’ from curb to right-of-way line and Mathews Street has approximately 19’ from curb to right-of-way line. Effectively, all the “public” space required for utilizes is already provided within the existing rights-of-way. There are locations for small pocket easements on the site if it is absolutely necessary for a utility to have a facility (box, vault, or pedestal) behind the right-of-way. Through the PDP process we will work with the various utilities and if they need infrastructure on the site, we will add small utility easements to accommodate them. 3. This is an infill project and utilities already existing within the right-of-way. It is unlikely that any utility upgrade would try to move behind the right-of-way line because there is not a consistent easement dedicated. The most likely scenario for any utility upgrade is that it would be replaced in the same location as the existing utility. This variance will not be detrimental to the public health, safety, or welfare. Please call me if you have any questions or require any additional information for the approval of this variance.
