RE: EXTENSION OF ROMA VALLEY DR ACROSS COMMON ELEMENT
Dear Mr.lVordic:
This letter is to confirm that Miramont Associates Limited Liability Company .
("Miramont") conveyed to Miramont Planned Community Assn. ("HOA") Tract E,
Miramont Valley P.U.D., City of Fort Colli.ns, county of Larimer, state of Colorado, as a
Common Element as defined in the Miramont Planned Unit Development Declaration
recorded June 30, 1993, as Reception No. 93043889 in the records of the Larimer County
Clerk and Recorder ("Declaration"). This letter further acknowledges that Mirainont has
the Additional Reserved Rights as provided in Article V, Section 2(a) of the Declaration
to dedicate streets over and across Common Elements. �th the above ackaowledgments
and further ackaowledgi.ng a payment of $S,OUO by Miramont to the HOA, the Executive
Board of the HOA has adopted a resolution acknowledging Miramont's right to dedicate
Roma Va11ey Dr. to the city of Fort Collins, county of Lari:mer, state of Colorado, as a
street extension over and across the Common Element.
The purpose of this letter is to confirm the Executive Boazd's acquiescence in the
dedication and concurrence with the interpretation that Miramont has the reserved right to
make the dedication.
