AMENDMENT #1
AGREEMENT BETWEEN THE CITY OF FORT COLLINS
AND COOPERATIVE PERSONNEL SERVICES
This First Amendment (Amendment #1) is entered into by and between the CITY OF FORT
COLLINS (the “City”) and COOPERATIVE PERSONNEL SERVICES (the “Professional”).
WHEREAS, the Professional and the City entered into an Agreement 9426 Sergeant and
Lieutenant Promotional Process effective January 1, 2022 (the “Agreement”); and
WHEREAS, the parties intend to renew the Agreement for the period, January 1, 2023 through
December 31, 2023; and
WHEREAS, Professional and the City desire to amend the Agreement to replace Exhibit D – Cost
and Work Hours to incorporate the Professional’s 2% price increase and $500 cost increase to
“Expenses.”
NOW, THEREFORE, in consideration of the foregoing recitals and the mutual promises herein
contained, the parties agree as follows:
1. Exhibit D: Cost and Work Hours, is hereby removed and replaced in its’ entirety with the
Exhibit D: Cost and Work Hours attached.
Except as expressly amended by this Amendment #1, all other terms and conditions of the
Agreement shall remain unchanged and in full force and effect. In the event of a conflict between
the terms of the Agreement and this Amendment #1, this Amendment #1 shall prevail.
IN WITNESS WHEREOF, the parties have executed this First Amendment the day and year
shown.

The total cost reflects the steps and time necessary to provide the City with the services
requested. If changes or additional services are required, we will be happy to discuss changes to
the project activities, schedule, and/or cost estimate. CPS HR will invoice the City upon
completion of the project work.

• The City will provide a site for assessor training, candidate orientation, and the
development and administration of examination components.

Assessment Consultant for FCPS Sergeant & Lieutenant Promotional Process
• Testing facilities and time of the City personnel assisting in the development of the
assessment processes will be the responsibility of the City.
• The City will recruit assessors and make all travel arrangements. The City will be
responsible for all associated assessor expenses.
• Besides assisting the City in responding to questions and/or inquiries regarding each
assessment process, we will provide 4 hours of consulting time without charge in defense
of each assessment process if it is legally challenged and/or litigated within six months of
administration. Additional consulting services will be invoiced at the rate of $350.00/hour
for general consultant time and/or actual testimony before any governing bodies or
courts of law, plus expenses. CPS HR will p rovide litigation support as requested by the
City.
