AGREEMENT BETWEEN THE CITY OF FORT COLLINS
AND CMS MECHANICAL SERVICES, INC
This Third Amendment (Amendment #3) is entered into by and between the CITY OF
FORT COLLINS (the “City”) and CMS MECHANICAL SERVICES, INC (the “Service
Provider”).
WHEREAS, the Service Provider and the City entered into an Agreement effective July 24,
2019 (the “Agreement”); and
WHEREAS, Service Provider and the City desire to amend the Agreement to 8909 HVAC
On-Call Services 2019 to renew the term and revise the Compensation Schedule.
NOW, THEREFORE, in consideration of the foregoing recitals and the mutual promises
herein contained, the parties agree as follows:
1. In accordance with Section 4 of the Agreement, the Agreement term will be extended for
one (1) additional year, July 24, 2022 through July 23, 2023.
2. Exhibit D: Bid Schedule/Compensation, is hereby removed and replaced in its'
entirety with the Exhibit D attached hereto.
Except as expressly amended by this Amendment #3, all other terms and conditions of the
Agreement shall remain unchanged and in full force and effect. In the event of a conflict between
the terms of the Agreement and this Amendment #3, this Amendment #3 shall prevail.
IN WITNESS WHEREOF, the parties have executed this third Amendment the day and year
shown.
