Davis, Director of Development Services RE: Innovative Industries/Union Pacific South Third Annexation There may be some questions raised at the Council meeting on Tuesday on the Union Pacific South Third Annexation item. Some of the County residents in the area have raised noise and air quality concerns about the Innovative Companies operation at the adjacent Golden Meadows Industrial Park. These concerns are not germane to the Union Pacific (UP) annexation request. The existing building on the UP property is being used as a box supply warehouse for the A-B brewery. The City Development Staff and County Health Department have spoken to Innovative Companies about their operation. According to the Natural Resources Department, Innovative is currently in compliance with state air quality standards. In terms of the noise concern, we are in the process of meeting with Inno- vative to review their operation to see how we can help. Our ability, how- ever, to enforce noise standards lies with the Police Department. I've noted some development concerns that you may need to share with the Council - Council members may be contacted in the next two weeks about the pending annexation of a parcel of UP land on Harmony and the tracks (west of Timberline) There was a bit of controversy at the Planning and Zoning meeting. Neighbors are annoyed with noise and smoke from Innovative Industries and are leary of industrial development and expansion in the industrial area adjacent to their homes. A PUD condition was added to the annexation and zoning - already passed by Council on 1st reading. The condition may be moot - there is a warehouse on the site to be annexed which will be considered a legal non -conforming use and an expansion can go thru a planning and public review. Because the proposed user is the box assembly, glass recycling to serve Anheuser-Busch there is additional concern that rail traffic will increase. Materials will be delivered by rail - there are 2 rail spurs there but product will go to the brewery on trucks - Harmony to I-25 The neighbors (Golden Meadows and a County neighborhood) may be alerting Council to their concerns. And the building owners - Charlie Lockman and Arlo Deines may also contact the Council. Council is scheduled to hear the item April 19. thanks. Linda
