Dear Eldon,
Staff has reviewed your documents for the Interstate Land P.U.D. - Preliminary that were
submitted to the City on August 21, 1995, and would like to offer the following comments:
1. The East Larimer County (ELCO) Water District has stated that the water line
improvements shown on the preliminary utility plan need to be revised. A 12" water line
must be extended from the 8" line in East Prospect Road to connect to an existing 12" water
line located in the intersection of Smithfield Drive and the West Frontage Road. The new 12"
line must be connected to the existing 6" line located on the west side of the Interstate off -
ramp. The 6" line under the Interstate will someday be replaced by a 12" water line.
Provisions also need to be made to extend a water line to the property immediately north and
west of the Frontage Road.
2. Copies of letters received from the (New) Cache La Poudre and Lake Canal Reservoir
Companies are enclosed with this letter.
3. The Zoning Department has offered the following comments:
a. Show dumpster and bicycle rack locations.
b. Parking needs to comply with the City's Parking Lot Guide. Show "typical"
spaces/back-ups, etc. The 100' scale is difficult to portray true sizes.
C. Add the standard note about the landscaping regarding installation or 125% of
valuation for securement prior to issuance of certificates of occupancy.
d. Need to show lot sizes on the subdivision plat.
e. Show dimensioned building envelopes.

4. A copy of the comments received from the Building Inspection Department is enclosed
with this letter.
5. The Poudre Fire Authority has offered the following comments:
a. Fire hydrant locations and fire flows will be determined by occupancy and building
size.
b. Buildings in excess of 5,000 square feet in size must be provided with an approved
fire suppression system.
6. The Light & Power Department has stated that it appears on the utility plans that storm
drains go behind the curb on both sides of Gateway Drive, in Light & Power's normal
position. This will have to be worked out prior to development.
7. Tim Buchanan, the City Forester, has stated that the adopted Prospect Road Streetscape
Plan indicates that:
sidewalks should be parallel to the road on the Frontage Road
the tree rows should relate to road geometry, not sidewalks.
Copies of blue -lined portions of the Streetscape Plan and Interstate Land Landscape Plan are
enclosed with this letter.
8. The Natural Resources Deparment has stated that you need to contact Myrna Hanson of
the Larimer County Health Department regarding a State Air Quality Permit for control of
fugitive dust during the construction process. You will need to provide evidence that you are
exempt from State requirements or that you have applied for the permit by the time of plan
submittal for Final P.U.D. approval.
9. The Planning Department would like to meet with you and discuss the building layout on
this proposal. A more realistic portrayl, fitted to this site, may be possible.
This completes the review comments at this time. Additional comments will be forthcoming as
comments from various departments and reviewing agencies have not yet been received. Please be
aware of the following dates and deadlines to assure your ability to stay on schedule for the October
23, 1995 Planning and Zoning Board hearing:

PMT's, renderings, and 8 folded copies of final revisions (for the Planning and Zoning Board
packets) are due on October 16,1995.

RE: Interstate Land PUD
Mr. Olt:
The Lake Canal Company exists in Larimer County and Weld County for
the purpose of servicing stockholders with irrigation waters.
Access is a major concern of canal companies for maintenance and
operation of the canal. This at times requires wider access than
a mere roadway for the use of heavy equipment, a place to
temporarily store maintenance material and adequate space to allow
excavation operations with minimal interference. Enough
forethought has not always gone into these easements causing very
poor access to exist along some current residential sections. As
you are aware, we have frequently ask that paralleling utility
easements be utilized to establish green belt borders to minimize
future maintenance on the neighboring development. The Lake Canal
Company has a major flume structure in the northeast corner of Lot
8 of Interstate Land PUD. The Lake Canal Company is requesting
that their easement be established at seventy five (75) feet wide
from the center of the existing canal on the service road
increasing to one hundred (100) feet wide at the intersection of
The Cache La Poudre Reservoir Company inlet canal. The Lake Canal
Company is requesting this to accommodate the extensive maintenance
and operation of the structure which includes periodic burns.
One plan that has been utilized in development along the canal
system has been to leave a green belt parallel to the canal.
Starting from the center of the canal, allowing room for the canal
itself and the paralleling maintenance road, a green belt area is
designated at part of the covenants of the development and
regulations written specifying that only native grasses are ever to
be seeded in the green belt area. This green belt area is
established to be wide enough to serve the needs of both the canal
and the utilities.
In viewing the plan, we are very alarmed to see trees located in
the potential canal easement. It is absolutely essential that a
buffer area parallel the canal that is restricted to native grass
only to prevent future frictions due to maintenance and operation
of the canal.

Another concern is the additional exposure of the canal system to
people. Exposure to water delivery and storage systems creates a
considerable amount of risk. The Lake Canal Company is of the
opinion that development along the system should not increase our
liability. It is the hope of The Lake Canal Company that those who
choose to develop along the system and those who choose to neighbor
along the system will take such precautions as are reasonable to
develop safety measures within their own real property and
accesses.
It is the practice of The Lake Canal Company to refuse drainage
from developed properties to control exposure to undesirable
contaminates that may exist in drainage waters. We request that it
be made clear what the drainage plans are for this plat.
The Lake Canal Company supports the rights of neighboring property
owners to develop their property in an orderly manner consistent
with the county and local master plans. It is the opinion of The
Lake Canal Company that adjustments need to be made to the plans of
Interstate Land PUD to accommodate adequate access for the
maintenance and operation of the canals, to insure that adequate
storm drainage is in place and to seed all easements to native
grasses.
If it is necessary for any services to cross the right-of-way of
The Lake Canal Company, it will be necessary for each entity to
contact the office of The Lake Canal Company, establish and record
crossing agreements. It would be preferred that these crossings be
established during planning and approved before The Lake Canal
Company signs the final plat.
