RECOMMENDATION: Staff recommends adoption of the Ordinances on Second Reading. EXECUTIVE SUMMARY: A. Second Reading of Ordinance No. 28, 1989, Annexing Approximately 110.6 Acres Known as Highway I-25 First Annexation. B. Second Reading of Ordinance No. 29, 1989, Zoning Approximately 110.6 Acres Known as Highway I-25 First Annexation, into the I-L Limited Industrial District. On February 21, Council unanimously adopted Resolution 89-47 Setting Forth Findings of Fact and Determinations Regarding the Highway I-25 First Annexation. On February 21, Council also unanimously adopted on First Reading Ordinance No. 28, 1989 and Ordinance No. 29, 1989 annexing and zoning approximately 110.6 acres of I-25 right-of-way located between County Road 48 and County Road 52. RECOMMENDATION: Staff recommends passage of the Resolution and adoption of the Ordinances on First Reading. EXECUTIVE SUMMARY: A. Resolution 89-47 of the Council of the City of Fort Collins Setting Forth Findings of Fact and Determinations Regarding the Highway I-25 First Annexation. B. Hearing and First Reading of Ordinance No. 28 , 1989, Annexing Approximately 110.6 Acres Known as Highway I-25 First Annexation. C. Hearing and First Reading of Ordinance No. L9, 1989, Zoning Approximately 110.6 Acres Known as Highway I-25 First Annexation, into the I-L Limited Industrial District. Request to annex and zone approximately 110.6 acres of I-25 right-of-way located between County Road 48 and County Road 52. The requested zoning is the I-L Limited Industrial District. Clevenger Chief Engineer BACKGROUND: The State Department of Highways, being the applicant and owner, has submitted a written petition requesting annexation of approximately 110.6 acres of I-25 right-of-way located between County Road 48 and County Road 52. The majority of the property is located within the Fort Collins Urban Growth Area. According to policies and agreements between the City of Fort Collins and Larimer County contained in the INTERGOVERNMENTAL AGREEMENT FOR DATE: February 21, 1989W -2- 7 ITEM NUMBER: 19 a-c THE FORT COLLINS URBAN GROWTH AREA, the City will annex property in the UGA when the property is eligible for annexation according to State law. The property gains the required 1/6 contiguity to existing city limits from a common boundary with the Vine Business Park Annexation and the Allen, Lind and Moore Annexation to the west. A portion of the property is located outside of the Fort Collins Urban Growth Area. The INTERGOVERNMENTAL AGREEMENT FOR THE FORT COLLINS URBAN GROWTH AREA states that the City may annex outside of the Urban Growth area provided that the proposed annexation is sent by certified mail to the Board of County Commissioners thirty-five days prior to the scheduled public hearing. This requirement has been met. The requested zoning for this annexation is the I-L Limited Industrial District.The I-L District designation is primarily for light industrial uses. The property consists entirely of State Highway right-of-way, which is essentially developed. State law requires that land being annexed must be zoned, there fore the property has been zoned in accordance with property located adjacent to it. Findings: The annexation of this area is consistent with the policies and agreements between Larimer County and the City of Fort Collins contained in the INTERGOVERNMENTAL AGREEMENT FOR THE FORT COLLINS URBAN GROWTH AREA. The area meets all criteria included in State law to qualify for a voluntary annexation to the City of Fort Collins. 3. The requested I-L Limited Industrial District is in conformance with the policies of the City's Comprehensive Plan. Planning and Zoning Board Recommendation: The Planning and Zoning Board heard the request at its regular monthly meeting on January 23, 1989, and voted 1-0 to recommend approval of the annexation and zoning. • ITEM HIGHWAY I-25 FIRST Annexation &Zoning NUMBER 104-88, A 0
