RECOMMENDATION: Staff recommends adoption of the Resolution. EXECUTIVE SUMMARY: The applicant and owner, the City of Fort Collins, is requesting annexation of approximately 5.48 acres located west of Overland Trail and south of Mulberry Street (extended). The proposed Resolution makes a finding that the annexation substantially complies with the Municipal Annexation Act, determines that a hearing should be established regarding the annexation, and directs that notice to be given of the hearing. The hearing will be held at the time of first reading of the annexation and zoning ordinances. BACKGROUND: The property is partially located within the Fort Collins Urban GrowtF Area. According to policies and agreements between the City of Fort Collins and Larimer County contained in the Intergovernmental Agreement for the Fort Collins Urban Growth Area, the City will annex property in the UGA when the property is eligible for annexation according to state law. The property gains the required 1/6 contiguity to existing city limits from a common boundary with the Brown's Annexation, the First Locust Grove Annexation, the Overland Trail Annexation, and the Noel Annexation, located to the southeast. Planning and Zoning Board Recommendation: The Planning and Zoning Board will conduct a public hearing on the request for annexation and zoning at its regular monthly meeting on March 27, 1989, and will make its recommendation at that time. The Board's recommendation will be forwarded to the City Council in time for the public hearing and first readings of the annexation and zoning ordinances. RESOLUTION 89-63 OF THE COUNCIL OF THE CITY OF FORT COLLINS INITIATING ANNEXATION PROCEEDINGS FOR THE FORT COLLINS SUBSTATION ANNEXATION WHEREAS, the City of Fort Collins is the sole owner of certain real property to be known as the Fort Collins Substation Annexation; and WHEREAS, the City Council desires to initiate annexation proceedings in accordance with law. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the City Council hereby desires to initiate annexation proceedings in accordance with law for that certain property to be known as the Fort Collins Substation Annexation, more particularly described as situate in the County of Larimer, State of Colorado, to wit: A tract of land situate in the Northwest Quarter of Section 16 and the East Half of Section 17, all in Township 7 North, Range 68 West of the 6th P.M., Larimer County, Colorado, which considering the East line of the Northeast Quarter of said Section 17 as bearing S 00°10'27" W and with all bearings contained herein relative thereto, is contained within the boundary lines which begin at the Northeast corner of said Section 17 and run thence S 89°08'28" E 30.00 feet along the North line of said Section 16; thence S 00°10'27" W 978.41 feet; thence S 00°10'27" W 341.07 feet; thence N 89°12'19" W 30.00 feet to a point on the East line of said Section 17; thence S 00010'27" W 1319.56 feet to the East Quarter corner of said Section 17; thence S 00°16'51" W 411.40 feet along the East line of the Southeast Quarter of said Section 17; thence S 85°06'46" W 30.12 feet; thence N 00°16'51" E 414.11 feet; thence N 00°10'27" E 2203.32 feet; thence N 89°49'33" W 255.00 feet; thence N 00°10'27" E 410.81 feet to a point on the North line of said Section 17; thence N 85°10'57" E 286.09 feet to the point of beginning. Containing 5.4797 acres. Section 2. That the City Council hereby initiates annexation proceedings for the above described property. Section 3. That the Notice attached hereto be adopted as a part of this Resolution. Said Notice establishes the date, time and place when a public hearing will be held regarding the passage of an annexation ordinance pertaining to the above described property. That, on May 2, 1989, at the hour of 6:30 p.m., or as soon thereafter as the matter may come on for hearing in the Council Chambers in the City Hall, 300 Laporte Avenue, Fort Collins, Colorado, the Fort Collins City Council will hold a public hearing upon the annexation for the purpose of finding and determining whether the property proposed to be annexed meets the applicable requirements of Colorado law and is considered eligible for annexation. At such hearing, any persons may appear and present such evidence as they may desire. Dated this 21st day of March, A.D. 1989.
