Note that the F&F portion of this project will be submitted
for permit the week of June 1st. It is anticipated that the.
full permit set for Core and Shell and Tenant
Improvement will be submitted in early July.
The requested variances listed in this letter are the same
as those variances submitted for the Building 4 West
Annex Building on 613113. We are requesting that the
same relevant variances that were approved for the
Building 4 West Annex project be applied to the Building 3
— Warehouse / Test / Office Building.
Variances Requested: Waive specific Commercial Energy
Code and Green Code requirements as
stated below (Items 1 - 4).
Waive accessibility requirements for
mechanical service areas (Lower Level)
(Item 5).
Include non-combustible portions of the
superstructure in the Footings &
Foundations submittal (Item 6). .

BURKETTDESIGN
Pursuant to International Building Code Section 104.10, the building official shall
have the authority to grant modifications for individual cases upon application of
owner's or owner's representative, provided that the modification is in compliance
with the intent and purpose of this code and that such modification does not
lessen health, accessibility, life and fire safety, or structural requirements.
Five (5) separate variances are being requested:
1) Green Building Amendments — Item 5 — IECC 502.4.3.1 & IECC 502.4.3.2
We are requesting that the requirement for Air Tightness Testing be
waived. The manufacturing process requires a large number of air
changes per hour. With this number of air changes, the facilitation of the
air tightness requirement becomes inconsequential. The requirements for
the continuous air barrier system will be maintained per the Green
Building Amendments.
2) Green Building Amendments — Item 4 — IECC 505.8
We are requesting that the requirement for individual electrical panels to
separately monitor building systems be waived. The metering facility will
have extensive metering to monitor process loads and HVAC loads.
However, general receptacles and lighting are a very small portion of the
electrical consumption and it would not be practical or valuable to
segregate these loads for monitoring purposes only.
3) Green Building Amendments — Item 15 — IBC 3603.3
Request that the Low -Volatile Organic Compound (VOC) be relaxed for
the chemical resistant floor coating used on the Lower Level mechanical
area and the Test Level. Manufacturers of the chemical resistant floor
coating do not offer the Low VOC product. The chemical resistant floor
coating is required in the clean room manufacturing process.
We are also requesting that the Low -Volatile Organic Compound (VOC)
be relaxed for some of the epoxy coatings at the walls, columns and air-
flow slab. We will provide the low VOC epoxy products if available from
the manufacturer.
All other low VOC material requirements will be maintained per the Green
Building Amendments.
4) Green Building Amendments — Item 17 — IBC 3604.1
Request that the requirement for independent Commissioning Agent
reviews be waived. This function is typically provided by Avago personnel
with special knowledge of the -building systems and operations.

5) Limited Accessibility to Mechanical Service Areas — IBC Chapter 11
Request that the general accessibility requirements be relaxed for access
to the mechanical service areas of the Lower Level. The PPE and
gowning protocols cannot accommodate persons with disabilities. The
PPE and gowning requirements exist due to the cleanroom protocol. In
addition, the functions that must be performed in this space require the.
use of ladders, equipment lifts and heavy tools. Avago is committed to
providing ADA accessibility to the majority of their occupied spaces and
provide numerous job functions that can be performed safely by persons
with disabilities.
6) Submit Portions of Superstructure with Footings & Foundation Package
Request that certain portions of the non-combustible superstructure be
included in the submittal and review of the Footings & Foundation
package. These portions include, all above grade cast -in -place concrete
structure and all structural CMU walls.
