The deed format and legal look good for the row dedication. To finalize this I need:
a. Processing fee of $250 (check made out to the City of Fort Collins)
b. Deed signed by Del Sol, Notary and Del Sol's Attorney.
c. A check for the filing fee. 4 pages, so it is $26 and this check needs to be made
out to "Larimer County Clerk and Recorder".
The DA was sent out for review February 4, 2011. I have not heard back with any
questions or comments. If there are no concerns regarding this document it needs to be
signed and returned to me with a check for $71 made out to the "Larimer County Clerk
and Recorder" for the filing fees for the 13 page document.
I have no remaining comments on the Utility Plans. Please make sure you get the
districts signature on the mylars before they are submitted to the City. Once the mylars
are received they will be routed for signatures, but Engineering will not sign the mylars
until the above items have been received.

The revised site plan doesn't match Sheet 2 of 2 of the utility plans. The site plan needs to show the
sidewalk and revised landscape island dimensions. If the sidewalk results in the need to remove the
tree and other landscaping from what remains of the island, then a tree and ground cover will need
to be reinstalled. The island has to be at least 10' in depth (distance from sidewalk to east edge of
island). If a new tree is required, it must be a 2" minimum caliper deciduous street tree (Linden,
Locust, etc).
R See revised Site and Landscape Plan prepared by Shear Engineering Corporation.
R Tree relocation or replacement note has been added to the site plan. The tree has been situated in
the landscape area between the curb and gutter and the detached walk.

This letter is in response. to your comments noted in a January 22, 2003 memo to Matt Lafferty.
Transportation/Access Issues:

1. This project will have impact on SH 287, and therefore requires review and approval by the
Colorado Department of Transportation (CDOT). The applicant will need to contact Tess
Jones at (970) 350-2163 of the Greeley office of CDOT for setback and right-of-way needs,
as well as general access questions for this proposal.
Response
• I talked to Tess at 2:20PM on Monday, January 27, 2003. She was not familiar with the
project. I sent her a fax package of information with a quick note. Attached is a copy of the
letter I sent with the project location information. I called her back on Wednesday, January
29, 2003 and left a message. Have not heard back.
Comment:
2. According to Section 9.7.4 of the LCLUC, right-of-way dedication (36-foot half right-of-way
for this project must be accomplished by a properly executed Deed of Dedication at the time
of final approval.
Response
• Attached are the right-of-way and easement dedication documents for both Lots 37 and 38.
The right-of-way and an easement dedication formats are similar to those that we recently
completed in the County associated with Hearthfire P.U.D. Second Filing. These were
acceptable to the County.

Comment:
3. According to Section 1.9.3.B.3 of the Larimer County Urban Area Street Standards, Bueno
Drive must be built to the Commercial Local Street standard where it is adjacent to the
subject property, including proper transitions and sidewalks. The following issues must be
addressed before staff can recommend approval:
• The new cross-section must extend, at minimum, to the property line. It appears the
pavement at the south part of the property does not meet this requirement. Please adjust.
• It is unclear if curb and gutter will be installed along the new cross-section. Please
clarify. What type of curb and gutter will be installed? Rollover, vertical, etc?
• The site in relation to the new cross-section does not appear to be the same on every page
of the plans. For example, the layout shown on the cover page and page 4 is not the same
as what is shown on page 3 and 5. Please adjust.
ResRonse
• There is an existing pipe invert accommodating the property to the south which must be
accommodated with new curb, gutter and walk construction for Lots 37 and 38. Therefore, a
small portion of the curb and gutter was removed near the south portion of Lot 38 to allow
runoff from the pipe to the south to reach the new curb and gutter to the north. The walk is
represented to the south property line.
• Construction Item 1 on the Master Improvements Plan (Sheet 4) clearly identifies "vertical
curb and gutter". We have "X"d out the rollover curb and gutter detail on the curb and gutter
detail referenced on sheet 8.
• Sheets 3, 4 and 5 now represent the same conditions.

1. There:. are some drainage concerns with this project, especially in relation to the area storm,
sewer crossing near the property and off -site drainage issues. The applicant must contact Rex
Burns with the ;Larimer County Engineering Department: to address these issues before the
next submittal.

I talked to Rex. Burns at. 11:15AM on Monday, January 27, 2003_ He indicated that. Ed
Woodward sent a letter to the Fossil Creek HOA. Ed provided me with a copy of that letter.
It is attached for your immediate reference. The letter gives a February, 14, 2003 deadline
date for the Fossil. Creek HOA to respond. Rex also indicated that building permits would be
released due to previous understandings and efforts concerning the storm sewer outfall for
South.13.

These comments identify items still needed to meet the prior comments —
A draft development agreement has is with the City Attorneys office for review. Once I
receive comments back a draft agreement will be forwarded onto the applicant for review
and comment.
Legal description, deed, and fees for the area to be dedicated has not yet been received.
Once these are received they will be reviewed.
The utility plans to improve Bueno Drive adjacent to the property to City Standards have
been reviewed. Comments are:
General Notes 19, 40, 41, 47, and 48 need to be added to the plans. These are the notes
that can not just be referenced since each note is customized to the project.
See Redlined plans and utility plan check sheet for additional comments (these are
available at the counter for pick up).
Centerline and profiles for each flowline including the 500 feet off -site is needed. The
flowline profile that has been provided does not include any slope or design information.
The street section for this roadway is to be the Industrial Local street section which
matches the '/z row width of 33 feet. Thus the curbline needs to be moved west to
provide for the standard x-section and minimum parkway width.
Ideally the existing centerline profile meets standards and the centerline elevation will not
need to be reconstructed, but I don't know at this point if the existing centerline profile
can remain as is. Centerline profile and flowline profiles will determine what
construction/ reconstruction will need to take place for this section of street in front of
this lot to meet standards for design and construction.
I don't know if a mill and overlay from centerline to flowline and property line to
property line is adequate or does the street section need to be rebuilt? Until cores and
pavement design are proposed this won't be known. This also depends on if the current
centerline and cross slopes meet standards as to whether this can just be a property to
property line job.
These plans need to match the site plan and show what is to be done for the landscape
area behind the sidewalk and show the new trash enclosure.
Where does the curb stop sit in relation to the edge of the sidewalk? If it is within the
sidewalk enough concrete sidewalk will need to be on all sides to make sure it is a solid
section and will not break off (sidewalk may need to be widened around the curb stop to
achieve this.
What are the driveway widths. Maximum driveway width is 36 feet.
Need additional details for the driveways. How they are to be built, the grades and
enough information to verify grades can be tied into within the ROW or identify any off -
site easements that might be needed.
Make changes to details so they match our details or provide City details. Additional
details 1601 and 1602 are needed as well.

In order for the redevelopment of this site (change of use), the following apply:
This property was developed in the county and recently annexed into the City. Under the
annexation policy the street in front of this property remains the obligation of the
property owners for maintenance, until such time as the street is brought up to City
standards (curb, gutter, sidewalk, width and pavement design).
As identified above Bueno has not been constructed and improved to City street
standards. This creates a couple of complications and requirements in order for this
property to gain approval.
First in accordance with Section 3.3.2(F) of the Land Use Code a development is required
to have an improved connection to the arterial roadway, which in this case is College
Avenue. As identified above Bueno is not considered improved. One way to meet this
requirement is for Bueno to be improved from this property out to College Ave. The
code also identifies a waiver possibility. I have not been able to meet with the City
Engineer yet to determine if the waiver option is a possibility and what if anything might
be needed to provide the information for a waiver consideration. I am hoping to find this
information out within the next couple of days and will update the comments when I have
that information.
This property is responsible for improving the adjacent portion of Bueno, not just because
of the annexation policy, but also the City Code requires this at the time of development
or redevelopment of the property prior to issuance of a building permit. To accommodate
the industrial local street cross-section this property will need to dedicate an additional 3
feet of row along the frontage of the property. Engineering development review can
provide sample documents and information on this. There is a $250 processing fee and
Larimer county recording fees will apply). If a waiver to the improved street connection
requirement identified above can not be granted the project will need to design and
constructed from this property to College Avenue. If a waiver to the improved street
connection requirement is granted, this project will be required to provide a cash escrow
to cover the costs of the design and construction of the improvements adjacent to this site.
A development agreement will also need to be entered into documenting the
requirements. Please contact Engineering Development Review to get a copy of the
information for development agreement sheet, so we can gather the owner and property
information needed to start drafting this document. Larimer County Recording fees will
apply as this document once signed will be recorded at the county.

R Limits of driveway construction are now consistent. Sheet 4 has been revised to show entire
proposed driveway.
d. Cl, per the sections it looks like much of this matches existing grades. Please clarify where
the two match (existing and proposed) and where the two differ.
R The entire design matches the existing Bueno Drive centerline elevations.
e. There are several places where the grade breaks exceed standards (4%). Need to look at
adjusting the grades or providing variances with justification.
R The grades have been adjusted and the grade breaks do not exceed the standard .4%.
f. Where do the grade breaks occur along the flowline?
R We have labeled "grade break" at each station in which a grade break occurs. Grade breaks at
the flowline are generally the same as the grade breaks at the centerline.
g. The fl grades on this sheet do not match those shown on sheet 4.
R Foowline grades match those on Sheet 4.
h. Elevation numbers along the side of the grid are off. They don't appear to match the grades
labeled on the profile.

The street section for this roadway is to be the Industrial Local street section which matches the %Z
row width of 33 feet. Thus the curbline needs to be moved west to provide for the standard x-section
and minimum parkway width.
R In order to meet Fort Collins — Loveland Water District separation requirements from the existing
water line on the east side of Bueno Drive, A twenty five foot (25') one-half street section has
been provided on the east side of Bueno Drive.
R A thirty six foot (36') right-of-way will be dedicated with Lot 11.
R The twenty five foot (25') one-half street section and the thirty six foot (36) right-of-way
adjacent to Lots 37-38 on the west side of Bueno Drive are noted because that is what exists
today for Lots 37-38. Refer to attached response letter to Roxann Mackenzie Hayes, P.E., Senior
Civil Engineer with Larimer County; letter dated: January 29, 2003.
