Tyler,
My comments - I note two areas for further discussion:
ILE Natural Resource — We need to clarify COFC ("Owner") vs. Developer responsibilities for the Habitat Buffer Zone and
possibly delineate lease footprint and perimeter landscape as one zone and Habitat Buffer as another.
11.1.1 Dev. Constr. Permit — Refers to a Sidewalk Permit for Multi -Use Path — I would look either for deletion of this
paragraph or for some clarification on timeline as this is a future site improvement.

Hi Michelle and Norm,
Attached is the Draft Development Agreement for the Riverside Solar Garden for your review. At the request of our
attorney, I have removed the sidewalk obligations from the development agreement and this will be handled with a
separate memo between COFC Utilities and COFC Engineering. If COFC Utilities and CEC would like to add language to
the development agreement about reimbursement for the fence costs that is ok with me. I believe that Norm is working
on a separate memo that will address this as well.
Regarding the responsibilities for landscaping and the Habitat Buffer Area plantings, I was not part of those discussions
so I am not sure who is responsible. The language that I received from Stephanie and Lindsay from Natural Areas
references the Developer (CEC) is responsible. See section ILE on page 5, 6, 7 of the agreement. If we need to change
the language to Owner (COFC Utilities) is responsible please let me know. You may want to set up a meeting with
Stephanie and/or Lindsay to confirm this so we are all on the same page.
Please review the agreement and let me know if you have any revisions, questions or concerns.
Thanks,
Tyler Siegmund

Hey Tyler -
Been trying to put together a logical note to place on the site plan regarding the multi -use path — let me know if you
want any specific language or edits, but what I've come up with so far: (h
A
"The multi -use path shown is for illustrative purposes only and will be constructed at a later date when future
conS. hisgitehasbe ffiderMfie&A commitment t&+he future construction of the path by Fort
Collins Utilities is in the project's Development Agreement." {

I don't know how if we want to ecifically address an interim crusher -fine path, or if that's best left to a minor
amendment if/when that occurs.
Thanks, I
