RE: Utility Easement Vacation at 1705 North College Avenue
The City's Utilities Department recently replaced a 60-year old sanitary sewer located
approximately on -half block west of North College Avenue between Alpine and Willox. The
new sewer line required a new alignment in some sections of the project. The property located .at
1705 North College Avenue is platted as Schrader Commercial PUD. This plat included a
dedication for a 10-foot wide utility easement which was for the old sanitary sewer line. The
new sewer line required a different alignment and a new utility easement was acquired from the
owner. During negotiations with the owner for the new utility easement, City staff agreed to
assist the owner with requesting the old easement area be vacated as it is no longer needed for
utility purposes.
I have attached for you a copy of the Schrader Commercial PUD plat showing the utility
easement to be vacated, a copy of the Easement Deed for the newly acquired utility easement,
and the legal description for the proposed vacation area.

OF THE DIRECTOR OF PLANNING, DEVELOPMENT, AND TRANSPORTATION
SERVICE UNIT OF THE CITY OF FORT COLLINS
VACATING A PORTION OF THE EXISTING UTILTY EASEMENT THROUGH THE
WESTERN HALF OF LOT 1, SCHRADER COMMERCIAL P.U.D
WHEREAS, Section 2.1.5 of the Land Use Code of the City of Fort Collins
authorizes the Director of Planning, Development, and Transportation Service Unit to
vacate certain easements by resolution or by approval of replats containing notation of
such dedication; and
WHEREAS, the Owner has requested that the City vacate a portion of the
original 10 foot utility easement. This vacation request is limited to the original 10 foot
wide utility easement and does not overlap or vacate any part within the recently
dedicated 30 foot utility easement granted December 12, 2011 (Reception #
20120002636). Vacation of the original 10 foot utility easement is more particularly
described on Exhibit "A".
WHEREAS, the vacation has been reviewed and approved by the pertinent City
Departments and utility providers, which departments and utility providers report no
objection to the vacation.
NOW, THEREFORE, be it resolved by the Director of Planning, Development,
and Transportation Service Unit of the City of Fort Collins, that a portion of the existing
10 foot utility easement through the western half of Lot 1, Schrader Commercial P.U.D,
as more particularly described on Exhibit "A", attached hereto and incorporated herein
by this reference, is hereby vacated.
Passed and adopted by the Director of Planning, Development and Transportation
Service Unit of the City of Fort Collins this 10 day of September, 2012.
