To whom it may concern,
I am writing this letter to serve as a description of two 6' utility easements that Provincetowne
Investments, LLC wishes to vacate a portion of in the subdivision Provincetowne Filing Three,
specifically Phase 3A. The 6' utility easements are located between Lots 16 and 17, Block 12.
We must vacate 3' of each easement.
Due to the utility easements on Lots 16 and 17, Block 12 the required setbacks only allow for a
39' building envelope which violates the standard building envelope required in the subdivision.
This phase of construction is complete. These two easements were not used by Fort Collins Light
and Power, Excel Gas, Century Link Telephone or Comcast Cable.
We do not foresee any issues arising from the vacation of these utility easements.

To whom it may concern,

specifically Phase 3B. The 6' utility easements are located on Lots 23 and 24,131ock 12. We must
vacate 3' of each easement.
Because of the 6' utility easements on Lots 23 and 24, Block 12 the required setbacks only allow
for a 39 foot building envelope which violates the standard building envelope required in the
subdivision.
We do not foresee any issues arising from the vacation of these utility easements.
This phase of construction will be started in the next 30 days.

RESOLUTION NO. AD12-20
OF THE DIRECTOR OF PLANNING, DEVELOPMENT, AND TRANSPORTATION
SERVICE UNIT OF THE CITY OF FORT COLLINS
VACATING A PORTION OF THE SIDELOT UTILITY EASEMENTS ON LOTS 16, 17,
23, AND 24 ON BLOCK 12, PROVINCETOWNE FILING THREE
WHEREAS, Section 2.1.5 of the Land Use Code of the City of Fort Collins
authorizes the Director of Planning, Development; and Transportation Service Unit to
vacate certain easements by resolution or by approval of replats containing notation of
such dedication; and
WHEREAS, the Owner has requested that the City vacate portions of the side lot
utility easements on lots 16, 17, 23, and 24 on Block 12, Provincetowne Filing Three, as
more particularly described on Exhibit "A", "B", "C", and "D".
WHEREAS, the vacation has been reviewed and approved by the pertinent City
Departments and utility providers, which departments and utility providers report no
objection to the vacation as long as 3 feet of each side lot easement is dedicated back
as utility easement since it has been determined that only portion of the utility easement
to be vacated is not currently being utilized for utility purposes.
NOW, THEREFORE, be it resolved by the Director of Planning, Development,
and Transportation Service Unit of the City of Fort Collins, that the portions of the sidelot
utility easements on lots 16, 17, 23, and 24 on Block 12, Provincetowne Filing Three, as
more particularly described on Exhibit "A", "B", "C", and "D", attached hereto and
incorporated herein by this reference, is hereby vacated.
Passed and adopted by the Director of Planning, Development and Transportation of the
City of Fort Collins this day of June 2012.
