Re: Cargill — Repair guarantee and reimbursement opportunity for public improvements
Mr. Stadelmaier,
As discussed during the Basic Development Review process for the Cargill Greenhouse
project at 2540 East Drake Road, Fort Collins, CO 80525, the Developer, "Cargill
Research", is responsible for installing public improvements, which consist of a six foot
wide public sidewalk and a ten foot landscaped parkway along the East Drake Road
frontage of the property as part of the Cargill Greenhouse project. This letter is intended to
highlight the requirements and opportunities associated with the public improvements in
lieu of a development agreement.
In accordance with the Municipal Code, Section 24-95, the "Developer" is responsible for
the public street improvements adjacent to developable property. In addition, Section 24-
112 of the Municipal Code states that the City of Fort Collins Street Oversizing
Reimbursement Program shall pay certain costs associated with increasing the width of
public improvements, such as sidewalks, from the local status of 4.5 feet to the arterial
status of a 6 foot wide sidewalk.
Agreements made with "Cargill Research" during the Basic Development Review process
for the Cargill Greenhouse project include:
Cargill Research understands and agrees to the two-year maintenance guarantee
and five-year repair guarantee as identified in section 3.3.2(c)(2) of the Fort Collins
Land Use Code as it relates to the installation of the public sidewalk and associated
landscaping within the ten foot parkway along the frontage of the property.
Per section 24-112 of the Fort Collins Charter and Municipal Code, Cargill
Research acknowledges that they are eligible for reimbursement from the City's
Street Oversizing Reimbursement Program for the 1.5 foot oversized portion of the

six foot wide sidewalk that is being installed along East Drake Road as part of this
project.
By signing this document, "Cargill Research" acknowledges and agrees to the conditions
set forth as it pertains to the Cargill Greenhouse project.
