Schedule: Expected completion in 2000. H. Recommendation The Planning and Zoning Board at their regular business meeting on November 15, 1979, recommended approval of the Preliminary P.U.D. Plan of the First Christian Church subject to the following conditions: 1. That all parking lots meet the minimum design standards as specified by City staff; 2. That a minimum 6' bike lane and 5' sidewalk be provided on both sides of Drake Road and along Lemay Avenue; 3. That three additional landscaped islands be provided per staff comments; 4. That all hydrants and fire access roads be installed for each phase prior to building construction; 5. That the developer work with City staff to develop an agreeable design solution for the Lemay/Drake intersection; 6. The Board was concerned about the 20 year phasing of the preliminary plan and recommended that the developer request master plan approval for the entire site, with preliminary plat approval for the first phase. At such time as the applicants wish to construct the second phase of the project, a preliminary plan would be submitted and following the normal procedures and requirements of the P.U.D. regulations. The site is located on the south- east corner of the intersection of Lemay Avenue and Drake Road, all with- in the municipal limits. The property is .zoned R-L-P, Low Density Planned Residential, and R-P, Planned Residential, and is presently vacant. Submittal Dear Mr. Frank, As for the City of Fort Collins Planning and Zoning Board action on the above project at the preliminary P.U.D. review last Thursday evening Novem- ber 15, 1979, the First Christian Church of Fort Collins shall agree to the following conditions of our plans: 1. All parking lots shallmeet minimum design standards as specified by city staff. 2. A six foot bike lane and a five foot sidewalk shall be provided on both sides of Drake Road and along Lemay Avenue (responsibility of north side of Drake shall be assumned by Everitt Enterprises as previously agreed). 3. Three additional landscape parking islands shall be provided as per staff comments. 4. All fire hydrants and fire access roads for each phase shall be in- stalled prior to starting construction. 5. The developer shall work with the city staff to develop agreeable design solution for the Lemay-Drake intersection. Further more, it is our understanding that with the board approval of the master plan First Christian Church is provided the following rights under a 20 year building program: 1. To exceed city standards for entrance/exit drive. 2. To delay construction of privacy fencing on the east property line until such time that future parking lots in that proximity are developed. 3. To exceed the fourty foot height restriction in the construction of the future sanctuary/auditorium. Putting all "intents" aside, I believe the minutes reflect that the council action taken that night did, in fact, grant a height variance to the "Master Plan" which continues today. Then the question arises if the height variance is for the perpetuity of the Master Plan or for a period of twenty years. The last statement on page 2 of the Agenda Item Summary prepared for the 12/4/79 council meeting erroneously states that the applicants understand and concur with staff recommendations. It continues to refer to a "letter of agreement" from the applicant which, in fact, states contrary to the staff recommendations that it was their understanding (as Trustees of the church) that First Christian Church was provided the right "...to exceed the forty foot height restriction in the construction of the future sanctuary/auditorium..." "...under a 20 year building program." (See attached 11/19/79 letter.) Other than the reference to this letter in the agenda, neither of us have a letter -of -response although one was requested if the letter contained inaccuracies. Very truly yours, Carl J. Dear Steve: Thank you for conducting the neighborhood meeting last night. I feel we were able to communicate the intent of the church so that most concerns were satisfied. I have reviewed the minutes of the 12/4/79 city council meting which you provided to me last night. I have two important observations: 1. The height variance document which was reviewed by the council and referenced in the minutes illustrated the completed development including the intended sanctuary and tower. (See attached.) 2. In the third paragraph of page 284, the minutes reflect that there was discussion about the "Master Plan", and it states:"...the Master Plan which would grant the applicant a variance on the height,...". Then the minutes continue to record that it was moved and seconded to approve the First Christian Church "Master Plan" and First Phase Preliminary Plan. It passed with no exceptions taken.
