It only meant that we would have to read the entire agreement since it did not come from our base agreement: I also mentioned that drafting the development agreement at that time was premature. We would draft the agreement when the utility plans were nearing completion. I said I would keep the draft agreement that she prepared and use it as a guide for what the Developer wanted in the agreement. I did not read Lucia's draft agreement until last week. I believe that Love and Associates may have been using that draft as their instructions and the City had not agreed to it. If you have any questions please let me know. This response addresses the Engineering Department comments referred to in the memo. The following is the comment as stated in the memo followed by my response. COMMENT: "Engineering in now requiring improvements to Vine Drive adjacent to Waterglen that are contrary to the direction Love was given by City staff last year; and contrary to the Staff's position on street oversizing. * It is unfair to change requirements at this late date." RESPONSE: We do not believe that the requirements are any different t n were given at any time on this project or any other projec 'he street- / mprovements to V ni a Drive along the frontage o e Waterglen site % /must be constructed with curb, cutter, sidewalk and pavement in o ac r_dance with the City arterial street standards. The'6eveloper shall be respon ible for-Tie-whoi"e mptovemerit of"£he local street portion and the oversized portion in accordance with the street oversizing policy of the City to provide enough street surface to stripe the lanes necessary to replace the existing lanes and the additional lanes necessary for this development. Vine Drive must be designed in accordance with City standards and reconstructed (the existing pavement is not in good enough condition to overlay). The Developer is not eligible for street oversizing reimbursement. The only variation from the City standard requirements was for the off site improvements to Vine Drive. The Developer was granted an option to overlay the existing Vine Drive (approximately 2.5 miles to the west to Lemay) in lieu of having to reconstruct the street to City standards. The Developer would not be eligible for reimbursements for the offsite improvement. In the last meeting I had with Love and Associates, Nancy Love kept mentioning a development agreement from which she got her direction for what to design. I could not recall any agreement. However, I just found a draft agreement in my file attached to a letter from Lucia Liley dated May, 1995.
