May 22, 1995 P & Z Meeting Page 4 RECOMMENDATION: Staff recommends approval of Resolution.PZ95-12 Abandonment of a Portion of the Indian Hills West P.U.D. and a Portion of the Indian Hills Village P.U.D. - *81-93B. Resolution PZ95-12 Abandonment of Lot 108 and a Portion of Tract A of the Indian Hills West P.U.D. and a Portion of Tract A of the Indian Hills Village P.U.D. May 22, 1995 P & Z Meeting Page 3 Section 29-527 EFFECT OF PLANNED UNIT DEVELOPMENTS of the Land Development Guidance System states that: A. In the event that a property has obtained development approval of a preliminary or final planned unit development. plan pursuant to Section 29-526 of the Code, such property may not thereafter. be developed in any other fashion, except when such development is for the purpose of continuing or expanding any legal use (but not to include a previously approved subdivision or planned unit development) which existed upon the property at the time of the approval of the planned unit development plan; or upon the occurrence of the following event: (2) The owner of the property has obtained the approval, by resolution, of the Planning and Zoning Board to abandon the right to develop the property (or any portion thereof) in accordance with the approved planned unit development plan, in which event the right to develop other than as a planned unit development shall apply only to the portion of the property which is no longer subject to the planned unit development plan. In order to replat and develop Lot 108 and a portion of Tract A of the Indian Hills West P.U.D. and a portion of Tract A of the Indian Hills Village P.U.D. as parts of the Indian Hills Village P.U.D.., Phase 2, the Planning and Zoning Board must grant approval by resolution to abandon those portions of the original Indian Hills West and Indian Hills Village P.U.D.'s. 3. Design: FINDINGS of FACT/CONCLUSIONS: In evaluating the request for a Resolution to Abandon a Portion of the Indian Hills West P.U.D. and a Portion of the Indian Hills Village P.U.D., staff makes the following finding of fact: * In order to replat and develop Lot 108 and a portion of Tract A of the Indian Hills West P.U.D. and a portion of Tract A of the Indian Hills Village P.U.D. as parts of the Indian Hills Village P.U.D., Phase 2, the Planning and Zoning Board must grant approval by resolution to abandon those portions of the original Indian Hills West and Indian Hills Village P.U.D.'s. Resolution PZ95-12 Abandonment of Lot 108 and a Portion of Tract A of the Indian Hills West P.U.D. and a Portion of Tract A of the Indian Hills Village P.U.D. May 22, 1995 P & Z Meeting. Page 2 COMMENTS: 1. Background: The surrounding zoning.and land uses are as follows: N: RM; existing single family residential (Bristol Subdivision) S: rp; planned/approved single family residential (Indian Hills Village P.U.D.) E: RL; existing single family residential (Indian Hills Subdivision) W: rp; planned/approved single family residential (Indian Hills Village P.U.D.) The property was annexed into the City with the South College Avenue Consolidated Annexation in April, 1957. The easterly three-quarters (3/4) of the property was platted as Lot 108 and a part of Tract A of the Indian Hills West P.U.D. that was approved by the Planning and Zoning Board in June, 1979. The undeveloped portion of the Indian Hills West P.U.D., approximately 6.2 acres in size, was abandoned by resolution of the Planning and Zoning Board in July, 1992 to allow construction of Rivendell (private) School as a use -by -right. The westerly one -quarter (1/4) of the property was platted as a part of Tract A of the. Indian Hills Village P.U.D. that was: approved by the Planning and Zoning Board in May, 1994. This P.U.D. is contiguous to the subject property on the south and west. 2. Land Use• Abandonment of a Portion of an Approved P.U.D.: This is a request to abandon the right to develop Lot 108 and a portion of Tract A of the Indian Hills West P.U.D. and a portion of Tract A of the Indian Hills Village P.U.D. (see Exhibits "A" and "B", attached) in accordance with the approved P.U.D. plans. The applicant is proposing to abandon portions of the P.U.D,'s that include the currently platted Lot 108 and portions of Tracts A of both P.U.D's and then replat and develop the area as two single family residential lots and an open space tract to be known as Indian Hills Village P.U.D., Phase 2. The total area is 9,867 square.feet (0.22 acre) in size. The property is located on the south side of East Stuart Street (601 East Stuart) between Stover Street and Busch Court and is zoned rp - Planned Residential. RECOMMENDATION: Approval EXECUTIVE SUMMARY: This is a request to abandon the right to develop Lot 108 and a portion of Tract A of the Indian Hills West P.U.D. and a portion of Tract A of the Indian Hills Village P.U.D. in order to replat the property and approve a new development plan known as Indian Hills Village P.U.D., Phase 2. The Planning and Zoning Board must grant approval by resolution to abandon those portions of the original Indian Hills West and Indian Hills Village P.U.D.'s.
