DECISION
Based on the findings and conclusions, the request for the Harvest Park Subdivision
Filing 2 Replat is approved.
Dated this 27th day of April 2001, per authority granted by Sections 1.4.9(E) and 2.1 of

easement configurations continue to adequately serve the access, utility, and
drainage needs. All utilities currently using the existing easement
configuration have reviewed this request, and have no conflicts with the new
configuration.
4. Findings of Fact/Conclusion:
A. The Harvest Park Subdivision Filing 2 Replat contains a permitted use in the
LMN - Low Density Mixed Use Residential Zoning District.
B. The Harvest Park Subdivision Filing 2 Replat meets the procedural requirements
located in Division 2.1 - General Procedural Requirements, Division 2.2 -
Common Development Review Procedures for Development Applications, and
Section 2.4 - Project Development Plan located in Article 2 - Administration.
C. The Harvest Park Subdivision Filing 2 Replat meets the plat requirements
located in Section 3.3.1 - Plat Standards located in Article 3 - General
Development Standards.
RECOMMENDATION:
Staff recommends approval of the Harvest Park Subdivision Filing 2 Replat, file # 25-
98E.
FINDINGS AND CONCLUSIONS
After reviewing the staff report and the record of the public hearing, the Hearing Officer
makes the following findings and conclusions:
A. The Harvest Park Subdivision Filing 2 Replat is subject to administrative review
and the requirements of the Land Use Code (LUC).
B. The Harvest Park Subdivision Filing 2 Replat conforms to standards of the LMN
zoning district.
C. The Harvest Park Subdivision Filing 2 Replat conforms to the applicable plat
standards as put forth in the Land Use Code.
D. Future development of the property will be required to meet Land Use Code
Division 2.6 DEVELOPMENT CONSTRUCTION PERMITS, and, Division 2.7
BUILDING PERMITS.

The PDP for this subject site was approved on January 5, 2000. The approved PDP
shows the alley connecting at Rock Creek Drive rather than Corbett Drive.
2. Article 2 - Administration:
The request complies with the applicable requirements of the LUC, specifically the
procedural requirements located in Division 2.1 - General Procedural Requirements,
Division 2.2 - Common Development Review Procedures for Development Applications,
and Section 2.4 - Project Development Plan located in Article 2 - Administration.
3. Article 3 - General Development Standards:
The request complies with the applicable requirements of the LUC, specifically the plat
requirements located in Section 3.3.1 - Plat Standards located in Article 3 - General
Development Standards.
A. The replat is in compliance with Section 3.3.1(A) General Provisions in that:
1) The subdivision plat will be filed and recorded only after having been
approved by the Director of Planning, with such approval evidenced in writing
on the plat and signed by the City Clerk.
2) No building permit or certificate of occupancy shall be issued for construction
of any new principal building or no act which changes the use of any building
shall be permitted until the subdivision plat is filed and recorded in the City of
Fort Collins.
B. The replat is in compliance with Section 3.3.1(B) Lots in that:
1) Each lot has direct vehicular access to a public and the side lot lines are
substantially at right angles or radial to the street lines.
2) The general layout of lots, roads, driveways, utilities, drainage facilities and
other services within the proposed development were established with the
approval, filing, and recording of Harvest Park Subdivision PDP. The design
of the adjacent platted roads is unaffected.
C. The replat is in compliance with Section 3.3.1(C) Public Sites, Reservations
and Dedications in that:
1) The rights -of -way for the adjacent streets (Corbett Drive and Rock Creek
Drive) and the drainage and utility easements necessary to serve this area
were dedicated with the Harvest Park Subdivision plat that is on record in the
City of Fort Collins. The reconfigurations of the lots and tracts change the

NOTICE OF PUBLIC HEARING: Notice of public hearing was made on March 30, 2001
by mailing to property owners within 500 feet of the
subject property.
The public hearing was advertised in the Coloradoan.
PUBLIC HEARING
After reviewing the Staff Report and recommendation, a public hearing was held on the
subject application at 4:00 PM on April 13, 2001. The hearing was held in Conference
Room D at 281 North College, Fort Collins, Colorado.

PROJECT DESCRIPTION:
This request is to replat Lots 8,9, 10 and a portion of Tract A-1 Block 7 of Harvest Park
Subdivision. The purpose of this replat is to bring the lot pattern into conformance with
the approved Project Development Plan. In the original subdivision plat the alley (Tract
A-1) took a 90-degree turn and ran between lots 8 and 9. This replat straightens the
alley so that it runs behind 8,9 and 10 and connects with Rock Creek Drive rather than
Corbett Drive. The lots and tracts affected by this replat are all in the in the LMN (Low
Density Mixed Use Neighborhood) zone district.
