FACILITY (US WEST) - PDP/FDP - 11-97E - CORRESPONDENCE - (3)MODIFICATION OR AMENDMENT This agreement constitutes the entire understanding between the Owner and the Contractor. No modification, amendment, renegotiation or other alteration to the terms of the agreement shall be of any force or effect unless mutually agreed upon by the parties and embodied in writing. INSURANCE Workman Compensation, public liability and property damage insurance shall be provided by the Contractor. Certificates of insurance shall be furnished to the Owner prior to the commencement of such work. ADDITIONAL ITEMS The Owner and / or their management representatives reserve the right to withhold payment if the work performed does not meet these contract specifications. Payments withheld will be paid upon the completion of any disputed work to the reasonable satisfaction of the Owner and within the reasonable scope of the Contractor. Owner assic's L ndscapi' & lawn Care Even though every precaution will be taken to avoid damage to property, Contractor will not be held responsible for damages to unlocated utilities or underground services that are the responsibility of the Owner. Contractor assumes no responsibility for present or future damage due to subsurface conditions; for example, lack of or non functioning perimeter drain, improperly installed sump system, improperly compacted backfill, improperly operated irrigation system ( present and proposed ), inadequate or non functioning downspout extensions. excessive watering of landscape, etc... COSTS: a. Soil prep. $ 350.00 b.Trees & Installation $ 2425.00 c. Fabric & Mulch $ 587.00 d. Maintenance $1,700.00 Total cost $ 5,062.00 The above prices are good for 30 days. ( tree prices are based on current nursery stock ) PAYMENT TERMS Half down $ 2,531.00 Half on completion $ 2,531.00 If payment is not made within 30 days of issuance of a letter of completion by the building inspection division ( City of Fort Collins ) then the Owner agrees to pay interest of 1.5% on the unpaid balance until paid. The Owner will pay all court costs and/or collection fees necessary to collect payments that are 45 days past due. WARRANTY a. Trees are under warranty for a period of one year from the date of installation. b. T OCT 17 ffn ief ell In consideration of the covenants herein, the following Agreement is entered into at Wellington, between SBA, INC., hereafter referred to as owner and CLASSIC'S LANDSCAPING AND LAWN CARE, hereinafter referred to as contractor. SCOPE OF WORK, SOIL PREP, INSTALLATION & MAINTENANCE OF TREES; a. Soil Prep 1,000 sq.Ft . b. Prep includes ripping the soil 6" - 8" deep, spreading 3 yrds of compost Reripping the soil 3" - 5" deep, roll and grade area. c. Install seven 7' B & B Austrian Pines or Blue Spruce or as otherwise directed by US West Wireless. d. Includes delivery, plant mix, staking, cedar mulch and weed barrier as per specs. MAINTENANCE a. Maintenance to include watering of trees for a period of two seasonal years. ( season being 26 weeks. ) b. Season will commence at completion of installation of trees. c. Any changes, additions or deletions to scope of work require a formal change order authorized by contractor. GUARANTY All materials, methods and processes used in the performance of the work shall conform to the standards of the professional landscape trade and it is assumed that the Contractor is familiar with such requirements or that he will familiarize himself therewith. The Contractor will perform the work in a safe and lawful manner, using capable employees or sub -contractors and will comply with applicable laws, regulations and requirements of municipal and or governmental bodies exercising authority.The compliance shall include the procuring of any required licenses or permits.
